Bids for materials and the installation of in -ground lighting &
receptacles for medians #1,2 & 3 on Crandon Blvd.
The following is a list of bids opened and received for the installation of in -ground
lighting and receptacles for medians #1,2 & 3 on Crandon Blvd.
• Horsepower Electric, Inc. $29,900.00
• Traffic Control Devices, Inc. $49,252.00
• Electrical Contracting Service $59,900.00
It is my recommendation that as the lowest bidder, Horsepower Electric be awarded the
job.
II. The following is a list of all bids opened and received for the materials of in -ground
lighting & receptacles for medians #1,2 & 3 on Crandon Blvd.
• Paramount Electronic Dist. $33,234.30
• South Dade Electrical Supply, Inc. $34,182.00
• Gem -B Electric Supply, Inc. $35,073.00

It is my recommendation that as the lowest bidder, Paramount Electronic Dist. be awarded
the job.
This lighting project will accomplish the following:
1. Eliminate outages occurring to median one on Crandon Blvd.
2. Provide lighting to the coconut palms in median two and three.
(Electrical sleeves were previously installed during the Street Lighting Project)
3. Provide adequate lighting to the American flag.
This project is a goal of the Village Council and part of the Crandon Boulevard
improvement project. Funding is available for this project.

Village Clerk The Clerk reported that the Mayor had issued the following proclamations during the
month of August a) Proclaiming August 25 -September 1, 1997 as Firefighter Appreciation Week,
b) Proclaiming September 16, 1997 as Flonda International University Day, c) Proclaiming
September 16, 1997 as International Day of Peace, d) Proclaiming September 17-23, 1997 as
Constitution Week, e) Proclaiming October 14-20, 1997 as Licensed Midwives Awareness Week,
f) Proclaiming November 18, 1997 as National Community Education Day
Village Manager The Village Manager requested a motion to authonze him to award the following
contracts a) Contract for landscaping maintenance services for a two year period to Gorgeous
Lawns, Inc in the amount of $ 99,967 00
The Attorney addressed the Council regarding this issue
Councilmember Fried made a motion to award the landscaping contract to Gorgeous Lawns, Inc
The motion was seconded by Councilmember Han and approved by a 4-0 roll call vote The vote
was as follows Councilmembers Fried, Han, Vice Mayor Padovan and Mayor Festa voting Yes

for a total of $ 33,000 to Horsepower Electric, Inc 2 Materials $ 33,234 30 + 10% contingency
for a total of $37,000 to Paramount Electronic Distributor
Councilmember Han made a motion to award the contract for lighting Crandon Boulevard medians
Councilmember Fried seconded the motion
Mayor Festa made a motion to defer this item to the next Council meeting The motion was
seconded by Vice Mayor Padovan and failed by a 3-1 voice vote The vote was as follows
Councilmembers Han, Vice Mayor Padovan and Mayor Festa voting Yes Councilmember Fned

Councilmember Fned made a motion to reconsider the motion to defer The motion was seconded

