HomeMy Public PortalAbout04-09-2002PLANNING COMMISSION MINUTES - APRIL 9, 2002 PRESENT: ELIZABETH WEIR, LENNY LEUER, DICK PICARD, TOM SUPEL, GERALD BROST, SHARON JOHNSON, RANDY BRINKMAN AND RON JOHNSON. ALSO PRESENT PLANNING AND ZONING ADMINISTRATOR LOREN KOHNEN AND PLANNING AND ZONING ASSISTANT SANDIE LARSON. ABSENT: MARY VERBICK Chairperson Elizabeth Weir called the meeting to order at 7:00 p.m. 1. ADKINS ASSOCIATES FOR QWEST - 3585 PINTO DRIVE - CONDITIONAL USE PERMIT FOR BUILDING EXPANSION - PUBLIC HEARING Loren Kohnen read his memo to the planning commission and put up overheads of the site and proposed expansion. He pointed out where he suggested that the arborvitae be placed. Mike Ostlie, Adkins Associates, said that 50 decibels is the MPCA noise level standard. He said that 30 is unrealistic. Mike had pictures of the generator and its enclosure. He also had color photos of the concrete wall. Tom Supel asked Loren to clarify the metal panels vs the concrete panels and where they would be. L. Kohnen put up an overhead and pointed the walls out. The metal panels are the generator enclosure. Paul Piekarski, 3575 Pinto Drive, asked what the decibel level was of the present generator. M. Ostlie said he would guess between 80 - 100 decibels. Lenny Leuer said at the sketch review he was under the impression that the concrete panels were going to completely enclose the generator. M. Ostlie said he was not, but it could. L. Leuer said that in our commercial areas we do not allow metal buildings and this generator enclosure is metal. Lenny asked about the sound silencer and Mike explained. it. Planning Commission Minutes April 9, 2002 1 L. Leuer asked what the height of the generator and silencer were in comparison to the screen wall. M. Ostlie said the screen wall should be higher. Lenny said it did not look like it was. He reiterated that he thought the generator was to be entirely enclosed. Lenny asked Loren about #2 in his recommendations and asked about floor drains. L. Kohnen said if the drain is in the rest room they need a curb around it 2-4" high. L. Leuer asked about the engineer's recommendation for a drainage and utility easement on the north property line. L. Kohnen said we can do that by separate instrument since there is no plat involved. Randy Brinkman asked about the south elevation and pointed out the stack.. He said he would recommend that the precast panels be higher to screen it all. He said he too was under the impression that the precast panels would screen it all. He said this seems the best, cleanest way to do it, with precast panels. L. Kohnen said with the height of the generator and stack it is about 16'. M. Ostlie said that with the muffler on top, it is about 16' and that is taller than the old building and about 1' shorter than the new building. R. Brinkman said he would recommend screening straight across so the 2 elevations are the same. M. Ostlie said he would like to screen it all except for the north side, so that the generator is easier to get to for servicing. T. Supel said he has two questions: 1 - he asked Mike if the water treatment areas were acceptable and Mike said yes and 2 - the decibels. He said by the time the council gets this it should be nailed down. 30 decibels was mentioned at the last council meeting. M. Ostlie said the MPCA standard is 50 decibels at the property line at night. T. Supel said just so it is right when it gets to the city council. L. Kohnen said that the testing of equipment cannot take place between 5 pm and 8 am. Ron Johnson said the MPCA has jurisdiction of decibels levels, does the city also? L. Kohnen said only if we have an ordinance on it and he said he does not think we do. Planning Commission Minutes April 9, 2002 2 R. Johnson asked the energy source for the generator and Mike said diesel. The public hearing was closed. R. Brinkman said the north side will not have a concrete panel screen and he said just so we don't wish we had done it. L. Leuer said that the north looks into our commercial area and they do need access into the generator area. MOVED BY LENNY LEUER AND SECONDED BY RANDY BRINKMAN TO RECOMMEND APPROVAL OF THE CONDITIONAL USE PERMIT FOR 3585 PINTO DRIVE FOR A BUILDING EXPANSION WITH THE FOLLOWING CONDITIONS: 1. The generator should have a concrete screen from the existing building, west then north to the end. It is to be the same or higher than the generator + exhaust. 2. Proper types and #'s of plants will have to be worked out with city staff for use in the water treatment area. 3. The sound level of the generator must be tested by a qualified technician and the results forwarded to the city to verify compliance. The decibels are not to exceed 50 decibels at the lot line. 4. Testing of the generator is to occur between the hours of 8 am and 5 pm, Monday thru Friday. 5. All lighting on the exterior of the building and the property must be shoe box style with all sides enclosed except the bottom with the lens recessed and light source not visible. 0 foot candles at all property lines will be permitted. 6. No outside storage is permitted. 7. There needs to be curb on floor between battery area and floor drain. 8. Follow engineers recommendations, 10 drainage and utility easement on the NW and south lot lines and 33' road right-of-way. MOTION PASSED. 