AN ORDINANCE TO APPROPRIATE FIFTY SEVEN THOUSAND FIVE HUNDRED DOLLARS
($57,500.00) FROM THE FEDERAL REVENUE SHARING TRUST FUND FOR CERTAIN
ORDINARY AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE LAMS
OF THE STATE OF INDIANA AND BY`THE ORDINANCES OF THE CITY OF RICHMOND,
INDIANA.
WHEREAS, the State and Local Fiscal Assistance Act of 1972, Title I of
Public Law 95-512 was approved October 20, 1972.
WHEREAS, Section 51..40 of Part 51, Chapter I, Subtitle B, Title 31 of
the Code of Federal Regulations provides as follows:
A recipient Government which receives entitlement funds under the
Act shall:
tc) Provide for the expenditure of entitlement funds in
accordance with the laws and procedures applicable
to the expenditure of its own revenues;
WHEREAS, persuant to the said State and Local Fiscal Assistance Act,
the proper legal officers of the City of Richmond, Indiana, have
established a trust fund known as the Federal Revenue Sharing Trust Fund,
WHEREAS, revenues are available in said trust fund to be used for certain
ordinary and necessary capital expenditures as authorized by law, and,
WHEREAS, certain extraordinary emergencies have developed since the
adoption of the existing annual budget so that it is now necessary
to appropriate more money for the various functions of the City
Government than was appropriated in the annual budget;
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
RICHMOND, INDIANA:
SECTION 1. That for the expenses of the City Government and its insti-
tutions for the year ending December 31, 1976, the following amount of
money is hereby appropriated and set apart out of the. Federal Revenue
Sharing Trust Fund for certain ordinary and necessary capital expenditures,
said sum being subject to all laws governing the same and such amount
appropriated shall be held to include all expenditures to be made during
the year unless expressly stipulated by law.
SECTION 2. That for the said fiscal period, there is hereby appropriated
from the Federal Revenue Sharing Trust Fund for the hereafter enumerated
purposes the following specified amount to meet the extraordinary
emergencies hereby declared to exist:
MOTOR VEHICLE HIGHWAY FUND - EQUIPMENT
S-35 MOTOR EQUIPMENT $48,000.00
5-37 OTHER EQUIPMENT 9,500.00
TOTAL $57,500.00
SECTION 3, An extraordinary emergency exists for the above appropriation
and it has been recommended by the City. Controller.
SECTION 4., This Ordinance shall be in full force and effect from and
after its passage and approval by the Mayor and is subject to the laws
of the State of Indiana. governing emergency appropriations..

COUNCIL OF THE CITY OF RICHMOND, INDIANA
The Common Council of the City of Richmond, Indiana, met in regular session
in the Council Chambers in the Municipal Building of said City August 16,
19Z6 at the hour of 7:30 P.M.
Councilman Mills presided with the following members present: Messrs.

The Clerk presented proof of publication of Notice to Taxpayers printed in the
Richmond Palladium Item, a newspaper of general circulation in the City of
Richmond, Indiana, on the dates of A,juimt rand
Said notices stated that a public hear ng would�be� held on a �.,_ ay o
by the Common Council to consider additional appropria-
ons as promed for in Ordinance No. , within the City of
Richmond, Indiana. The proof of atiori-and asting of notices were
examined and found to be correct and in order. Councilman
moved the proof of publication and posting of notices be rece ve and or'�ered
filed, seconded by Councilman Elstro _ , and on voice vote the motion
was carried.
The Clerk read on second reading Ordinance No. 3121-1976
Councilman Austerman moved .for engrossment of Ordinance No. 3121-1976,
seconded by Councilman Paust and on unanimous voice vote the motion was carried.
Councilman Cornett moved to suspend the rules and place Ordinance No. 3121-1976
on third reading by title only, seconded by Councilman Paust and on unanimous
voice vote the motion was carried.
After hearing all persons present, Ordinance No. 3121-1976 was placed on
final passage or rejection and on a call of the ro"ilhe- oMwing was recorded:
