HomeMy Public PortalAbout3140-1976- AUTHORIZING SPECIAL USE IN ONE TO EIGHT FAMILY RESIDENCE DISTRICTORDINANCE NO. 3140-1976 AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN FN R-3 ONE -TO -EIGHT FAMILY RESIDENCE DISTRICT, OF ORDINANCE N0, 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. As provided in Article 22, Section 22.01 and more speci- fically provided in Article 48 of Ordinance No. 2325-1968, commonly known as the Zoning Ordinance of the City of Richmond, Indiana, the following described use of the following described real estate is allowed as a Special Use for a dental office located at 213E :W. 2nd Street, in the city of Richmond, Indiana; more particularly de- scribed; to wit: Part of N.W. Division official map 199 N.W. Sec. 5 Twp. 13 R 1 .08 A strip 36.7' x 137.93' SECTION 2. As a condition of the aforesaid Special Use and as an addi- tional restriction on said use, the following requirements shall hereafter and at all times be met by the owner, leasee or any person, firm or corporation using such real estate. SECTION 3. The Zoning Administrator of the City of Richmond, Indiana, is hereby authorized and directed, upon enactment and publication of this Ordinance, to record and approve the issuance of a permit for the estab- lishment of the use herein allowed. SECTION 4. This Ordinance shall be in full force and affect from and after its passage and approval by the Mayor, and publication is by law required. The opposition was on S.W. 1st Street rather than on S,W. 2nd Street. The Plan Contnission voted six (6) ayes and one (l) naye in favor of this Special. Use with the following conditions, Mr, Kyle voted naye. Ccn nissioners absent were Messrs. Austerman and Conley. 1. A solid.fence along the south property line from the front of the proposed office to the rear lot line. 2. Non -deciduous trees and bushes to be located along the south property line frcm the :Front of the proposed, office to the front lot lino. CEZis will provide a. year round green buffer .for resicicti,a3,i structures to the south. 3. The Board of Zoning Appeals voted four (4) ayes and.zero (0) nayes in favor of these variances.
