ROLL CALL: Commissioners Renzi, Ruane, Seggebruch, Womack and Chairman Kiefer were present. Commissioners Heinen and Minnis were absent. Plainfield Fire Protection District was present. Plainfield Township Park District, Plainfield Public Library District and Plainfield Community Consolidated School District 202 were absent. OTHERS PRESENT: Yuchen Ding, Associate Planner; Jessica Gal, Associate Planner; and Jonathan Proulx, Director of Planning APPROVAL OF MINUTES The minutes of the Zoning Board of Appeals dated May 21, 2019 were approved as amended. PUBLIC COMMENTS Chairman Kiefer asked for public comment and there was no response. DEVELOPMENT REPORT Mr. Proulx provided an update on the Special Use for the Sanctuary. OLD BUSINESS NEW BUSINESS Case No. 1849-080619.VAR 14415 S. Maple Ct. Tanner Panozzo Mr. Ding stated that the fence being proposed is six-foot (6’) traditional wood fence, not four-foot (4’) as stated in the staff report. Mr. Ding stated the applicant is seeking a variance to allow a fence in the corner side yard of their property at 14415 South Maple Court. The fence will be a six-foot (6’) traditional wood fence. The applicant is requesting an encroachment into the corner side yard of approximately 31.5 feet. Mr. Ding reviewed the finding of facts in the staff report dated September 3, 2019. Mr. Ding stated prior to public hearing and discussion by the Zoning Board of Appeals, staff recommends approval. Chairman Kiefer asked if staff has any concerns about reduced site lines for the traffic on Ash St. and Maple Ct. Mr. Proulx stated that staff does not have concerns about the site lines being reduced. Chairman Kiefer swore in Tanner Panozzo, applicant. Mr. Panozzo stated he is requesting the fence variance for privacy and since the mosque fence does not block their entire parking lot. Chairman Kiefer asked for public comment and there was no response. Commissioner Seggebruch asked staff if the house is on the setback line at 35 feet. Mr. Proulx explained the minimum setback is 30 feet per code but by definition it is the shortest distance from the home to the lot line. Commissioner Seggebruch asked if the existing driveway extension in the front of the house is allowed. Mr. Proulx stated parking can encroach in a corner side yard. Commission Seggebruch asked 3 Zoning Board of Appeals Minutes September 3, 2019 Page 2 of 3 what the normal setbacks for a shed since the shed in the rear of the house is encroaching in the easement. Mr. Proulx stated typically sheds should not be placed within five feet (5’) of the property line or in a drainage or detention easement. Mr. Proulx stated that staff can investigate if the shed was permitted. Commissioner Seggebruch asked the applicant if he installed the sheds. Mr. Panozzo stated the sheds were on the property when he purchased the home. Commissioner Seggebruch asked if the mosque installed the fence. Mr. Proulx confirmed. Commissioner Seggebruch asked the applicant if he is aware that fences installed in the utility easement can be taken down if work needs to be completed in the easement. Mr. Panozzo confirmed. Commissioner Seggebruch indicated that he feels the applicant will have a hard time maintaining the easement in the rear yard beyond the fence because of the current placement of the mosque fence. Commissioner Seggebruch suggested an alternative placement for the fence. Commissioner Seggebruch asked what the setback will be on the side yard. Commissioner Ruane stated his interpretation is it will be five feet (5’) off the property line. Commissioner Seggebruch stated he would like to see the applicant move he rear shed and install the fence outside of the easement. Mr. Panozzo stated the shed has electric to it, so that is the more permanent shed. Commissioner Seggebruch suggested to abut the fence to the shed, so the lawn can be easily maintained. Commissioner Ruane agreed with Commissioner Seggebruch’ s comments. Commissioner Ruane asked if the existing fence for the mosque can be extended or was it installed as part of their approval. Mr. Proulx stated the existing placement complies with fence restrictions. Commissioner Ruane stated he does not feel there is a good argument to encroach in the side yard. Commissioner Ruane suggested the applicant coming off the side of the house and connect with the existing fence in the rear of the property. Commissioner Womack asked if placing the fence 31.5 feet from the house was because of where the last parking space is located for the mosque. Mr. Panozzo confirmed that the measurement is in line with the three (3) parking space closed to