CITY OF TEMPLE CITY

DECEMBER 23, 1963
INITIATION:
1. The regular meeting of the City Council of the City of Temple
City was called to order by Mayor Nunamaker at 7:30 P.M.,
2. following which the Mayor gave the invocation, followed by the
3. Pledge of Allegiance to the Flag.
4. ROLL CALL:
PRESENT: Councilmen - Dickason, Merritt, Tyrell, Nunamaker
ABSENT: Councilmen-Fitzjohn
ALSO PRESENT: City Attorney Shatford and City Manager Woollett
5. APPROVAL OF MINUTES:
City Manager Woollett corrected the minutes of Dec. 9, 1963 as
follows: Page 1, Public Hearing appealing zone variance Case
#63 -62, the phrase "and without future fee" should be changed to
read ''give credit for the fee paid for the variance'.
Also, on the last page under Adjournment, should read 'adjourn
to the next meeting on December 19, 1963 ".
Councilman Dickason moved to approve the Minutes of December 9,
1963 as amended, seconded by Councilman Merritt and carried by
the following roll call vote:
AYES: Councilmen - Dickason, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT: Councilmen - Fitzjohn
UNFINISHED BUSINESS:
6. RESOLUTION NO. 63-335: Denying without prejudice Variance re-
quested by Walter A. Sawyer & Emory F. Sawyer, Variance Case
#63 -62. .City Manager Woollett read title. Councilman Merritt
moved to adopt Resolution No. 63 -335, seconded by Councilman
Tyrell and carried by the following roll call vote:
AYES: Councilmen - Dickason, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT: Councilmen- Fitzjohn
PUBLIC HEARING: 7:30 P.M. Requested change of zone Case #63-69,
property west side Arden Drive between Randwick and Green St.
from A -1 -1 acre to R -1. Planning Advisor Cushman explained that
a subdivision tract No. 29143 for 9 parcels having 5,000 sq. ft.
or more has been submitted and approved and contractor is re-
questing a change of zone from A -1 Acre to R -1 to permit this
useage.
Councilman Tyrell moved to open the public hearing, seconded by
Councilman Dickason and carried. Mayor Nunamaker asked if anyone
wished to speak for or against and no one came forward. Council-
man Merritt moved to close the Public Hearing, seconded by
Councilman Tyrell and carried. Mr. Cushman advised that the sur-
rounding area consists of some older homes on larger lots, but
that the newer homes in the area are on 5,000 to 6,000 sq. ft.
lots. Councilman Tyrell moved to instruct the City Attorney to
draw an ordinance in accordance with the recommendations of the
Planning Commission, making the effective date that time when
the Council approves the final tract map. Seconded by Councilman
Merritt and carried by the following roll call vote:

NOES: Councilmen: None

City Attorney Shatford arrived at 7:45 P.M.
PUBLIC HEARING: 7:30 P.M. - Zone Variance Case #63 -64, Benjamin Boyd
10520 Key vWest.- Appeal of Planning Commission Decision.
Councilman Dickason mowed to open the Public Hearing, seconded
by Councilman Merritt and carried. Planning Advisor Cushman ad-
vised the requested variance was to allow a second parcel having
the required 5,000 sq. ft. but not the required front footage.

Total square footage of lot is 13,200, while the second parcel
proposed is 5600 sq. ft. The surrounding area is developed in
single family residences. The Planning Commission recommended
denial, primarily on the basis that there are two parcels on
either side with the same situation and an approval on this case
would mean an invitation to approve the other two. After study-
ing the map, it was felt that perhaps there was enough area by
combining forces to build a subdivision, but there were strong
doubts on the part of the Planning Advisor. Mayor Nunamaker asked
if anyone wished to speak for the requested variance and Mr.
Benjamin Boyd, 10520 Key West, owner of the property in question,
addressed the Council stating that he felt that an injustice was
being done him due to the fact that his house is the smallest in
the area and his lot one of the largest. At present, the land is
assessed at more than the house, and in his opinion he would never
be able to sell his house without a loss at its present status.
Mr. Boyd discussed in great detail his feelings with regard to
the improvement of his property, and felt that unless he were
granted this variance the property would gradually deteriorate,
thus becoming an eyesore to the whole neighborhood, as well as a
financial loss to him.
Mayor Nunamaker then asked for those who wished to speak against
granting this variance. Mr. Robert Juenemann, whose parents live
at L..941 Doreen to the rear of Mr. Boyd's lot, stated that his
parents moved to their present home 15 years ago for the express
purpose of having a large yard with privacy. It is their feeling
that if this one variance were granted it would soon lead to
others, thus destroying the spaciousness of the area.
Mrs. Caroline Hintz, 4927 Doreen, also expressed these sentiments
and was very strongly in favor of denial.
Noone else wished to address the Council and Councilman Dickason
moved to close the Public Hearing, seconded by Councilman Tyrell
and carried. City Attorney Shatford informed the Council that
although Mr. Boyd stated his case very well, the size and shape
of a lot and the location with respect to surrounding homes and
lots is of primary importance in making a decision of this nature,
and the Planning. Commission felt that granting this variance
would be an encroachment for surrounding residences.
Councilman Tyrell moved to deny the appeal and reaffirm the Plan-
ning Commission's decision, and instruct the City Attorney to
draw a resolution to this effect. Seconded by Councilman Dickason
and carried by the following roll call vote:

