George Shaw stated he have been cited and will go to court after the mitigation determination is made. Chair
David McNaughton asked if we know the name of the contractor who cut the trees. George Shaw stated it is in the
packet and not a company we are familiar with. Marie Rodriquez asked Officer Hattrich if he talked to the
company that cut the trees. Officer Hattrich approached the Planning Commission and stated yes, when they
arrived on scene he did not recognize the name of the company and they did not have any identification and did not
speak English. One of his assistants did speak English and had identification so Officer Hattrich issued him the
citations, his name is Ishmeal Padilla. The company could not show any business license and he is not registered as a
contractor with the City of Tybee. Officer Hattrich also stated he and the arborist did observe the ten stumps and
measured the diameter and it was his opinion that all of those trees at breast height would have exceeded the
diameter for a tree pursuant to our code sections. So he did issue ten citations to Mr. Padilla who has also been in
front of the judge with the owner of the company. Officer Hattrich stated he also cited the owner of the property
since he hired the company that cut the trees. The judge postponed any decision so that this process can go through
and the mitigation requirements can be met. Officer Hattrich also contacted DNR Deb Barreiro to come look at the
trees in the marsh. DNR Deb Barreiro stated the ones near the marsh are very close to the jurisdiction line but she
did not want to pull a line since the city was taking care of the citations. Marie Rodriquez asked Officer Hattrich if
he asked the company if they cut more trees than they were supposed to. Officer Hattrich stated no, he is not
required to ask anything like that and this is something that he's brought up since we issued the citations, the owner
was not on site. Jay Schmetz, who lives at 1121 Sandhill Road, Guyton, approached the Planning Commission and
stated he has some pictures that show the trees look dead and he handed it to the Planning Commission to look at.
He stated he was unaware he needed a permit to cut trees. Also the company employees did not speak English and
just misunderstood what he wanted. Martha Williams asked if the contractor had a valid business license and was
registered with the city. Jay Schmetz said no. He also stated he has plenty of trees left on the property. Elaine
McGruder made a motion to deny. Marie Rodriquez seconded. Vote was unanimous to deny, 6-0
George Shaw stated the applicant Terry Timmons did apply for a tree removal permit and wanted to remove a few
palm trees that he believes will interfere with the growth of live oak trees. The arborist went to the site and he did
not feel the palm trees were causing imminent damage to the oak trees or any structures. So based on our ordinance
he didn't feel like it was appropriate to issue a permit for tree removal. Staff recommends denial for that reason.
Susan Hill stated she saw a couple that she thought could interfere with the oaks growth. She asked if under section
7 050 A if the minimum density of three trees per 4,500sgft could come into play in this situation and allow him to
take out a couple of those trees. George Shaw stated under normal circumstances yes, but unfortunately all species
of palms are considered significant and the way the ordinance is written we didn't feel like we could approve. Terry
Timmons, who lives at 2 Horsepen Point, Tybee Island approached the Planning Commission and stated palms will
grow eight or nine inches a year and when you have high winds they will eat away the small branches and over time
it modifies the shape of the tree. He stated he is looking for about four palms to remove which is less than ten
percent of the palms that he has now. He also stated he does values live oak trees more than palms. Martha
Williams asked if he discussed his concerns with the arborist when he was there. Terry Timmons stated he never
saw him. George Shaw stated unfortunately our ordinance does not favor one significant tree species over another,
so determining which species should if any of them come out is not spelled out or clear. Marie Rodriquez made a
motion to deny. Elaine McGruder seconded. The motion failed for lack of majority vote. Whitley Reynolds made
a motion to continue until the arborist can meet with the owner. Martha Williams seconded. Voting in favor were
Elaine McGruder, Marie Gooding, Susan Hill, Whitley Reynolds and Martha Williams. Voting against was
Marie Rodriguez. Vote to continue was,abbroved, 5-1.

George Shaw stated that Council member Barry Brown recommended this Fourth Street site instead of the lot next
to the fire station on Jones since the city uses that location for an emergency lay down when there is a hurricane or
disaster. This site does not block any accesses to properties. It would be an inconvenience to some who come upon it
accidentally. And of course the city will have to find another staging area for some of our parades. Staff looked at it
and it will be feasible. These plans are tentative right now we will figure out better when the buildings come in.
These are two modular buildings. Elaine McGruder made a motion to approve. Whitley Reynolds seconded. Vote
to approve was unanimous, 6-0

APPLICATION: Appeal of actions Sec. 7-100 regarding denial of tree permit.
PROPOSAL: The applicant is requesting to remove four palm trees from his lot. His application was denied.
ANALYSIS: The applicant submitted a permit to remove five palm trees from his lot. The City arborist went to the
lot and found the trees healthy and not causing damage to any structure. _Palms are on our significant tree list and
may not be removed unless unhealthy or causing damage to a structure. At the request of the Planning Commission
to reassess the application based on the future health of the trees involved the arborist revisited the site and
recommends removal of all of the requested palms.
The Comprehensive Plan describes the Marshfront Neighborhood as follows:
arshfront Neighborhood: Along the marshfront exist residential uses of various ages, sprinkled with
intermittent commercial uses. Zoning classifications are R-1, R -IB, R-2, and E -C. Providing natural
habitat, scenic views, and access to the water via docks and creeks, natural resources here require
special consideration.