Ash St. Commissioner Womack asked where are doors on the shed that is located in the corner of the rear yard corner. Mr. Panozzo stated the doors face Ash St. Commissioner Womack agreed with his fellow commissioners regarding the placement of the rear fence. Commissioner Womack indicated he does not have a problem with the side yard fence placement but asked the applicant to work with staff on the rear yard fence placement. Commissioner Womack pointed out for clarification that the applicant is only seeking a variance for the side yard setback. Mr. Proulx clarified when a fence is restricted in an easement. Mr. Proulx clarified that staff is not purposing any relief for the rear placement of the fence. Commissioner Ruane stated that part of the rear is in the side yard setback. Mr. Proulx confirmed that rear lot line does not start until the side yard ends. Commissioner Ruane asked the applicant if he has considered planting bushes instead of putting up a fence. Mr. Panozzo stated no, he would like the fence for privacy. Commissioner Ruane asked the applicant if he was aware that fences are not typically allowed in the corner lot side yard. Mr. Panozzo stated he was aware and was advised that this could be taken to the Village Board. Commissioner Renzi asked staff to clarify in the staff report point (a) “…consistent with the purpose and intent of the Zoning Ordinance…”. Mr. Proulx explained the location of the adjacent properties homes is something they consider but that is not an issue with this property. Commissioner Renzi stated the report was written for a four-foot fence and asked if the proposed fence is still low enough to prevent themselves from hindering drivers’ view. Mr. Proulx stated yes and explained why. Commissioner Renzi stated code does not allow the requested fence location, he feels there is not a unique circumstance, and he feels the yard can yield a reasonable use without the variance. Commissioner Renzi implied that bushes or 4 Zoning Board of Appeals Minutes September 3, 2019 Page 3 of 3 shrubs could provide the same result a fence would. Commissioner Renzi indicated he cannot support the variance request. Commissioner Seggebruch stated he would be willing to support the side yard setback, if he lines up the fence in the rear with the shed. Chairman Kiefer suggested adding a stipulation to have the applicant work with the staff to resolve the back-fence line as discussed. Mr. Panozzo agreed to the stipulation. Commissioner Womack made a motion to adopt the findings of fact of staff as the findings of fact of the Zoning Board of Appeals and recommend approval of a variance to permit a fence up to 31.5 feet into the corner side yard for the property located at 14415 South Maple Court. 1. Working with the staff to resolve the back-fence line as discussed. Seconded by Commissioner Seggebruch. Vote by roll call: Renzi, no; Ruane, no; Seggebruch, yes; Womack, yes; Kiefer, yes. Portage Ln. 9 Variance Request 15731 Portage Ln, Plainfield, IL 60544 This letter is in support of my request for a variance to the fence restrictions on a corner lot. The intention is to fence in the back yard and extend the fencing into the side yard toward Creekview Dr. Creekview Dr. has higher than typical traffic volume, and I would like to allow my young children to use a portion of the space in the side yard without the risks inherent with the street in question. Without the requested fencing, we would The proposed fence would be a slotted aluminum fence to avoid obscuring vision. I have included a markup to illustrate the requested area for the proposed fence along with a sample image of the fence style. Thank you for your consideration. ROLL CALL: Commissioners Heinen (7:04 p.m.), Minnis, Renzi, Ruane, Seggebruch, Womack, and Chairman Kiefer were present. Plainfield Fire Protection District, Plainfield Public Library District, Plainfield Township Park District and Plainfield Community Consolidated School District 202 were absent. OTHERS PRESENT: Jonathan Proulx, Director of Planning; and Yuchen Ding, Associate Planner APPROVAL OF MINUTES The Minutes of the Plan Commission meeting held on October 15, 2019 were approved as amended. PUBLIC COMMENTS Chairman Kiefer asked for public comment and there was no response. DEVELOPMENT REPORT Mr. Proulx provided updates on the following: Legendary Escape Games and TVA Logistics Inc. Chairman Kiefer asked if the Village had made a decision on a liquor license for the Legendary Escape Games. Mr. Proulx stated the applicant will not be serving liquor. Commissioner Ruane asked if the applicant resolved the dumpster