AN ORDINANCE TO APPROPRIATE TWENTY THREE THOUSAND SEVEN HUNDRED FORTY SEVEN
DOLLARS AND EIGHT'CENTS ($23,747.08) FROM THE FEDERAL REVENUE SHARING
TRUST FUND, FOR CERTAIN ORDINARY AND NECESSARY MAINTENANCE AND OPERATING
EXPENDITURES AND FOR CERTAIN ORDINARY AND NECESSARY CAPITAL EXPENDITURES
AS AUTHORIZED BY THE LAWS OF THE STATE OF INDIANA AND BY THE ORDINANCES
OF THE CITY OF RICHMOND, INDIANA.
WHEREAS, The State and Local Fiscal Assistance Act of 1972, Title I of
Public Law 95-512 was approved October 20, 1972.
WHEREAS, Section 51.40 of Part 51, Chapter I, Subtitle B, Title 31 of
the Code of Federal Regulations provides as follows:
A recipient Government which receives entitlement funds under the
Act shall:
(c) Provide for the expenditure of entitlement funds in
accordance with the laws and procedures applicable
to the expenditure of its own revenues;
WHEREAS, persuant to the said State and Local Fiscal Assistance Act,
the proper legal officers of the City of Richmond, Indiana, have
established a trust fund known as the Federal Revenue Sharing Trust Fund,
WHEREAS, revenues are available in said trust fund to be used for certain
ordinary and necessary maintenance and operating expenditures and for
certain ordinary and necessary capital expenditures,
WHEREAS, there is a need for funds for certain ordinary and necessary
maintenance and operating expenditures and for certain ordinary and
necessary capital expenditures as authorized by law, and
WHEREAS, certain extraordinary emergencies have developed since the
adoption of the existing annual budget so that it is now necessary
to appropriate more money for the various functions of the City
Government than was appropriated in the annual budget;
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
RICHMOND, INDIANA:
SECTION 1. That for the expenses of the City Government and its insti-
tutions for the year ending December 31, 1976, the following amount of
money is hereby appropriated and set apart out of the Federal Revenue
Sharing Trust Fund for certain ordinary and necessary maintenance and
operating and certain ordinary and necessary capital expenditures, said
sum being subject to all laws governing the same and such amount appropriated
shall be held to include all expenditures to be made during the year unless
expressly stipulated by law.
SECTION 2. That for the said fiscal period, there is hereby appropriated
from the Federal Revenue Sharing Trust Fund for the hereafter enumerated
purposes the following specified amount to meet the extraordinary
emergencies hereby declared to exist:

These funds are to be appropriated for the following project:
Community Alcohol Rehabilitation and
Education Services, In.c. (C.A.R.E.S., Inc.)

SECTION 3. An extraordinary emergency exists for the above appropriation
and it has been recommended by the City Controller.
SECTION 4. This Ordinance shall be in full force and effect from and
after its passage and approval by the Mayor and is subject to the laws
of the State of Indiana governing emergency appropriations.

The Common Council of the City of Richmond, Indiana, met in regular session
In the Council Chambers in the Municipal Building of said City January

The Clerk presented proof of publication of Notice to Taxpayers.printed in the
Richmond Palladium Item, a newspaper of general circulation in the City of
Richmond, Indiana, on the dates of December 21 and December 28
Said notices stated that a public hearing wou ld on the day of
January, 1977 by the Common Council to consider additioRT a�ppropris-
ons as provided or in Ordinance No. 3169-1976 , within the City of
Richmond, Indiana. The proof of publics on and posting of notices were
examined and found to be correct and in order. Councilman 1
moved the proof of publication and posting of notices be rece vie an o ered
filed, seconded by Councilman Ahaus , and on voice vote the motion
was carried.
The Clerk read on second reading Ordinance No. 3169-1976 .
Councilman Mills moved for.e.ngrossment of Ordinance No. 3169-1976,
seconded by Councilman Ahaus and on unanimous voice vote. the motion was carried.
Councilman Williams moved to suspend the rules and place Ordinance No. 3169-1976
on third reading by title only, seconded by Councilman Mills.
After hearing all persons present, Ordinance No. 3169-1976 was placed on
final passage or rejection and on a call of the roll e- following was recorded:

PROPOSED ADDITIONAL APPROPRIATIONS
Notice is hereby given the taxpayers of the City of Richmond, Mayne County,'
Indiana, that the proper legal officers of said Municipal Corporation at
their regular meeting place at:30 o'clock P.M., on day of
Januaru , 19 77 , will consider the following additional
app'roprj.ations in excess of the -budget for the current year.
FEDERAL REVENUE SHARING TRUST FUND

Taxpayers appearing at such meeting shall have a right to be heard thereon.
The additional appropriations as finally made will be referred to the State
Board of Tax Commissioners, which [board, upon receipt, will hold a further
hearing within fifteen days at the County Auditor's Office of said County,
or at such other place as may be designated. At such hearing taxpayers
objecting to any of such additional appropriations may be -heard. Interested
taxpayers may inquire of the County Auditor when and where such hearing
will be held.
