AN ORDINANCE AUTHORIZING A RESIDENTIAL DEVELOPMENT UNIT PROJECT PUR-
SUANT TO ARTICLE 45 OF ORDINANCE 2325-1968, AND PROVIDING FOR A
SPECIAL USE PURSUANT TO ARTICLE 48 OF ORDINANCE 2325-1968 COMMONLY
CALLED THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA APPROVED
JUNE 3, 1968.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA
THAT:
SECTION 1.01: The following described real estate situated in the
City of Richmond, Wayne County, Indiana:
Being a part of the Northeast Quarter of Section 9, Town-
ship 13 North, Range 1 West in the City of Richmond,
Indiana, and being Lots Numbered 76 to 101, both inclusive,
and a part of South 20th Street and a part of South P
Street, said Lots and Streets being in Richard's Addition
to said City of Richmond, Indiana, and being more parti-
cularly described as follows:
Beginning at an iron spike found at the southeast corner
of the Northeast Quarter of said Section 9, and running
thence, from said beginning point, west, along the south
line of said Northeast Quarter, (assuming that said south
line runs east and west),. 1590.00 feet to an iron rod set;
thence north 0 degrees and 01 minute west, parallel to the
east line of said Northeast Quarter, 1153.81 feet to an
iron pipe set; thence north 89 degrees and 16 minutes east
303.82 feet to an iron pipe set on the west line of South
20th Street; thence continuing north 89 degrees and 16
minutes east, along the south line of South 0 Street,
892.30 feet to an iron pipe set at the intersection of
said south line with the west line of South 22nd Street;
thence south 0 degrees and 01 minute east, along the west
line of said South 22nd Street, 310.00 feet to an iron pipe
set on the south line of South P Street; thence north 89
degrees and 16 minutes east, along the south line of said
South P Street, 394.00 feet to an iron rod set on the east
line of said Northeast Quarter; thence south 0 degrees and
01 minutes east, along said East line, 863.78 feet to the
place of beginning, containing an area of 39.669 acres, there
being 6.350 acres in said Richards Addition, and 33.319 acres
in said Ncrtheast Quarter.
SUBJECT TO: The right-of-way of South 23rd Street, the Wernle
Road, South 20th Street, and South P Street, and any ease-
ments of record.
ALSO:
Beginning at a point in the south line of the Northeast
Quarter of said Section 9, said point being 825.00 feet
east of a spike found at the southwest corner of said
Northeast Quarter, and running thence, from said beginning
point, continuing east, along the said south line, (assum-
ing the said south line runs east and west), 245.63 feet
to an iron rod; thence north 0 degrees and 01 minutes west,
parallel to the east line of said Northeast Quarter, 1153.81
feet to an iron pipe; thence south 89 degrees and 16 minutes
west, 246.32 feet to a point on the east line of a dedicated
50.00 foot wide street; thence south 0 degrees and 03 min-
utes east, along the said east line, 1150.66 feet to the
place of beginning., containing an area of 6.506 acres.
SUBJECT TO: The right-of-way of Wernle Road and any easements
of record.

is and the same is hereby allowed as a Special Use and is classified
as Residential Development Unit Project, subject to the provisions of
Article 45, Ordinance No. 2325-1968 relating to Development Unit Pro-
jects as follows:
SECTION 1.02:
a. The name of the project shall be Vista Pines Residential
Unit Development Project.
b. Vista Pines Residential Unit Development Project shall
conform to the standards prescribed in Articles 45.031
through 45.039 and 45.040 and 45.041 of Ordinance No.
2325-1968 as shown by copy of Land Use and Density Plan
for Vista Pines Residential Unit Development Project,
attached, marked Exhibit A and made a part of this
Ordinance.
SECTION 1.03
The Plan Commission and the Common Council make the following findings
relating to Vista Pines Residential Unit Development Project:
a. It complies with the Comprehensive Master Plan for
the City of Richmond.
b. It will not adversely affect neighboring property.
c. It is at a location where traffic congestion does not
exist at present on the streets to be utilized in con-
junction therewith. Undue congestion is not likely
to be created as a result of this project.
d. The Land Use and Density Plan provides for integrated
and harmonious design of buildings, for adequate and
properly arranged facilities for internal traffic
circulation, off-street parking and loading, landscaping
and such other features and facilities as may be necess-
ary to make the project attractive and efficient from
the standpoint of the developer as well as from the
standpoint of the adjoining or surrounding existing
or potential developments.
e. The site for Vista Pines Residential Unit Development
Project is an R-3 District appropriate for the develop-
ment proposed.
SECTION 1.04:
The Plan Commission and the Common Council place the following special
conditions upon Vista Pines Residential Unit Development Project:
a. PHASE I and PHASE II as shown on the Land Use and Den-
sity Plan, shall be granted preliminary and final
approval. PHASE III as shown on Land Use and Density
Plan.,.shall,be granted preliminary approval only.
b. Improvement Location Permits for any structure shall
be issued only after the following requirements are
met prior to each Phase of Development shown on the
Land Use and Density Plan.
Vista Pines, Inc. or its successor shall file an Allo-
cation Plan for each Phase.