NEW BUSINESS:
8. SET PUBLIC HEARING FOR ASSESSMENT ON CURB & GUTTER CONSTRUCTION
AGNES AVE. WEST SIDE, MILOANN TO LA ROSA.
City Manager Woollett suggested public hearing be set for 7:30 P.M
on January 13, 1964. Councilman Tyrell so moved, seconded by
Councilman Merritt and carried.
9 AGREEMENT BETWEEN TEMPLE CITY, EL MONTE, ROSEMEAD & SOUTHERN
PACIFIC COMPANY re improvement of grade crossing and protective
devices on crossing #3493.3 on Temple City Blvd.:
City Manager Woollett recommended the Council instruct the Mayor
and City Clerk to sign the Agreement. Councilman Dickason so
moved, seconded by Councilman Tyrell and carried by the following
roll call vote:
AYES: Councilmen: Dickason, Merritt, Tyrell, Nunamaker
NOES: Councilmen: None
ABSENT: Councilmen: Fitzjohn
10. RESOLUTION NO. 63 -334: ADOPTING AND SUBMITTING BUDGET FOR FUNDS
ALLOCATED BY STATE HIGHWAY FUND TO CITIES:
City Manager Woollett read title and explained Resolution No.
63-334. Councilman Tyrell moved to adopt Resolution No. 63-334,
seconded by Councilman Dickason and carried by the following roll
call vote:

11. ASSIGNMENT OF FOUR PARKING LOT LEASES FROM COUNTY OF LOS ANGELES
TO CITY:
Councilman Tyrell moved to instruct the Mayor and City Clerk
to sign indicating acceptance, and instruct the City Clerk to
sign for the leases. Seconded by Councilman Merritt and carried
by the following roll call vote:
AYES: Councilmen: Dickason, Merritt, Tyrell, Nunamaker
NOES: Councilmen: None
ABSENT: Councilmen: Fitzjohn
12. REVISED BUILDING INSPECTION SERVICES AGREEMENT:
City Manager Woollett explained that this Agreement gives the
City more flexibility in getting the County to do what we wish.
Councilman Merritt moved to instruct the Mayor and City Clerk .
to sign for a four year term, seconded by Councilman Tyrell and
carried by the following roll call vote:

13. RESOLUTION NO. 63 -333: WARRANTS & DEMANDS, NCS. 4435 through
4456 IN THE SUM OF $2,686.55.
Councilman Merritt moved to adopt Resolution No. 63-333, seconde
by Councilman Tyrell and carried by the following roll call vote

NOES: Councilmen: None
ABSENT: Councilmen: Fitzjohn
14. PLANNING COMMISSION RECOMMENDATIONS: ORDINANCE NO. 63 -118
AMENDING NO. 63 -112 TO ALLOW SIX CHILDREN IN FOSTER HOME WITH
24 HOUR CARE:
City Attorney Shatford read title and explained the purpose of
allowing six children in an R -1 Zone rather than three was to
allow children from large families to remain together.
Councilman Merritt moved to waive further reading, seconded by
Councilman Nunamaker and carried.
15. SET PUBLIC HEARINGS: CURB AND GUTTER:
(a) Lora St. north side, Pal Mal to cul de sac
(b) Lora St. south side, Pal Mal to cul de sac
Councilman Tyrell moved to set public hearings on the two curb
and gutter projects for 7:30 P.M. January 13, 1964, seconded by
Councilman Dickason and carried.
16. COMMUNICATIONS: None
17. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
(1) Charles Oakley, 6064 Rosemead Blvd. stated that the people.
next door to him at 6156 Rosemead Blvd., Gabriel G. Janus,
were given until December 15, 1963 to cease and desist operation
and to this date are still doing upholstery work. City Attorney
Shatford informed Mr. Oakley that the matter would be checked.
18. MATTERS FROM CITY OFFICIALS:
(1) Mr. Woollett informed the Council that the Deputy City Clerk
Marjorie Woodruff, had sufFered a fall resulting in a broken
ankle, which was broken in three places. She has undergone sur.-
gery and is in the Arcadia Methodist Hospital, where she will
remain for at least a week. She is expected to remain at home
at least three weeks after that.
(2) City Manager Woollett requested that the City Hall be closed
at 12:00 Noon on Christmas Eve in order to give the employees
an opportunity to do their last minute shopping in Temple City.
Councilman Dickason moved to approve, seconded by Councilman
Merritt and carried.
(3) Mr. Woollett wished everyone a Merry Christmas from the staff
,1 9. ADJOURNMENT: Councilman Dickason moved to adjourn at 8:35 P.M.
and carried. Council adjourned until the next regular meeting
on January 13, 1964 at 7:30 P.M. at tap Ci .1.
