AN ORDINANCE: PRESENTED December 13~ ~8-0-41 ADOPTED December 13: AMENDING THE LEESBURG ZONING ORDINANCE REGAPa)ING SWIMMING POOLS AND RELATED STRUCTURES WHEREAS, the Council on October 25, 1988, initiated smendments to the Leesburg Zoning Ordinance to allow pools and related structures within required minimum side and rear yards; and WHEREAS, a joint public hearing of the Plsnnlng Commission and Council was held on these amendments on November 22, 1988; and WHEREA~, the Planning Commission recommended to Council approval of these amendments on December 1, 1988; and WHEREAS, this amendment is in the interest of the public necessity, convenience, general welfare and good zoning practice. TIIE~FO~, ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The Leesburg Zoning Ordinance is amended to replace the current text of Section 1B-5(c)9 in its entirety and replace this text with the following:.. Section 1B-5(c)9 Swimming Pools A private swimming poo~ not exceeding three feet above grade, is perm/tted in a required m{rlilnuln side or rear .yard to within six feet of a property line, as measured perpendi~tl~ from said property line to the outermost edge of the pool coping..Any associated walkway or deck, not exceeding three feet above grade, is permitted in.a required minimum side or rear yard to within three feet of a property line. A private swimmirlg po0~ or associated walkway or deck, exceeding three feet above-grade, shall not be permitted in a required minimum .yard. Swimmillff pOOls 8ha~ not be permitted in front .yards. Private pools not exceeding three feet above grade mu~.~ be enclosed by an opaque fence with a mirtimllm height of four feet. SECTION II. All prior ordinances in conflict herewith are repealecL 1988 1988 ZONING ORDINANCE AMENDMENT REGARDING SWIMMING POOLS 2 SECTION rr~. Seveeal~ty. If any provision of this ord/nanee is dec3-red/nvalid by a court of competent jurisdiction, the decision shall not affect the validity of the Article as a whole or of ally l'en~inln~ provisions of the Article.
