BE IT ORDAINED BY the Comm Council of the City of Richmond, Indiana., as follows: SECTION 1. WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968, designates and describes as 0-1, GREENBELT DISTRICT, the following described property located at 711 Sheridan Street, in the City of Richmond, Indiana, more particularly described as follows: TRACT I: �.X part of Lot Jk4 in the Cincinnati and Fort Wayne Railroad Addition to the City of Richmond, beginning at the Southeast corner of State and Sheridan Streets and running thence Southward on the East line of Sheridan Street 100 feet; thence Eastward parallel with the South line of State Street 152 feet, more or less to the center of what was formerly Sheridan Street; thence Northwardly along said center line of what was formerly Sheridan Street to State Street; thence West along State Street 261-, feet, more or less, to the place of beginning. ALSO, Lots #1 and Jk2 as laid out by the Cinc3nmti and Fort Wayne Railroad Company in a plat of land situated Northwest of the Cincinnati and ChicagoJaUroad Bridge across the White - water River, subject to the right of way of said railroad, the Cincinnati and Fort Wayne Railroad along the North side of the Cincinnati and Chicago Railroad, all of which will more fully appear by reference to the plat of said lots recorded in the Recorder's Office of said Wayne County, said lots being within the City of Richmond. Being the same property as was conveyed by deed of Anna M. Fetta and Alfred H. Fetta to Mary E. Fetta of date November 30, 1898, and recorded in Deed Record 110 at pages 432 and 433 in the Recorder's Office of said Wayne County, to which reference is hereby made Excepting therefrom a strip of land conveyed to the P.C.C. & St. L. Railroad Company from the South side of said lots for additional right of way. , SECTION 2. WHEREAS, it is the intent and purpose hereof to change the zoning classification of the above described area fran 0-1, Greenbelt Dis- trict to M-2 General Industrial District, and, SECTION 3, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the day of , 1976, at which time remonstrances were heard ron all parties interested in or affected by this Ordinance. SECTION 4, GMEREAS, the vote of the Richmond City Plan Commission was to in favor of/in opposition to recommending the passage of Ordinance No. 3085-1976. UDIN SECTION 5. It is hereby ordained that the zoning classification of the above described property be, and the same is hereby changed to M-2 General Industrial District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amend- ments thereto. SECTION 6. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. SECTION 7. The original zoning classification of the aforementioned area is hereby rescinddd and the --,zoning classification of this area will be in accordance with Section 2 of this Ordinance. COMMISSION RICHMOND, INDIANA I.Aspo Mr. Kenneth Mills, President May 27, 1976 Members of the Common Council & Mrs. Jo Ellen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance 3073-1976, Plan Commission Case 76-7, Commons Lumber Company, 711 Sheridan Street, re- uesting rezoning from 0-1 (Greenbelt) to M-2 General Industrial District) Dear Mr. Mills, Members of the Council & Mrs. Trimble: The Richmond City Plan Commission held a public hearing on Tuesday, May 25, 1976, at 7:30 P.M. in the Council Chambers of the Richmond Municipal Building to hear the request of Commons Lumber 'Company, 711 Sheridan Street, for rezoning from 0-1 to M-2. All parties interested in or affected by this request were heard. One (1) person spoke in favor and there was no one present to speak in opposition. Letters had been sent to adjoining properties, with two (2) returned un- opposed. The Plan Commission made the following findings in reaching their recommenda- tion: 1. Retention of this parcel of ground in an 0-1 Greenbelt classification is not as critical to the protection of the Whitewater valley as conventional wisdom in 1968 had determined. 2. Federal legislation governing pollution makes most industrial uses less objectionable on•this site. 3. Additional geological information indicates that ground faults do not exist on this site and that vibrations from industrial machinery will not have the devastdting effect on the cliff face as once thought. The Plan Commission voted eight (8) to zero (0) to grant this petition and forward the request to Common Council. Respectfully submitted, DEPARTMENT OF CITY PLANNING Robert B.
