HomeMy Public PortalAbout3141-1976- AUTHORIZING SPECIAL USE IN ONE TO EIGHT RESIDENCE DISTRICTORDINANCE NO. 3141-1976 AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN AN R-3 ONE -TO -EIGHT FAMILY RESIDENCE DISTRICT OF ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, APPROVED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. As provided in Article 21, Section .01 and in Article 20, Section .021 of Ordinance No. 2325-1968 commonly known as the Zoning Ordinance of the City of Richmond, Indiana, the following described real estate is allowed as a special use to wit: Planned Unit Develop- ment for elderly located at 2030 Chester Boulevard in the City of Richmond, Indiana, more particularly described as follows: Being part of the South one-half of the Southeast Quarter of Section 20, Township 14 North, Range 1 West, in Wayne Township, Wayne County, Indiana, more particularly de- scribed as follows: Beginning at an iron pipe on the north line of the South one-half of the Southeast Ouarter of Section 20, said pipe being 1628.05 feet north 89 degrees and 10 minutes west of the northeast corner of the South one- half of said Southeast Quarter, and running thence from said beginning point, south 45 degrees and 50 minutes west, 23.27 feet to an iron pipe; thence south 0 degrees and 50 minutes west 1312.38 feet to an iron pipe on the south line of the Southeast Quarter of Section 20; thence north 89 degrees and 18 minutes west, along said south line, 520.22 feet to an iron pipe; thence north 0 degrees and 50 minutes east, 1330.04 feet to an iron pipe on the north line of the South one-half of said Southeast Quarter; thence south 89 degrees and 10 minutes east, along said north line, 536.67 feet to the place of beginning, containing an area of 15.880 acres. ALSO: A part of the south half of the Southeast Quarter of Section 20, Township 14, Range 1 West, bounded as follows, to -wit; Beginning at a point in the east line of said quarter sec- tion 29 rods south of the northeast corner of said south half of said section; thence west parallel with the south line of said quarter section 100 rods; thence south parallel with the east line of said quarter section 51 rods, more or less, to the south line of said quarter section; thence east along the south line 100 rods to the southeast corner of said quarter section; thence north 51 rods, more or less to the place of beginning, excepting the following 6 acres, to -wit: Beginning at the southeast corner of said quarter; thence west 30 rods; thence North 32 rods; thence east 30 rods; thence south 32 rods to the place of beginning, leaving 25-7/8 acres, more or less, excepting also a part of the southeast quarter of Section 20, Township 14, Range 1 West, bounded as follows, to wit: Beginning at the southwest corner of a tract of land belonging to Claude E. Berry 30 rods west from the south- east corner of said quarter section; thence west 6 rods to the west side of an open ditch; thence northeastwardly along the west side of said open ditch to a point 375 feet north of the place of beginning; thence south to the place of beginning, .containing one-half acre. (over) SECTION 2. As a condition of the aforesaid Saecial Use and as an addi- tional restriction on said use, the following requirements shall here- after and at all times be met by the owner, leasee or.any person, firm or Corporation using said real estate. 1. 2. 3. 4. SECTION 3. WHEREAS, a study of this Ordinance was co ducted by the Rich- mond City Plan Commission the z S-44 day of 1976, at which time remonstrances were heard from all parti s i terested in or affected by this Ordinance. SECTION 4. WHEREAS, the vote of the Richmond City Plan Commission was to (I in favor of/' - recommending the pass- age of Ordinance No. 3141-1976. SECTION 5. The Planning Director of the City of Richmond, Indiana, is hereby authorized and directed upon .passage of this Ordinance, to record and approve the issuance of an Improvement Location Permit for the estab- lishment of the use herein allowed. SECTION 6. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. September 30, 1976 Mr. Kenneth Mills, President Members of the Common Council & Mrs. Jo Ellen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 3141-1976 PC Case No. 76-15 Dear Mr. Mills, Members of the Council is Mrs. Trimble: The Richmond City Plan Commission held a public hearing on September 28, 1976, at 7:30 P.M. in the Council Chambers of the Richmond Muni- cipal Building, to hear the request of Friends Fellowship Community Inc., requesting a Special Use for a Residential Development Unit Project on 15.88 acres of property at 2030 Chester Boulevard.. The proposed use of this property is for twelve (12) two (2) family residential dwellings as an extension of the existing Friends Fellow- ship Community facilities.. All parties interested in or affected by this petition were given an opportunity to speak at this hearing. All adjoining property owners were contacted by mail and invited to comment on the proposed peti- tion. No objections were heard from any source. This petition grants a Special Ilse for site development only and Final approval of the building set -backs, distance between structures, parking requirements, open space ratio, and other standard require- ments of the zoning Ordinance, Article 45, must be met prior to con- struction.