issue. Mr. Proulx stated the waste will be consolidated with there operation in Aurora. OLD BUSINESS Case No. 1814-081318.AA.SU.PP Greenbriar Subdivision Edward Mattox Chairman Kiefer stated the applicant is not ready to proceed, so public hearing will be closed this evening. Chairman Kiefer explained when the applicant is ready to proceed again there will be another public hearing. Commissioner Renzi made a motion to close the public hearing for case number 1814-081318.AA.SU.PP on November 5, 2019. Second by Commissioner Minnis. Vote by roll call: Heinen, yes; Ruane, yes; Seggebruch, yes; Womack, yes; Minnis, yes; Renzi, yes; Kiefer, yes. Motion carried 7-0. NEW BUSINESS Case No. Will County Case 26049 W. Lockport St. Tom Putz Mr. Ding stated the applicant is seeking approval from Will County for a map amendment (re-zoning) from A-1 Agricultural to I-1 Limited Industrial on a 5-acre property located in unincorporated Plainfield Township. The subject zoning request is in response to a zoning violation for unpermitted uses in the A-1 district. In addition to a map amendment, the applicant is also seeking approval of a special use permit to allow an outdoor storage yard for boats. If approved, this would allow the applicant to continue utilizing the property for an outdoor storage yard, landscaping business and manufacturing business. Mr. Ding reviewed the staff report dated November 5, 2019. Mr. Ding concluded The Village of Plainfield has an opportunity to send a letter of objection to Will County regarding the proposed County map amendment. Staff recommends that the Village object based on the Village’s long-term plans for this area. 18 Plan Commission Minutes October 15, 2019 Page 2 of 3 Chairman Kiefer swore in Tom Putz, applicant. Mr. Putz stated he has owned the property for 18 years and explained the current use of the property which are residential, landscaping company, and pallet manufacturing. Mr. Putz explained he would like to annex into the Village when possible. Mr. Putz provided an explanation on how the zoning change would fit into the Villages’ future land use. Mr. Putz stated Will County will require the following improvements with the rezoning: stormwater detention, converting existing residents into office space, and acquiring IDOT approval for the entrances on Route 126. Mr. Putz stated he intends to use the property in the future to store boats and RV vehicles. Mr. Putz stated he plans on installing buffer around the property. Chairman Kiefer asked for public comment. No response. Chairman Kiefer closed public comments. Mr. Proulx stated the applicant has been working with staff to make sure the long-term plans for the business is compatible with the village’s plans. Mr. Proulx stated the applicant intends to install signage and fencing that will meet the village’s standards since he hopes to annex the property in the future. Commissioner Renzi asked staff if the Will County zoning would have any influence on an annexation into the Village. Mr. Proulx stated the property would be annexed into the village as R-1 (Residential Single-Family) and any current uses on the property could be addressed in the annexation agreement. Mr. Proulx explained that the rezoning of this property in Will County is driven by the outdoor storage use, since there is no special use for that in their Agricultural Zoning District. Chairman Kiefer asked if the use of the property would be grandfathered when it annexes. Mr. Proulx indicated that is common to grandfather the use and provided some examples of other properties that the uses were able to continue. Mr. Proulx stated this an opportunity to work with Will County to say we are interested in adequate detention, screening/buffering, and to ensure the access point from Route 126 satisfies IDOT requirements. Commissioner Heinen asked the applicant if the property is currently being used by a landscaping company and for pallet manufacturing. Mr. Putz confirmed. Commissioner Heinen asked the applicant if any permits were issued by the County to permit the uses. Mr. Putz stated no, Will County is requiring him to rezone the property because of the current uses. Commissioner Heinen stated he drives by the property everyday and feels it is an eye sore. Commissioner Heinen stated that he feels this is premature because all the violations currently on the property. Commissioner Heinen suggested the violations be correct first before a request for rezoning be considered. Commissioner Heinen indicated he does not have faith that the property will be brought up to code if the County approves the