HomeMy Public PortalAboutResolution 63-304follows: RESOLUTION N0, 63 -304 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANTING REQUESTED APPLICATION IN ZONE VARIANCE CASE NO. 63 -51 OF FRANK HARBERT FOR ZONE VARIANCE AT 9518 E. LAS TUNAS DRIVE The City Council of the City of Temple City does resolve as SECTION i. On May 10, 1963, Frank Harbert hereinafter referr ed to as "Applicant" filed application for a zone variance in Zone Variā€¢ ance Case No. 63 -51 to construct an addition to an existing store build ring covering more than 50% of the lot area, resulting in less than the required parking. SECTION 2. On June 3, 1963, the Planning Commission held a public hearing pursuant to law, after which the Planning Commission denied the aforesaid variance request. SECTION 3. Within the time prescribed by law the applicant appealed the decision of the Planning Commission to the City Council and on August 12, 1963, the City Council held its hearing upon the said appeal. SECTION . The City Council finds as follows: (a) The applicant proposes to construct an addition to an existing store building, which would then occupy more than 50 per cent of the lot area; and to provide less than the required parking, in the C -2 zone, (b) The existing and proposed developments are shown on the plot plan submitted with the application, which is a part of the perman ent file in Zone Case No. 63 -51, marked Exhibit "A ". Proposed is a 300 square foot addition to an existing one -story building, which would the contain a total of approximately 1,350 square feet of floor space, on a parcel of land having approximately 1,650 square feet of area. The plot plan also indicates a 15 foot by 20 foot paved parking area to the rear of the proposed addition. Compliance with the Zoning Ordinance would require four parking spaces for the proposed development. (c) The subject property is a rectangular- shaped parcel fronting 15 feet on Las Tunas Drive and having a depth of 110 feet. A paved alley 20 feet wide borders the southerly boundary. The property is currently developed with a single -story building, as shown on said Exhibit "A ", (d) Both frontages along Las Tunas Drive are developed to various commercial uses. Immediately to the south are parking lots. The remaining area, on the north and south perimeters, is developed to mixed residential uses, (e) The subject property has been zoned C -2 since July 8, 1947, when it was part of the unincorporated area of the County of Los Angeles. (f) East Las Tunas Drive is a fully dedicated major highway at this location. (g) The area sought to be built upon will not depreciate any parking due to its size and location. (h) The surrounding property will in no way be adversely effected, nor will any contemplated master plan development by allowance of the requested variance. SECTION 5. Based upon the findings referenced in SECTION 4, the Application for Variance as requested is hereby granted, subject to the following condition that the property shall be developed in accordance with the plot plan on file in the above - referenced Zone Case.