2. GRAMERCY CORPORATION - 5022 COUNTY ROAD 101 - PLAT 2 LOTS TO 1 LOT AND REZONE TO MR-PUD - PUBLIC HEARING Loren Kohnen read his memo to the planning commission and stated that this was being reviewed for the 2nd time by Hennepin County. He put up an overhead of the area. Lou Stocco, vice-president Gramercy Corporation said the question raised last time of trees on both sides of the north road, they will do that. He then passed out landscape plans and a letter from Julius Droweiler. L. Kohnen said that the question of the park fee will be discussed at the city council meeting.. Planning Commission Minutes April 9, 2002 3 Julius Dorweiler, 5022 County Road 101, said he was in favor of this project but is concerned with the platting and said the enemy is Hennepin County. They have said they were not going to take my house and I would not have sold if Hennepin County was not going to do that. Julius said he has just received an offer from the County and they plan on starting construction on the road in August and no one else has been contacted. Julius wanted to know when final approval would be given on the plat and he is concerned because the county has not acquired his property. L. Kohnen said the city council would decide if they are taking ROW for the county thru this platting. Tom Supel said he is confused - can we proceed with this platting and is the 60 day rule hanging over our head. L. Kohnen said that the applicant will have to give us a 60 day extension. He said the planning commission could still approve this and let the city council wrestle with the issue. He said it is between Gramercy and Julius and the county. If this goes to the city council, they will have to make the decision on the ROW. There was discussion on Julius, Gramercy and what is happening with the county. Mike St. Martin said they are coordinating their grading with the county's grading. L. Kohnen said maybe these things should be resolved between Julius and Gramercy and the county before this goes forward. He said there are too many things hanging out there. He said there should be a meeting with the county and then with the city. Loren said he would recommend. a letter from Julius and Gramercy to table this for further information and until this issue of ROW is resolved the discussion cannot take place at a city council meeting. J. Dorweiler said he was sorry he had not brought the correspondence from the county. T. Supel asked Mr. Stocco if this all was news to them. L. Stocco said that Mike St. Martin has had many conversations with the county. He said their purchase agreement was with the understanding that the county was taking about 7/10 of an acre. Lou said they would like to start the pre -sale of the units in June with construction to start October -November. There was discussion of what we could do. J. Dorweiler said he would like to see it go forward for Mr. Stocco. Elizabeth Weir said this looks like a very fine development and would like to see it happen. Planning Commission Minutes April 9, 2002 4 L. Kohnen said that other developers up and down the road have given property for road easements. L. Stocco said if we need another 30 days, I'm o.k. with it, but want to move quickly. He said he is comfortable with tabling until this is worked out. Lenny Leuer said he does have a few other questions: #1 - Clydesdale Trail - the engineer recommends that it go all the way to the east. L. Kohnen said he has discussed this with city engineer Tom Kellogg and the city council did not want it to go all the way to the east - there would be a potential for too much traffic from Plymouth using Gramercy and Cudd roads. L. Leuer : #2 - He said that the homes to the south had brought up about having city water - how about the easement to the property line to the south. M. St. Martin pointed out where it would go and talked of alternatives. T. Supel said he is uncomfortable with dropping this at this point if we pushed this on to the city council. L. Stocco asked if the planning commission could pass this and then have it go to the city council after it was worked out with Julius, the county and us. L. Kohnen said all three items should be at the next planning commission meeting. There was further discussion of what - when. E. Weir said it seems most advantageous to table and do all three next time - plat, rezone and PUD. MOVED BY LENNY LEUER AND SECONDED BY JERRY BROST TO LEAVE THE PUBLIC HEARING OPEN AND TABLE THIS APPLICATION FOR FURTHER INFORMATION AND THEN DEAL WITH THE PLAT, REZONING AND PUD AT THE SAME TIME. J. Dorweiler said he has said it in the past, there has been meeting without the property owners involved. L. Kohnen said the meeting was strictly engineering issues. MOTION PASSED. 4. DISCUSSION OF PLANNING COMMISSION TRAINING GUIDE Planning Commission Minutes April 9, 2002 5 This will be discussed when there is a draft for everyone to look at. 5. PLANNING COMMISSION REPRESENTATIVES AT CITY COUNCIL MEETINGS Elizabeth Weir wanted to add a discussion about the representatives at the city council meeting. She said it would be helpful if the representative could get a city council packet and also the planning commission chair. There was discussion of getting city council packets and the interaction at city council meetings. Tom Supel said that for standard planning commission agenda items, the planning commission representative at the city council could give the report. There was further discussion of the planning commission role at the city council meetings. 6. MINUTES OF MARCH 12, 2002 The following changes were made: Page 1 - 3rd paragraph - add (for sound) and asked - -; Page 6 - 12th paragraph - change `it is' to they are; Page 8 - 4th paragraph - add - - sloped and have slight - - Page 9 - 10th paragraph - change name to A. Jackson; page 11 - 12th and 13th paragraphs - change `hardvoce' to hardcover and change to - `with the addition the green space is 50.1%; page 12 - 15th paragraph change `produce' to product and page 13 - in second motion change name to Sharon Johnson. MOVED BY RON JOHNSON AND SECONDED BY TOM SUPEL TO APPROVE THE MINUTES AS CORRECTED. MOVED BY SHARON JOHNSON AND SECONDED BY RON JOHNSON TO ADJOURN. MOTION PASSED.
