HomeMy Public PortalAbout3309-1977 - REZONING PART OF NOTHEAST QUARTER OF SEC NINE TOWNSHIP THIRTEEN NORTH RANGE ONE WESTORDINANCE NO. 3309-1977 AN ORDINANCE REZONING A PART OF THE NORTHEAST QUARTER OF SECTION NINE (9), TOWNSHIP THIRTEEN (13) NORTH, RANGE ONE WEST FROM R-2 (SINGLE FAMILY RESIDENTIAL) TO C-1 (NEIGHBORHOOD BUSINESS) CLASSIFICATION PROVIDING FOR A NEIGHBORHOOD COMMERCIAL CENTER PURSUANT TO ARTICLE 45 OF ORDINANCE NO. 2325-1968 COMMONLY CALLED THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA APPROVED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana that: SECTION 1: The following described real estate situated in the City of Richmond, Wayne County, Indiana: Being a part of the Northeast Quarter of Section 9, Town- ship 13 North, Range I West in the City of Richmond, Indiana and being more particularly described as follows: Commencing at an iron pipe at the northwest corner of said quarter and running thence North 89 degrees 15 min- utes East, 180.00 feet along the north line of said quarter to an iron rod at the place of beginning of this description; thence North 89 degrees 15 minutes East, 562.27 feet along said north line to the centerline of a 60 feet wide street; thence South 00 degrees 03 minutes East, 147.64 feet along said centerline to a point -of - curve; thence 295.55 feet along a centerline curve to the left to a point -on -curve, said curve having a central angle of 15 degrees 41 minutes 03 seconds and radius of 1079.66 feet; thence South 89 degrees 15 minutes West, 602.47 feet; thence North 00 degrees 03 minutes West, 440.00 feet to the place of beginning containing an area of 5.768 acres. is and the,same is hereby rezoned from single-family residential (R-2) classification to neighborhood business (C-1) classification. SECTION 2.01: The real estate described below situated in the City of Richmond, Wayne County, Indiana Being a part of the Northeast Quarter of Section 9, Town- ship 13 North, Range 1 West in the City of Richmond, Indiana an d being more particularly described as follows: Commencing at an iron pipe at the northwest corner of said quarter and running thence North 89 degrees 15 min- utes East, 180.00 feet along the north line of said quarter to an iron rod at the place of beginning of this descrip- tion; thence North 89 degrees 15 minutes East, 562.27 feet along said north line to the centerline of a 60 feet wide street; thence South 00 degrees 03 minutes East, 147.64 feet along said centerline to a point -of -curve; thence 295.55 feet along a centerline curve to the left to a point - on -curve, said curve having a central angle of 15 degrees 41 minutes 03 seconds and radius of 1079.66 feet; thence South 89 degrees 15 minutes West, 602.47 feet; thence North 00 degrees 03 minutes West, 440.00 feet to the place of be- ginning containing an area of 5.768 acres. ALSO: Being a part of the Northeast Quarter of Section 9, Town- ship 13 North, Range 1 West in the City of Richmond, Indiana and being more particularly described as follows: ORDINANCE NO. 3309-1977 Page 2 Commencing at an iron pipe at the northwest corner of said quarter and running thence North 89 degrees 15 minutes East, 742.27 feet along the north line of said quarter to the centerline of a 60 feet wide street at the place of be- ginning of this description; thence North 89 degrees 15 minutes East, 668.80 feet along said north line to the centerline of South 20th.Street; thence South 00 degrees 01 minutes East, 460.00 feet along said centerline to a point; thence South 89 degrees 15 minutes West, 622.54 feet to a point -on -curve in the centerline of said 60 feet wide street; thence 316.30 feet along a centerline curve to the right to a point of tangency, said curve having a central angle of 16 degrees 47 minutes 08 seconds and a radius of 1079.66 feet; thence North 00 degrees 03 minutes West, 147.64 feet to the place of beginning containing an area of 6.9517 acres. is and the same is hereby allowed as a Special Use and is classified as a Neighborhood Commercial Center, subject to the provisions of. Article 45, Ordinance 2325-1968 relating to Neighborhood Commercial Center as follows: SECTION 2.02: a. The name of the project shall be Syncom Neighborhood Commercial Center. b. Syncom Neighborhood Commercial Center shall conform to the standards prescribed in Article 45.02 through 45.025 and 45.05 through 45.06 of Ordinance 