"GRAFFITI" OF THE CODE OF THE BOROUGH OF CARTERET
BE IT ORDAINED by the Mayor and Borough Council of the Borough of
Carteret (the "Borough") as follows:
Section 1 § 140-5(A). Violations and penalties is hereby amended as follows:
(1) delete $500; insert $1,250
Section 2 § 140-5(B). Violations and penalties is hereby amended as follows
delete $1,000; insert $1,250
Section 3 § 140-5. Violations and penalties is hereby amended to add the
following:
C. Any person who is convicted of violating an ordinance within
one year of the date ora previous violation of the same ordinance
and who was fined for the previous violation, shall be sentenced by
a court to an additional fine as a repeat offender. The additional
fine imposed by the court upon a person for a repeat offense shall
not be less than the minimum or exceed the maximum fine fixed
for a violation of the ordinance, but shall be calculated separately
from the fine imposed for the violation of the ordinance.
Section 4 All ordinances or parts thereof inconsistent with the provision of
this ordinance are hereby repealed limited to the extent of any
such inconsistency.
Section 5 If any section, paragraph, sub-division, clause or provision of this
ordinance is adjudged invalid, such adjudication shall apply only
to the section, paragraph, sub-division, clause or provision so
adjudged and the remainder of this ordinance shall be deemed
valid and effective.
Section 6 This ordinance shall take effect upon its passage and publication
according to applicable law.
