AMENDING THE LEESBURG ZONING MAP FOR REZONING APPLICATION
#ZM-100 BY ROGER L. AND WANDA W. HOUGH
WHEREAS, on February 10, 1988, the Council received Rezoning Application
#ZM-100 by Roger L. and Wanda W. Hough to rezone a 19,909 square foot parcel
of land on Fort Evans Road from R-2 to B-1 and referred the application
to the Planning Con~nission for public hearing and recommendation; and
WHEREAS, the Planning Commission on April 7, 1988, held a public
hearing on this application and recommended conditional approval to Council;
and;
WHEREAS, the Council, on May 25, 1988, held a public hearing on this
application, prior to which a signed, notarized proffer statement was sub-
mitted by the property owner:
THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia
as follows:
SECTION I. The Leesburg Zoning Ordinance is amended to revise the
Zoning District Map to change from R-2 to B-1 a 19,909 square-foot parcel of
land located at 154 Fort Evans Road, N.E. and surrounded by the Fox Creek
Townhouse community, in accordance with a plat prepared by Kamber,
Engineering, Inc., dated January, 1988, subject to the following conditions
proffered in writing on May 29, 1988, by the property owner pursuant to
Section 15.1-491(a) of the 1950 Code of Virginia as amended:
1. The applicant proffers and agrees that the permitted uses allowed
on the site will be limited to the following:

Office uses:
1. Medical offices including pharmacy
2. Professional offices
3. Government offices
4. General Offices
Banks
Day Care Center
Residential Use
1. As permitted by Special Exception
The applicant agrees and proffers that at such time as the Town
Council adopts an amendment to the Zoning Ordinance creating an
office zoning district, the subject property shall be included
therein.
The applicant agrees and proffers that at such time as Fort Evans
Road is closed, and a cul-de-sac created, the applicant will
interpose no objection thereto.
The applicant agrees and proffers that they will make a cash
contribution for road improvements. This cash contribution shall
be in the amount of $2,000 for each 1,000 square feet of new
construction; it shall be due and payable at the time a zoning
permit is issued for the new construction.
SECTION II. This ordinance shall be in effect upon its passage.