2325-1968 as shown by copy of the Land Use and Density Plan for Syncom Neighborhood Commercial Center, attached, marked Exhibit "A" and made a part of this Ordinance. SECTION 2.03: The Plan Commission and Common Council make the following findings relating to Syncom Neighborhood Commercial Center: a. It complies with the Comprehensive Master Plan for the City of Richmond. b. It will not adversely affect neighboring property. c. It is at a location where traffic congestion does not exist at present on the streets to be utilized in con- junction therewith. Undue congestion is not likely to be created as a result of this project. d. The Land Use and Density Plan provides for integrated and harmonious design of buildings, for adequate and properly arranged facilities for internal traffic circulation, off-street parking and loading, landscaping and such other features and facilities as may be necessary to make the project attractive and efficient from the standpoint of the developer as well as from the standpoint of the adjoining or surrounding existing or potential developments. e. The site for Syncom Neighborhood Commercial Center is a C-1 District appropriate for the development proposed. ORDINANCE NO. 3309-1977 Page 3 SECTION 2.04: The Plan Commission and Common Council place the following special condi- tions upon Syncom Neighborhood Commercial Center: a. Phase I, as shown on the Land Use and Density Plan, shall be granted preliminary and final approval. Phase II, as shown on the Land Use and Density Plan, shall be granted preliminary approval only. b. No improvement location permit for any structure shall be issued until the following requirements are met for each Phase of Development shown on the Land Use and Density Plan: 1. Syncom Inc., or its successor shall file an allocation plan for each phase. 2. The Planning Department shall make an adminis- trative review of the.allocation plan for each phase, which shall include dimensions of pro- posed lots, structures, and parking areas. The allocation plan for each phase shall be reviewed to determine compliance with buildable areas, landscaping, density, open areas, parking areas, access and right-of-way provisions and other pertinent factors. 3. Syncom Inc. or its successor shall obtain Board of Public Works and Safety approval of drainage plans, access drive plans and specifications and right-of-way plans and specifications for each phase. 4. Syncom Inc. or its successor shall also obtain all necessary approvals from the Wayne County Ditch Board for drainage plans into the County ditch. 5. Syncom Inca or its successor shall obtain Richmond Sanitary District Board of Commissioners' approval of sewage plans for each phase. c. Should Syncom Inc. or its successor fail to comply with any of the conditions set forth in this section, or with any requirement provided for by Article 45 of Ordinance No. 2325-1968, or with any requirements provided for by the Plan Commission as conditions of approval of any alloca- tion plan for any phase, this Ordinance shall be void. SECTION 3. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. Richmond, Indiana 47374 Re: Ordinance No. 3309-1977 - Plan Commission Case PC-77-18 Syncom Inc.., 1111 East 54th Street, Indianapolis, Indiana, requesting to rezone from R-2 One -Family Residence District to C-1 Neighborhood Business District on property located at 2000 Wernle Road Dear Mr, Carter, Members of the Council and Mrs. Trimble: The Richmond City Planning Commission held a public hearing on Tuesday, December 20, 1977, on the petition of Syncom Inc. requesting a rezoning from R-2 to C-land a Special Use for a commercial Planned Unit De- velopment. The petitioners represented their request and no one spoke in opposition. No letters were returned for or against the proposal. The Planning Commission voted unanimously, 6-0, to recommend approval of the request with the conditions as shown in the Ordinance, and fur- ther recommended the development plan be adopted as a part of the Ordinance, with the deletion of the curb cut on South "L" Street. The request is For preliminary approval of the entire site and final approval for that area designated Phase I. The rezoning request from R-2 to C-1 is for Phase I of the development plan only. Final working drawing shall be approved by the Planning Director prior to the issu- ance of a zonina clearance and building permits.
