AUTHORIZING TIlE ACQUISITION OF TITLE TO A PORTION OF
BLOCK 4, LO, T 1
WHEREAS, on November 1, 2003, the Borough of Carteret ("Borough") opened and
dedicated for public use Phase I of its new Waterfront Park; and
WHEREAS, Phase I of the Waterfront Park includes a four hundred (400') foot municipal
fishing pier and a boat launching ramp; and
WHEREAS, the Borough currently leases a portion of real property designated as Block 4,
Lot 1 on the official tax map of the Borough of Carteret for vehicular and pedestrian access
and for parking of vehicles and boats and trailers for the Waterfront Park; and
WHEREAS, the Borough has plans for an expansion of the Waterfront Park to include Phase
II which involves the development of seventeen (17) additional waterfront acres for passive
recreation and public use to include picnic areas, walkways and a children's park; and
WIIEREAS, a planned Phase III of the Waterfront Park is under design to include an
approximately two hundred fifty (250) slip municipal marina; and
WHEREAS, the Borough is in need of permanent use and access to the portion of Block 4
Lot 1 presently under lease from Keystone NJP II LLC, and as delineated pursuant to the
survey and map attached thereto and prepared by the Borough l~ngineer, for public and
vehicular access and for parking of vehicles, boats and trailers, all necessary for the public use
and enjoyment of the Borough's existing and proposed expansion of its Waterfront Park.
NOW, TIIEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of
Carteret, County of Middlesex, State of New Jersey as follows:
1. That the appropriate Borough officials, including the Borough Attorney, be
and are hereby authorized and directed to take all necessary action to initiate the
acquisition of title to the above referenced portion of Block 4, Lot 1 through
negotiations with the property owner, and are hereby further authorized and directed to
effectuate the acquisition of title to said real property through the exercise of the
Borough's powers of eminent domain should that be necessary.
2. That a copy of this Ordinance be forward to the Borough Attorney and the
Borough's Purchasing Department.
3. That a copy of this Ordinance be kept on file in the Borough Clerk's office.
