HomeMy Public PortalAboutResolution 63-312RESOLUTION NO. 63 -312 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING THE EXECUTION OF CERTAIN DOCUMENTS TO COMPLETE JOINT POWERS PROJECT BETWEEN THE CITY OF TEMPLE CITY AND THE COUNTY OF LOS ANGELES IN REGARD TO EXCHANGE OF REAL PROPERTY, CONSTRUCTION OF A NEW COUNTY LIBRARY, AND ALTERATION AND MODIFICATION OF FORMER COUNTY LIBRARY INTO NEW CITY HALL. WHEREAS, the County of Los Angeles and the City of Temple City, heretofore on May 24, 1962, entered into a Joint Powers Agreement for the construction of a branch county library to be located within the City of Temple City; and WHEREAS, the said agreement provided that the City of Temple City would construct on certain real property a library building to serve as a library facility for the Temple City area; and WHEREAS, said agreement provided that the County shall have the option to purchase said library and the real property upon which said library is located at a price based upon the total cost of the construction of the building plus the cost to the City of Temple City for its purchase price of a certain lot upon which said library has been constructed; and WHEREAS, said agreement also provided that upon purchase of the new library by the County, the City shall have the option to purchase from the County the old library building and cer- tain adjacent real property for the sum of Fifty -six Thousand Dollars ($56,000); and WHEREAS, said new library building has been completed and accepted by the County in accordance with the terms and condi- tions of said Joint Powers Agreement; and WHEREAS, it is the desire of County and City to.immedia- tely exchange said real property and library facilities in the manner provided for in said agreement; and WHEREAS, the City of Temple City has found and deter- mined that the real property to be acquired from the County of Los Angeles is required for City use; and WHEREAS, the entire cost of engineering, soil tests, con- struction costs, land acquisition, and other miscellaneous amounts in the final development of the new county library total $262,673.33; and WHEREAS, the County has agreed heretofore to contribute the sum of $262,673.33, leaving a balance of $237,673.33 to be ultimately paid for by the City of Temple City, which said sum shall be paid to the City of Temple City by the County of Los Angeles pursuant to the terms of the aforereferenced Joint Powers Agreement, as amended; and WHEREAS, the City of Temple City has the right, under the . aforesaid Joint Powers Agreement, to acquire the old County Library and land for the agreed purchase price of $56,000; and WHEREAS, the City of Temple City has determined to exer- cise its option right as aforesaid; and WHEREAS, the said option price of $56,000.00 shall be deducted. from the aforereferenced sum of $237,673.33, leaving a balance due to the City of Temple City in the sum of $181,673.33; and WHEREAS, the City of Temple City, in addition to receiv- ing the said stun of $181,673.33, shall receive the $25,000.00 419 contribution as set forth in an amendment to the Joint Powers Agreement, leaving a total balance due to the City of Temple City by the County of Los Angeles of $206,673.33; and WHEREAS, in order to effectuate and finalize the afore - referenced agreements between the County of Los Angeles and the. City of Temple City, it is necessary that an escrow be opened with the Bank of America, Temple City Branch, Temple City, Cali- fornia, wherein and whereby the aforesaid sums due to the City of Temple City by the County of Los Angeles shall be paid and there shall be exchanged deeds and policies of title insurance pursuant to the terms of the said Joint Powers Agreement, as amended, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1, The City Manager, William Woollett, Jr., or the Assistant City Manager, Karl Koski, and the Mayor, A. L. Nunnamaker, or the Mayor Pro Tem, Iioward M. Dickason, are hereby authorized to execute for and on behalf of the City of Temple City the following documents: (a) Escrow Instructions to the Bank of America, Temple City Branch, as attached hereto, marked Exhibit "A" and incorporated herein as though set forth in full, and any amend- ments thereto of any kind or nature which the City Attorney shall determine are reasonably required to carry out the in- tent and purposes of the Joint Powers Agreement, as amended. (b) Any and all deeds and other instruments of conveyance or title information, as shall be approved by the City Attorney, to carry out the intent of the Joint Powers Agreement, as amended. In particular the aforereferenced officers of the City of Temple City are authorized to convey to the County of :Los Angeles the real property described as: Lots 99; 100 and the Easterly half of Lots 101 and 102 of Tract No. 6561 in the City of Temple City, County of Los Angeles, State of California, as shown on Map recorded in Book 72, pages 34 -35 of Maps, in the office of the Recorder of said County. SECTION 2. The City Council does affirm by this Resolution, for the purpose of expediting any title company inquiry, that the City Manager is authorized, pursuant to Resolution No. 63 -312, to receive for and on behalf of the City of Temple City that certain real property referenced in the Joint Powers Agreement, as amended, and therein described as: The Westerly half of Lots 101 and 102, Tract No. 6561, in the City of Temple City, County of Los Angeles, State of California, as shown on Map recorded in Book 72, pages 34 -35, of Maps in the office of the Recorder of said County. SECTION 3. Upon approval of the City Attorney, the aforenamed officers of the City of Temple City are hereby autho- rized to make and execute any other documents which shall be reasonably .required, in the opinion of the City Attorney, to carry out and conclude the terms of the aforereferenced Joint Powers Agreement, as amended.