AGREEMENT FOR
SERVICES
THIS AGREEMENT, made and entered into on the a day of 3ePtemter , 1997 by and
between the Village of Key Biscayne, Dade County, Florida, party of the first (hereinafter called
"Village"), and Horsepower Electric, Inc. , party of the second part (Hereinafter called "Contractor");
RECITALS
The VILLAGE wants to engage the CONTRACTOR to perform certain services as described
in accordance with paragraph 1, scope of services to this Agreement ("Specified Services"). The
CONTRACTOR wants to provide such Specified Services in connection with the installation of in -
ground lighting and receptacles on Crandon Boulevard
In consideration of the mutual covenants in this Agreement, the parties agree as follows.
1. SCOPE OF SERVICES
A. The CONTRACTOR agrees, as directed by the Village Manager, to perform the following
services:
- Provide the Village of Key Biscayne with the installation of in -ground lighting and
receptacles for medians #1, 2, and 3 on Crandon Boulevard as stated in Addendum No 1, dated June
30, 1997. (Attached as Exhibit A)
2. FEES FOR SERVICES
The CONTRACTOR agrees to charge the VILLAGE for Specified Services provided in
accordance in Exhibit in an amount not to exceed TWENTY NINE THOUSAND NINE HUNDRED
dollars ($29,900.00).
3. TERM
The term of this agreement is 1 year unless terminated pursuant to paragraph 7 or
extended pursuant to paragraph 9.
4. GENERAL TERMS AND CONDITIONS
The VILLAGE reserves the right to increase or decrease the quantity of items installed with
appropriate adjustments to the contract price.
5. ASSIGNMENT
This Agreement shall not be assignable by the CONTRACTOR
6. PROHIBITION AGAINST CONTINGENT FEES
The CONTRACTOR, warrants that it has not employed or retained any company or person,
other than a bonafide employee solely for the CONTRACTOR, to solicit or secure this Agreement,
and that it has not paid or agreed to pay any person(s), company, corporation, individual or firm,
other than a bona fide employee working solely for the CONTRACTOR any fee, commission,
percentage, gift, or any other consideration, continent upon or resulting from the award or making
of this Agreement unless approved by the Manager of the Village of Key Biscayne.
7. TERMINATION
This Agreement may be terminated by the VILLAGE upon ten days' written notice with or
without cause by the CONTRACTOR upon 45 days' written notice with or without cause. If this
agreement is terminated, the CONTRACTOR shall be paid in accordance with the provisions of
Paragraph 2 of this contract for all acceptable work performed up tp the date of termination.
8. NONEXCLUSIVE AGREEMENT
The services to be provided by the CONTRACTOR pursuant to this Agreement shall be
nonexclusive and nothing herein shall preclude the VILLAGE engaging other firms to perform the
same or similar services for the benefit of the VILLAGE within the VILLAGE'S sole and absolute
discretion.
9. ENTIRE AGREEMENT
The parties hereby agree that this Agreement between the parties. This Agreement cannot
be amended or modified without the express written consent of the parties
10. WARRANTIES OF CONTRACTOR
The CONTRACTOR hereby warrants and represents that all times during the term of this
Agreement it shall maintain in good standing all required licenses, certifications and permits required
under Federal, State and local laws necessary to perform the Specified Services.
The CONTRACTOR shall furnish proof that he has Worker's Compensation Insurance as
required by Chapter 440, Florida Statutes and, where applicable, coverage for the U S
Longshoremen's and Harbor Worker's Act and the Jones Act.

The CONTRACTOR shall also furnish proof that he has Contractual Liability Insurance and
Automobile Liability Insurance covering all owned, non -owned and hired vehicles used in connection
with this work, in an amount no less than $1,000,000 per Occurrence for Bodily Injury and Property
Damage combined.
11. ATTORNEY'S FEES
In connection with any litigation arising out of this Agreement, the prevailing party shall be
entitled to recover reasonable attorney's fees and costs This provision shall exclude all litigation
resolved by agreement of the parties
12. NOTICES
All notices and communications to the VILLAGE shall be in writing and shall be deemed to
have properly given if transmitted by registered or certified mail or hand delivery All notices and
communications shall be effective upon receipt Notices shall be addressed as follows:

14. GOVERNING LAW
This Agreement shall be construed in accordance with the laws of the State of Florida.
IN WITNESS WHEREOF, the parties hereto have accepted, made and executed this
Agreement upon the terms and conditions above stated on the day and year first above written

1. Enclosed Drawings # El, E2 and E3 dated June 30, 1997. Disregard all other
drawings and specifications issued previously.
2. Clarifications and/or directives shall be addressed to "Raul Lastra, Village Planner"
Tel: 305-365-8912 at least five (5) calendar days before bid time.
3. Bond Requirements: $ 50,000
4. Time of Construction: 90 calendar days.
5. Special Provisions: All lighting fixtures will be provided by the Village of Key
Biscayne, to be installed by the Contractor.
