HomeMy Public PortalAbout3143-1976- AMENDING ORDINANCE 2325-1968 KNOWN AS ZONING ORDINANCEORDINANCE NO. 3143-1976 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. BE IT ORDAINED by the Common. Council of the City of Richmond, Indiana, as follows: SECTION 1. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968, designates and describes as R-3 Multi -Family Residential District, the following properties on South 9th Street between "G" Street and "H" Street: 1. 701 South 9th Street 2. 703 South 9th Street 3. 705 South 9th Street 4. 711 South 9th Street 5. 713 South 9th Street 6. 725 South 9th Street 7. 727 South 9th Street 8. 733 South 9th Street Also described as that parcel of real estate lying east of the center line of South 9th Street and west of the center line of the north south public alley between South 9th and loth Streets and lying south of the centerline of South "G" Street and north of the centerline of South "H" Street, and, SECTION 2. _ WHEREAS, it is the intent and purpose hereof to change the zoning classification of the above described area from R-3 Multi Family Residential to C-2 Community Business District, and, SECTION 3. WHEREAS, a study of this Ordinance was conduc, edy the Richmond City Plan Commission the —2( '67 day of ((J , 1976, at which time remonstrances were heard from all parties interested in or affected by this Ordinance. SECTION 4. WHEREAS, the vote of the Richmond City Plan Commission was to p in favor of/in opposition to recommending the passa a of Ordinance No. 3143-1976. NOW THEREFORE: SECTION 5. It is hereby ordained that the zoning classification of the above described property be, and the same is hereby changed to C-2 Community Business District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amendments thereto. SECTION 6. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. SECTION 7. The original zoning classification of the aforementioned area is hereby rescinded and the zoning classsification of this area will be in accordance with Section 2 of this Ordinance. GEORGE WEBB CITY ENGINEER Dear President Mills, Members of the Common Council & Mrs. Trimble: The Richmond Planning Commission held a public hearing on Tuesday, October 26, 1976, to hear the request of the owners of more than 500 of the properties, located on the east; side. of South 9th Street, between South " G" and ' W', Stx.eets,,.and east to the public alley, to rezone from R�3 one to e�ght family Residential District to C-2 Community Business Distr -ct, All parties interested or affected by this petition were given an opportunity to speak. No one was present to speak in opposition to the petition. Five (5) persons were present to speak in favor of this petition. The Plan Commission made the following finding in reaching their conclusion. 1.) This rezoning is a natural continuation of the C-2 zoning classification immediately south of the petitioners property. 2.) Zoning maps for 1956 and 1962.as well as the Master Plan accepted in 1968 show this area to be in a business classification district. Therefore, the zoning map prepared in 1968,4 in error showing this property as residential.
