HomeMy Public PortalAbout3152-1976- AMENDING CHAP 41ORDINANCE NO. 31 52-1976 AN ORDINANCE AMENDING CHAPTER 41, ARTICLE XI, SECTION 41.71 (s), RIDING ON SIDE- WALKS. WHEREAS, the Board of Public Works and Safety, upon report of a Bicycle Route Committee, and acting in cooperation with the Traffic Division of the Richmond Police Department and the Planning Department of the City of Richmond, and other Departments and Agencies of the Civil City of Richmond, Indiana, has selected a bicycle route for bicycle traffic proceeding east and west in and through the City of Richmond, and; WHEREAS, the use of bicycles in the City of Richmond has increased substantially in recent years, and it is in the best interest of the citizenry of Richmond to promote the efficient and safe use of bicycles as a means of transportation, re- laxation, and exercise, and; WHEREAS, the bicycle route selected by the Board of Public Works and Safety in conjunction with the various agencies and committees with which it has operated, includes routing of bicycles ;upon certain sidewalks in the City of Richmond, and that the present ordinance prohibits the use of bicycles upon sidewalks under certain conditions: NOW THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond, Indiana: SECTION 1. That Chapter 41, Article XI, Section 41.71, subparagraph (s) Riding on Sidewalks be, and the same is, hereby amended to read as follows: (s) Riding on Sidewalks'. 1. No person shall ride a bicycle upon a sidewalk within the central business district, except in those portions of sidewalk designated by -the Board as "bicycleroutes'' which portions shall be appropriately signed and marked as portions of such bicy clle FIUe aut sBo. . rd is authorized to erect signs on any sidewalk or roadway prohibiting the riding of bicycles thereon by any person and when such signs are in place no person shall disobey the same. 3. No person 15 or more years of age shall ride a bicycle upon any sidewalk in any district, except when operating the bicycle in the course of his business, trade or employment, or except in those portions of sidewalks designated by the Board as 'Bicycle Routes", which portions shall be appropriately signed and marked as portions of such bicycle routes. 4. Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right of way to any pedestrian and shall give audible signal before overtaking and passing a pedestrian. SECTION 2. This Ordinance shall be in full force and effect after its passage and approval by the Mayor and Publication as by law required.