Must maintain a density of 3 trees per 4,500 square feet. All trees with a 6" diameter at 4.5 feet above the ground
count toward the density.
Significant trees must be replaced inch -far -inch in like species with minimum 2 -inch diameter trees or be otherwise
mitigated.
By accepting the Tree Removal Permit, the property owner and the applicant agree to comply with all requirements
of the tree ordinance including mitigation requirements, planting specifications and tree survival requirements.

Mr. Timmons, the resident of 2 Horsepen, had requested four Sabal palms to be removed on his property several
weeks ago. At that time, due to some confusion with our ordinance, I recommended denial of said permit
request. George Shaw and I revisited the site and met with Mr. Timmons. Upon our meeting and reassessing the
concerns, I agree that the four palms in question, will eventually cause issues. Unfortunately, they are growing
so close to Live oaks, that they are competing for growth and nutrients. Eventually, this will cause the demise of
one or both trees. It is my opinion and recommendation to remove said palms. Thanks.

PROPOSAL: The applicant is requesting site plan approval for a new lab building on the east side of the property.
ANALYSIS: The applicant currently has a laboratory building near the proposed location of the new structure.
The new lab will be a factory built mobile lab that will be anchored to piers on site. It will meet all setback and
drainage requirements.

Drainage Plan for Proposed Modular Lab Buildingt the Waste Water Treatment
Facility
The City of Tybee Island is proposing to a modular building at the existing waste water treatment
facility in the parking area in the north east quadrant of the lot. The modular lab building is
1,568 square feet. This proposed building, decking, and ramp will create approximately 2,000
square feet of additional impervious surface in the 248,425 Square Foot (5.726 Acre) City owned
lot which the waste water treatment facility is located.
Since this building will be elevated, the pervious surface will remain under the footprint of the
building. The additional surface drainage created by the modular buildings will drain in a
northerly direction into the existing drainage ditch and remain on city owned property. The
increased runoff and will infiltrate into the existing ground before it has a chance to leave the
City owned property.
Since the additional drainage will be contained on the City owned lot there will be no adverse
effects to neighboring property owners, therefore an official drainage plan should not be required
for this project.
I have attached a site plan showing the proposed first floor elevation and the proposed drainage

Drainage 1 or Proposed Modular Lab Buildingat the Waste Water Treatment
Facility
The City of Tybee Island is proposing to a modularbuilding at the existing waste water treatment
facility in the parking area in the north east quadrant of the lot. The modular lab building is
1,568 square feet. This proposed building, decking, and ramp will create approximately 2,000
square feet of additional impervious surface in the 248,425 Square Foot (5.726 e) City owned
lot which the waste water treatment facility is located.
Since this building will be elevated, the pervious surface will remain under the footprint of the
building. The additional surface drainage created by the modular buildings will drain
northerly direction into the existing drainage ditch and remain on city owned roe e
increased runoff and will infiltrate ' to the existing ground before it has a chance to leave the
City owned props
Since the additional drainage will be contained on the City owned lot there will be no adverse
effects to neighboring property owners, therefore an official drainage plan should not be required
for this project.

Recommendation to City Council,
Proposal to edit to Section 7-060, Removal of Significant Trees

REQUEST: For consideration by the Planning Commission, Addition to Agenda, April 18, 2022
PROBLEM:As written, the tree ordinance does not provide any latitude for the subject matter
expert to use his best professional judgement when considering a permit to remove a tree. The
ordinance does not permit "thinning" a stand of protected trees; that is, cutting one or more to
facilitate better overall health of the rest. The ordinance as written does not provide any
latitude for professional judgement when one or more trees of different but protected species
grow into one another, unless presenting an immediate danger. It is possible that some
protected trees will become a danger or unhealthy if allowed to grow unchecked.
RATIONALE: Intent is to clarify the existing tree removal ordinance. Some requests for tree
removal brought before the Planning Commission do not meet the current criteria as defined,
but a logical case can be made for tree removal. The proposed change enhances the ability of
the city subject matter expert to use best professional judgement to preserve protected tree
species.
City staff currently has no flexibility to use reasonable expert judgement in certain cases where
best practices may favor removal of protected species to preserve the health of other protected
tree species. This may result in an appeal to the Planning Commission, for recommendation to
city council. When this happens, it generates unnecessary "churning," that is, the process of
application for, and consideration of a tree removal permit becomes unduly complex, more
prone to undesirable outcomes, and excessively time consuming.
AUTHORITY: Section 11-110, Duties; paragraph D, Land Use Planning; which reads:
Land use planning. The planning commission shall make careful surveys and studies
periodically in order to update the city's master plan and Land Development Codes.
Consideration shall be given to existing conditions, probable future development, and
the promotion of public health, safety, prosperity, economics [sic] development,
efficiency and the general welfare as evidenced by the quality of life in the
community.
IMPACT: The addition of a condition will allow the Zoning Office to consider the "best practice"
professional judgement of the Arborist and the rationale is documented on the permit, "...
promoting the public health, safety, prosperity, economic development, efficiency and the
general welfare as evidenced by the quality of life in the community."

(A) Significant trees may be removed only under the following situations or conditions:

International Society of Arboriculture body of knowledge, as recommended by the zoning
administrator. The rationale for the removal recommendation shall be documented and
included in each permit granted by the city; and
4. Prior to the issuance of a permit allowing the removal of a significant tree, the zoning
administrator shall confirm in writing that one or more of the situations enumerated
herein exists.

It is hereby ordained by the governing authority of the City of Tybee Island that Section 7-060,
Removal of significant trees, be amended to include the following clause after paragraph A to
read:
