AN ORDINANCE TO AMEND ORDINANCE NO. 2432-1969, COWONLY KNOWN AS THE GARBAGE AND
RUBBISH CONTROL ORDINANCE OF THE CITY OF RIa MOND, INDIANA.
WHEREAS, the City of Richmond, Wayne County, Indiana, has adopted Ordinance No. 2432-
1969, the same being known as the "garbage and rubbish control ordinance"; and,
WHEREAS, said Ordinance now requires weekly pickup of garbage and rubbish; and,
WHEREAS, since the adoption of said Ordinance and before January 1, 1976, the Board
of Sanitary Commissioners of the City of Richmond, Wayne County, Indiana, entered
into a contract with a Labor Union representing employees of the Sanitary District of
the City of Richmond, Indiana, which provided in part that:
(a) Employees of such Sanitary District could not be compelled to work
Saturdays;
(b) Any employees working overtime are to receive bonus pay;
(c) Employees were granted paid holidays on New Years, Good Friday,
Memorial Day, July 4, Labor Day, Veterans Day, Thanksgiving, and
Christmas, and 1/2 day each Election Day, and also 1/2 day for Union
Election Day; and,
WHEREAS, said Board of Sanitary Commissioners, after making such contract and before
January 1, 1976, proposed a budget for the year 1976, containing a sum for wages
which was not sufficient to pay bonus wages for collections on Holidays or Saturdays
of the week in which such holidays fall, and/or is legally observed; and,
WHEREAS, it is therefore impossible to collect rubbish and garbage once a week in the
weeks in which such holidays fall, or is legally observed; and,
NOW THEREFORE, be it ordained by the Common Council of the City of Richmond, Wayne
County, State of Indiana, that section 4.2 entitled "collection practices", of
Article 4 entitled "Standards and Practices", of Ordinance No. 2432-1969 be, and the
same hereby is, amended to read as follows, to -wit:
Section 4.2 Collection Practices.
A. Collection Frequency. The City of Richmond, Indiana, or its duly
authorized agency, shall collect all trash and rubbish which is deposited
in proper containers and properly placed for collection as prescribed by
this ordinance; such collection shall occur at least once each week,
except for the weeks in which any of the following days may occur: New
Years, Good Friday, Memorial, July 4, Labor, Veterans, Thanksgiving,
Christmas, each Election Day and Union Election Day. The scheduling of
routes and collection days shall be determined by the Superintendent of
the Sanitary District.
(1) Where applicable the container and all its parts shall be re-
placed by the collection agent in a position that complies with
the ordinance.
B. Limitation of Service. The types and locations of business and indus-
tries to be provided with collection services shall be at the discretion
of the Superintendent of the Sanitary District with the approval of the
Board.
C. Limitations of Materials Collected.
(1) The Board shall not be required to collect and dispose of construc-
tion and industrial refuse. Construction refuse shall be removed within ten
(10) days after completion of construction work.
(2) Bulky Items, such as discarded stoves, refrigerators, furniture,
etc., will be collected only by prior arrangement with the collecting
agency.
(3) No explosive material -or item shall be placed in any refuse
container.
D. Collection Equipment. Equipment used for the collection and trans-
portation of garbage or rubbish in the City of Richmond, Indiana, shall
have suitably constructed, sanitary type, all enclosed bodies with water
tight beds. Equipment other than the above shall be approved by the
Superintendent of the Sanitary District and the Health Officer.