(1) The Plan Department shall make an administrative
review of the allocation plan for each phase, which
shall include dimensions of proposed lots and struc-
tures and parking areas where applicable. The allo-
cation plan for each phase shall be reviewed to deter-
mine compliance with buildable areas, land usage,
density, open areas, parking areas, access and
right-of-way provisions and other pertinent factors.
(2) Vista Pines, Inc. or its successor in interest shall
obtain Board of Public Works and Safety Approval of
drainage plans, access drive plans and specifications
and right-of-way plans and specifications for each
phase.
(3) Vista Pines, Inc. or its successor in interest shall
also obtain Richmond Sanitary District Board or
Commissioners' approval of sewage plans for each
phase.
(4) Vista Pines, Inc. shall dedicate to the City of Rich-
mond, Indiana, additional right-of-way for Wernle
Road and South 23rd Street as shown on the Land Use
and Density Plan.
(5) Vista Pines, Inc. shall dedicate to the City of Rich-
mond, Indiana, right-of-way for the proposed South
20th Street extending from Wernle Road to the northern
project boundary of Vista Pines Residential Unit De-
velopment Project as shown on the Land Use and Density
Plan.
(6) Vista Pines, Inc. or its successor in interest shall
obtain approval of drainage plans from the County
Ditch Board.
c. Should Vista Pines; Inc.. or its successor in interest fail to
comply with any of the conditions set forth in this section,
or with any requirement provided for by Article 45 of Ordi-
nance 2325-1968, or with any requirements provided for by
the Plan Commission as condition of approval of any alloca-
tion plan for any phase, this Ordinance shall be void.
SECTION 2.01:
The area designated as Phase I on the Land Use and Density Plan is and the
same hereby classified as a Special Use pursuant to Article 48 of Ordinance
2325-1968 as follows:
SECTION 2.02:
a. The facility approved as a Special Use shall be a one -hundred
(100) bed I.C.F. nursing care center called Vista Pines Care
Center.
SECTION 2.03:
The Plan Commission and Common Council make the following findings:
a. Vista Pines Nursing Care Center is necessary for the public
convenience at the location shown on the Allocation and
Land Use Plan.
b. Vista Pines Nursing Care Center is so designed, located and
proposed to be operated that the public health, safety
and welfare will be protected.

c. Vista Pines Nursing Care Center will not cause substantial
injury to the value of other property in the neighborhood
in which it is to be located.
SECTION 3.
This Ordinance shall be in full force and effect from and after its
passage and approval as by law required.

Re: Ordinance No. 3308-1977 - Plan Commission Case PC-77-17
Vista 'Pines, Inc., 2000 Wernle Road; requesting approval
for a Residential Unit Development. Project, and requesting
a Special Use for a 100 bed nursing care center
Dear Mr. Carter; Members of the Council and Mrs. Trimble:
The Richmond City Planning Commission conducted a public hearing on
Ordinance No. 3308-1977 on Tuesday, December 20, 1977.
All parties interested or affected by thi's Ordinance were given an
opportunity to speak.
The petitioners presented their request and no one spoke in opposi-
tion or returned letters sent to adjoining property owners soliciting
opinions or remarks.
The Planning Commission voted unanimously,'S-O, to recommend approval
of the request for preliminary approval of the total plan and final
approval on the phased construction marked Phases I and II on the
development plan; also.reconauended approval of a Special Use request
for a 100 bed nursing care facility.,
Recommended conditions for approval are set out as conditions in the
Ordinance with special emphasis on the condition which would require
County ditch board approval for a retention basin at the southeast
corner of the project area. It was also recommended that the drawings
submitted be adopted as a part of the Ordinance with final working
drawings to be approved administratively by the Director of Planning
prior to the issuance of zoning clearances and building permits.
Commissioners Bartz, Kyle and Tiano were not present at this meeting.
