AN ORDINANCE:
ADDING SECTION 12.1-17.4 TO THE PERSONNEL MANUAL REGARDING
USE OF TOWN VEHICLES
WHEREAS, recent IRS regulations regarding personal use of town vehicles
has been revised to require adoption of a formal written policy statement on
commuting; and
WHEREAS, the Town of Leesburg must comply with all IRS regulations:
THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. Chapter 12.1 of the Town Code is amended by adding a new sec-
tion to be known as Section 12.1-17.4, Use of Town Vehicles for Co~nuting
to and from Work to read as follows:
Sec. 12.1-17.4. Use of Town Vehicles for Commutin~ to and from Work
For those employees assigned the use of a town vehicle on a t~egty-four
~our basis and who are permitted to use the vehicle for commuting to and from
work the followin~ conditions shall apply:
(1) The use of the vehicle is restricted for personal purposes ~nly
for commuting to and from work except in those instances of de minimis .personal
use (such as a stop for a .personal errand between a business associated trip and
~he employee's home).
(2) That with the exception of d_~e minimis personal use, town vehicles
are in no manner to be used by town employees for personal use or to conduct
personal business.
(3) For each d~ that the employee uses the town vehicle for commuting
purposes, the town shall add an appropriate amount to the employee's gross
income to equate a relative value for the employee's use of the vehicle.

The only employees with take-home vehicles that would be exempt from
these provisions will be those with vehicles found to be exempt under Internal
Revenue Code Section 274(i).
