As you are well aware, prior to the time that this request was made, Martin O'Boyle and his affiliated entities, including you, had in 2014 and 2015 alone filed at least 15 public records suits against the Town of Gulf Stream. Gulf Stream, Case No. 2014CC015050 RL Your request is not only extremely broad, it encompasses internal communications and memoranda shared with the Town's attorney in the course of ongoing litigation that would be exempt under Florida Statute 119.0171(1)(d) l until the conclusion of the litigation. To search for responsive documents, assess whether they constitute public records and determine if any exemption applies will require significant time and expense. The Town estimates 6 hours of administrative support at $36.39 per hour, 10 hours of administrative support at $50 per hour, and at least 8 hours of attorney support to review for exemptions related to ongoing litigation at $235.00 per hour, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d). (6 hours @ 36.39 = 218.34) - (.25 hour @ 36.39= 9.10) + (10 hours @ 50.00 = 500.00) + (8 hours @ 235.00 = 1,880.00) = Deposit Due: $2,589.24 in cash or check. The Town of Gulf Stream is currently working on a large number of incoming public records requests.
