ORDINANCE NO. 3090-1976
AN ORDINANCE TO AMEND ORDINANCE NO. 2432-1969 COMMONLY KNOWN AS THE GARBAGE
AND RUBBISH CONTROL ORDINANCE OF THE CITY OF RICHMOND, INDIANA
WHEREAS the City of Richmond, Wayne County, Indiana, has an Ordinance No.
2432-1969, same being known as the "Garbage and Rubbish Control Ordinance",
and
WHEREAS said ordinance now prohibits the burning of Leaves, at any time, and
citizens of the City of Richmond have expressed themselves to be in favor of
each citizen who wishes to be privileged to burn or otherwise dispose of
their own Leaves for a trial period.
NOW THEREFORE, be it ordained by the Common Council of the City of Richmond,
County of Wayne, State of Indiana, that
SECTION I. During the period of time from October 15, 1976 until November
15, 1976, any person may dispose of leaves which have been collected from
the property which said person maintains or inhabits as the residence of
said person by open burning.
SECTION II. Such "burning" as hereinbefore referred to in above Section I
shall be done only at the residence of the person.
SECTION III. Such person who shalt so burn Leaves coLZected from his or
her own residence shall do so not as agents for the aforesaid City of Richmond,
but only for themselves and said person shall be solely responsible for
any and all consequences of such open burning.
SECTION IV. The word "person" as used in this ordinance shall mean living
individual. The word "person" shall not mean any partnership, association,
syndicate, company, firm, trust, corporation, government corporation, depart-
ment, bureau, agency or any other entity recognized by Law.
SECTION V. Nothing in this amendment shall be deemed to repeal, canceZ, or
alter in any way Ordinance No. 2432-1969 of the City of Richmond except as
specifically hereinbefore set out.
