AN ORDINANCE ESTABLISHING THE MAXIMUM SIZE, WEIGHT AND TYPE OF VEHICLES WHICH
MAY`USE THE MUNICIPAL PARKING FACLITY COMMONLY KNOWN AS THE DOWNTOWN PARKING
GARAGE AND ESTABLISHING REGULATrONS FOR THE USE OF SAID DOWNTOWN PARKING
GARAGEANDPRQ'VIDIN G PENALTPES FOR THE 'VIOLATION THEREOF.
WHEREAS, the City of Richmond, Wayne County, Indiana, hereinafter called "City",
caused to be built -a multi -level municipal parking facility"located between
South 7th Street and South 8th Street, and long immediately south of the first
Public Alley running in an easterly and westerly direction south of the Promenade,
formerly known as Main Street, which Facility is commonly known as, and herein-
after called "'Downtown Parking Garage'" and
WHEREAS, City, by virtue of its powers does operate said Downtown Parking Garage
for and in the public interest and benefit; and
WHEREAS, the purpose of erecting and operating said Downtown Parking Garage is
to provide parking facilities for private passenger vehicles and private
pleasure.vehi,cles; and
WHEREAS, said Downtown Parking Garage has structural limi,tations pertaining to
the. size and weight of vehicles that are to park therein, the exceeding of which
would cause, damage to srai'd Downtown Parki`ng Garage; and
WHEREAS, it is necessary to impose restrictions upon the use of said Downtown
Parking Garage. as to the size, weight and kind of vehicles using the same and
the speed and -manner of operating vehicles therein so as to promote the public
welfare. and to safeguard against damage or injury to said Downtown Parking
Garage and the patrons of the same and the general public;
NOW THEREFORE, be it ordained by the Common Council of the City of Richmond,
Wayne County,, State of Indiana, as follows:;
SECTI;dN 1. It fs unlawful for any person to operate in the Downtown Parking
ggr,49e any,Jeiii`cle. licensed as a priyate passenger ve.h.itcle or private pleasure
Neiti,`cle as defined by Motor 'Vehicle Statutes of the State of I'ndi'ana; provided,
howaYer, that the. Board of Puhli;c Works, and Safety of the City of Richmond,
Wayne. County, State of fndi`ana, may be appropriate resolution designate a portion
of the. Downtown Parking Garage for use by bYcycles and/or motorcycles or other
yehilcles.
SECTION 2. I't is unlawful for any person to operate intheDowntown Parking
Garage any vehicle which has, a height in excess of seven feet (7') or any
vehicle which has attached thereto or situated thereon any object the height of
which, in combination with the height of said vehicle, shall exceed seven feet
(7 )
SECTION 3. It is unlawful for any person to operate in the Downtown Parking
Garage any vehicle which shall have a gross weight in excess of seven thousand
(.7000) pounds, or a gross weight on any wheel of said vehicle in excess of two
thouaand (2000j pounds.
SECTION 4. It is unlawful for any person to operate in the Downtown Parking
Garage any vehicle which contains or carries upon such vehicle any highly
combusti°onable or explosive material of any kind, except fuel for such vehicle
contained i"n tanks or storage compartments, which tanks or storage compartments
shall constitute: an integral part of such vehicle and are located upon such
Nehi;cle solely, for the purpose of carrying such fuel.
SECTION 5. It is unletful for any person to operate in the Downtown Parking
Garage any vehicle at a speed greater than ten miles per hour (10 MPH).
SECTION 6. It is unlawful for any person to park any vehicle in the Downtown
Parking Garage in any area except between lines which shall identify parking
spaces for ve.htcles in the Downtown Parking Garage.
SECTION 7. Any person violating any provision of this ordinance shall be
guilty of a misdemeanor and upon conviction thereof, shall pay a fine of not
more than Three Hundred Dollars ($300.00) or be imprisoned for a period not
excee.di;ng thirty days: (3Q) or be. both fined and imprtsone.d. Each Violation
shall constitute a separate offense and shall be punishable as such.
SECTION 8. Each section of this Ordinance shall be considered separable and
the ftyaltdfty of any, one or more sections of this Ordinance shall not affect
or impair the yali;dtty of any other secti'on of this Ordinance.
SECTION 9. Thi;s, Ordinance shall be in full force and effect from and after
i;ts passage, approval by, the. Mayor and publication as required by law.
