AN ORDINANCE AMENDING ZONING ORDINANCE NO 2007-287 CHANGING THE AREA
REQUIREMENTS FOR NEW DAYCARE FACILITIES IN R-1 E, R-1A, R-1 B, R1 C, R-2, R-4,
R-6, R-8, AND R-12, R-M, C-1 B, C-2B, C-10, AND C-20 ZONES
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose: The purpose of this amendment to Zoning Ordinance No 2007-287 is
to remove and replace the existing outdoor play area requirement for day care facilities
located in R-1 E Zones.
Section 2. Amendment: Section R-1 E.05(C) is hereby deleted and the following is inserted
in lieu thereof:

Section 3. Amendment: Section R-1A, R-1 B, R-1 C.05(C) is hereby deleted and the
following is inserted in lieu thereof:

C. All new day care facilities must comply with State administrative
requirements Set forth in I.A.C. 441-11(237A).
Section 4. Amendment: Section R-2.05(C) is hereby deleted and the following is inserted in
lieu thereof:

Section 5. Amendement: Section R-4, R-6, R-8, R-12.05(C) is hereby deleted and the
following is inserted in lieu thereof:

Section 6. Amendement: Section R-M.05(C) is hereby deleted and the following is inserted
in lieu thereof:

Section 7. Amendment: Section C-1 B.05(C) is hereby deleted and the following is inserted
in lieu thereof:

Section 8. Amendement: Section C-2B.05(C) is hereby deleted and the following is

Section 9. Amendment: Section C-10.05(C) is hereby deleted and the following is inserted
in lieu thereof:

Section 10. Amendment: Section C-20.05(C) is hereby deleted and the following is inserted
in lieu thereof:

Section 11. Penalty Provision. The city may elect at its sole discretion, to prosecute any violation
either as simple misdemeanor or a municipal infraction.
Section 12. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this
Ordinance are hereby repealed.
Section 13. Severability. If any section, provision, or part of this ordinance will be adjudged to be
invalid or unconstitutional, such adjudication will not affect the validity of the ordinance as a whole, or
any section, provision, or part thereof not adjudged invalid or unconstitutional.
Section 14. Effective Date. This ordinance will be in effect after its final passage, approval, and
posting as provided by law.
On the 11th day of March 2009, at the regular meeting of the Tiffin, Iowa City Council, Councilperson
Mike Gericke introduced Ordinance No. 2009-296, and moved that it be given its first reading. The
motion was seconded by Council Person John Wright.
Ayes: Chris Ball, Mike Gericke, Mark Petersen, John Wright
Nayes: None
Absent: Jim Bartels
Four Members of the Council being present and having voted "Aye", Mayor Royce Phillips declared
the motion carried, and Ordinance No. 2009-296, was read the first time, discussed and placed on
record.
On the 11th day of March 2009, at the regular City Council meeting of the Tiffin, Iowa City Council,
Council person John Wright made a motion to suspend the second reading for Ordinance No.
2009-296, and moved that the third and final reading be made. The motion was seconded by Council
person Chris Ball.
On the 11th day of March 2009, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Chris Ball introduced Ordinance No. 2009-296, and moved that it be given its third
and last reading. The motion was seconded by Councilperson John Wright.
Ayes: Chris Ball, Mike Gericke, Mark Petersen, John Wright
Nays: None
Absent: Jim Bartels
Four Members of the Council being present and voted "Aye". Mayor Royce Phillips declared the
motion carried, and the ordinance was passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2009-296 be adopted and signified his approval
of same by fixing his signature thereto. Passed by the City Council on the 11th day of March 2009.

day of March 2009, and signed by the Mayor on the 12th day of March 2009, and published on the 12th
day of March 2009, by posting copies thereof in three public places within the limits of the City of
Tiffin, Iowa. That I posted copies of Ordinance No. 2009-296 in the following places:
