HomeMy Public PortalAbout3153-1976- AMENDING ORDINANCE 2325-1968 KNOWN AS THE ZONING ORDINANCEORDINANCE NO. 3153-1976 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNO14N AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. WHEREAS, the Zoning Map which is part of Ordinance No. 2325- 1968, designates and describes as R-3 ONE -TO -EIGHT FAMILY RESIDENCE DISTRICT, the following described property located at 1117, 1119 and 1131 North J Street, in the City of Richmond, Indiana, more particularly described as follows: Being a part of Lot #21 and a part of Lot #22 in the Estate of Sarah Moffitt, an Addition to the City of Richmond, Indiana, and more particularly described below: Commencing at the northwest corner of Lot #20 in said Addition; thence north 89 degrees 43 minutes 10 seconds east 60,00 feet along the south line of North "J" Street to the place of beginn- ing of this description: Thence north 89 degrees 43 minutes 10 seconds east 60.00 feet along the south line of said street; thence south 174.49 feet to the north line west 60.00 feet along the north line of said alley; thence north 174.49 feet to the place of beginning, containing an area of 10,469,274 square feet (0.240 acres) of land, more or less. SECTION 2. WHEREAS, it is the intent and purpose hereof to change the zoning classification on the above described area from R-3 One -to -Eight Family Resi- dence District to-C-1 Neighborhood Business District, and, SECTION 3. WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the _-� sv — k day of1976, at which time remonstrances were heard from all parties interested in or affected by this Ordinance. SECTION 4. WHEREAS, the vote of the Richmond City Plan Commission was 7' to d in favor of/in opposition to recommending the pass- age of Ordinance No. 3153-1976. NOW THEREFORE: SECTION 5. It is hereby ordained that the zoning classification of the above described property be, and the same is hereby changed to C-1 Neighborhood Business District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amendments thereto. SECTION 6. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. SECTION 7. The original zoning classification of the aforementioned area is hereby rescinded and the zoning classification of this area will be in accord- ance with Section 2 of this Ordinance. ATTEST: 0" 0'e"— '(' City CTerk CITY -Z . t 'y RICHMOND, INDIANA" December 2, 1976 Mr. Kenneth Mills, President Members of Common Council & Mrs. Jo Ellen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 3153-1976 - Plan Commission Case 76,19, Redevelopment Commission, requesting, zoning from R,3 to C-1 on property located at 1117, 1119 and 1131 North J Street Dear Mr. Mills, Members of the Council & Mrs. Trimble: The Richmond City Plan Commission held a public hearing on Tuesday, November 23, 1976, at 7:30 P.M. in the Council Chambers of the Rich- mond Municipal Building to hear the request of the Redevelopment Commission requesting zoning from R-3 to C-1 on property located at 1117, 1119 and 1131 North J Street. The petition was represented by Richard Freeman of the Redevelop- ment Commission. No remonstrators were present to speak in opposi- tion. Thirty-seven (37) letters were sent to adjoining and adjacent property owners and three (3) were returned, all in favor of the rezoning. The Plan Commission voted unaninously, eight (8) to zero (0) to recommend approval of the petition to Common Council.
