HomeMy Public PortalAbout15-32 SIGNALIZED INTERSECTION PROGRAM 1st Reading: October 14, 2015 2"d Reading: November 12, 2015 Public Hearing: November 12, 2015 Adopted: November 12, 2015 Effective Date: November 12, 2015 Sponsored by: City Manager ORDINANCE NO. 15-32 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AMENDING ORDINANCE NO. 13-22, SIGNALIZED INTERSECTION SAFETY PROGRAM, ARTICLE X, CREATING SECTION 15-137 CLARIFYING THE PENALTY AND PROVIDING FOR AN ADMINISTRATIVE FEE FOR HEARING; PROVIDING FOR SEVERABILITY AND CONDIFICATION; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, The City Commission adopted Ordinance 13-22, the Signalized Intersection Safety Program on July 10, 2013; and WHEREAS, Sections 316.0083 of the Florida Statutes permits the application of a fine and administrative fee associated with the of the Signalized Intersection Safety Program; and WHEREAS, The City Commission desires to clarify the penalty and administrative fee applicable to Signalized Intersection Safety Program. NOW THEREFORE, BE IT DULY ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA: Section 1. The recitals and preambles herein are incorporated by reference. Section2. The City of Opa-locka City Commission hereby amends Ordinance 13-22, Article X creating section 137 to read as follows: All penalties and cost shall be collected in accordance with the Mark Wandall Traffic Safety Act. The administrative cost for a hearing held before the special magistrate hearing officer shall not exceed amount the set forth in the Mark Wandall Traffic Safety Act . Section 3. All ordinances or code provisions in conflict herewith are repealed. Section 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent Ordinance No. 15-32 jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 5. CODIFICATION. This Ordinance shall be codified in the Code of Ordinances when the Code is recodified. Section 6. EFFECTIVE DATE.