rezoning. Commissioner Heinen stated he does not feel long-term that this use is a fit. Commissioner Heinen recommends objecting to the County case. Commissioner Seggebruch stated he agrees with Commissioner Heinen’s comments. Commissioner Seggebruch indicated that objecting could avoid a future problem for the Village if this were to annex. Commissioner Minnis stated his issue is it does not fit in to the long-term comprehensive plan for the Village. Commissioner Minnis stated he feels that the land would be better as a residential development. Commissioner Minnis voiced his concern that the applicant did not obtain the proper permits or approval prior to make the improvements. Commissioner Womack stated he agrees with his fellow commissioners. Commissioner Womack stated that this use would be a better fit for 143rd St. Commissioner Womack stated that the applicant will need to spend a significant amount of money to complete the required improvements. Mr. Putz stated he has 19 Plan Commission Minutes October 15, 2019 Page 3 of 3 been taking the boats to the marina for 10 years and he felt this was a good fit because the business has grown over the year. Commissioner Ruane stated he also agrees with the other commissioner’s comments. Commissioner Ruane voiced concerns about the lack of proper permitting for what is already of the site. Commissioner Ruane asked staff to follow up EPA regarding water runoff. Commissioner Ruane stated it is not the correct use for the property. Commissioner Ruane stated he does not support the request. Mr. Putz stated he takes full responsibly for not obtaining the proper permits and will correct what needs to be corrected to bring the property into compliance. Commissioner Heinen added he hopes the County takes action on the noncompliance. Chairman Kiefer stated that when this property annexes it will be subject to more codes. Commissioner Renzi stated the commission needs to be true to the comprehensive plan. Commissioner Ruane made a motion that the Village of Plainfield forward a Letter of Objection of the proposed Map Amendment from A-1 to I-1 and the proposed special use permit for an outdoor storage yard to the Will County Land Use Department. Second by Commissioner Seggebruch. Vote by roll call: Heinen, yes; Minnis, yes; Renzi, yes; Womack, yes; Seggebruch, yes; Ruane, yes; Kiefer, yes. Motion carried 7-0. DISCUSSION Commissioner Seggebruch asked what the status of Chobar Towing building that is for sale on Van Dyke Rd. Mr. Proulx state the towing company has relocated and the building is zoned commercial and is not occupied at this time. Commissioner Renzi asked about the house with the new addition on Dillman St. Mr. Proulx stated the HPC did not support an alternative analysis after touring the property. Mr. Proulx added after the owner met with the HCP he decided to keep the original building and put an addition on it. Chairman Kiefer read the reminders. Main St Plainfield IL at the intersection of 126 and Route 59 in downtown Plainfield. It will be a one-of-a-kind luxury boutique suite and single chair rental concept for independent stylists and other salon professionals. Once construction is completed, the customizable salon suites and individual chair rentals will be move-in ready and fully equipped with all the amenities needed for a salon professional to operate their own business. Suite or chair rental options will be offered for salon professionals including but not limited to hair stylists, barbers, estheticians, massage therapists, nail techs, make-up artists and more. SUITE AMENITIES • 15 individual private suites will be available in various sizes • For those who don’t need or want a full suite, 9 individual chairs will be available for rent in a light, bright, open space • The following may be included in the suite rental based on the needs of each professional o Shampoo bowl and chair o Storage cabinet o Full length mirror o Chair o Tool cart o Private sink o Private lock for each suite HOURS OF OPERATION / PARKING While each salon owner will have access to their individual space 24 hours a day 7 days a week—salon professionals typically will book clients at varying hours between 8:00am and finishing up around 8:00pm Monday through Saturday. I anticipate that at any given time approx. 50% of the lessees will be in the building. CONSTRUCTION / TIMELINE FOR OPENING The property will require mostly cosmetic renovations since previously it was a doctor’s office with individual exam rooms. The exterior of the building will be a sophisticated black and white with awnings to modernize the dated building.
