AN ORDINANCE AMENDING ORDINANCE NO. 2508-1970, AN ORDINANCE AUTHOR-
IZING A "SPECIAL USE" IN A R-3 ONE -TO -EIGHT FXIILY RESIDENTIAL DIS-
TRICT OF ORDINANCE 140. 2325-1968 CONEMNLY MIO64N AS THE ZONING ORDIN-
ANCE OF THE CITY OF RIC1MND, INDIANA.
jWJUS, the Common Council of the City of Richmond, Indiana, has enacted Ordin-
ance No. 2508-1970, an ordinance authorizing a "special use" in a R-3
One -to -Eight Family Residential District of Ordinance No. 2325-1968,
commonly known as the Zoning Ordinance of the City of Richmond, Indiana;
and
1*MREAS, said Ordinance provided for the construction of a professional (medical)
building to be located at 2507-09 East Plain Street, Richmond, Indiana,
and more particularly described as follows:
A part of the Southwest Quarter of Section Thirty-four (34)
Township Fourteen (14), Range One (1) West in Wayne County,
Indiana, and being more particularly described as follows:
Beginning at an established iron pin at the foot of a cedar
tree which iron pin is sixty-four and eighty-five hundredths
(64.85) rods east, and seventeen and twenty-five hundredths
(17.25) rods north of the southwest corner of said quarter
section; thence north four and one-half (4 1/2) degrees east,
three hundred fifty-four (354) feet to the center line of
National Road; thence south eighty-five (85) degrees west
along said centerline, one hundred seventy-eight (178) feet;
thence south five and one-half (5 1/2) degrees west, forty
(40) feet to an iron pin in the south line of the National
Road, thence continuing south five and one-half (5 1/2) de-
grees west, Two hundred ninety and six -tenths (290.6) feet
to an iron pipe; thence south eighty-eight and one-half
(88 1/2) degrees east, one hundred eight -one (181) feet more
or less to the place of beginning and containing an area of
one and four -tenths (1.4) acres more or less; except twelve
(12) feet off the entire east side thereof.
The above description, excluding the exception of twelve (12)
feet, is taken from deed record 190, page 576, in which deed
Charles Edward Ruch is Grantee. Assuming that the same des-
cription is used in the unrecorded deed to Raper, the proposed
sale to Fox will be the same description, plus the exception of
twelve (12) feet, which Raper retains in order to own the drive-
way serving the "Ruch" residence at 2523 East Main Street.
Imo, Section 2 of said ordinance provided conditions of the aforementioned
special use and as an additional restriction of said use, which
additional. conditions are as follows:
1. The sanitary sewers for the proposed project shall be
approved by the Sanitation Board of Richmond, Indiana.
2. The Board of Public Works and Safety shall approve the
storm sewers to be installed to adequately handle the
water run-off created by the parking area.
3. The sign area is limited to ten (10) square feet.
4. The sign shall not be located closer to the street than
two-thirds (2/3) the distance in feet between the build-
ing and the property line.
IT EREAS, it is the intent of this Ordinance to Mend Ordinance No. 2508-1970 to
delete the above -mentioned conditions Numbered 3 and 4.
N0141 THEREFORE BE IT ORDAINED BY THE CONMN COUNCIL of the City of Richmond, Ind-
iana, that Ordinance No. 2508-1970 is hereby amended to delete the con-
ditions Numbered 3 and 4 from Section 2 of said Ordinance.

This Ordinance shall be in full force and effect from andd after its passage,
approval by the Mayor and publications as by law required.
