HomeMy Public PortalAboutExhibit L&B 83 Second Addendum To Procedural Schedule 9 6 11SECOND ADDENDUM TO PROCEDURAL SCHEDULE 2011 WASTEWATER RATE CHANGE PROCEEDING The Rate Commission adopts and approves this Second Addendum to the Procedural Schedule as revised on July 8, 2011 and August 8, 2011. (a) Supplemental Testimony. (i) Any Intervenor, Legal Counsel, and the Consultant may submit prepared Supplemental Testimony and schedules regarding the Electronic Reports to be made available by the District no later than September 16, 2011. Such testimony shall be filed at the principal office of the Rate Commission with copies to the District, the Consultant, Legal Counsel, and any other Intervenor. (ii) Such testimony shall include all information, analysis and other supporting data explaining the position of the party with respect to any element of the Electronic Report and supporting and explaining any alternative that the party wishes the Rate Commission to consider. (b) Supplemental Testimony Technical Conference. A Supplemental Testimony Technical Conference shall be held on the record at the Metropolitan St. Louis Sewer District, 2350 Market Street, St. Louis, Missouri 63103 at the conclusion of the Public Hearing on September 26, 2011. The Technical Conference regarding the Supplemental Testimony at which each person submitting Supplemental Testimony shall answer questions propounded by the District, the Consultant, Legal Counsel, and any Intervenor shall continue on successive business days until the Supplemental Testimony Technical Conference is completed. (c) Responsive Testimony. (i) The District, any Intervenor, Legal Counsel, and Consultant, may on or before September 22, 2011, submit prepared Responsive Testimony and schedules regarding the Supplemental Testimony. Such testimony shall be filed at the principal office of the Rate Commission with copies to the District, the Consultant, Legal Counsel, and any other Intervenor. (ii) Such Responsive Testimony shall include all information, analysis and other supporting data explaining why the party rejects or disagrees with positions taken by persons submitting Supplemental Testimony. 1 The Electronic Report means an electronic copy with formulas intact of the May 10, 2011, Black & Veatch Metropolitan Sewer District Rate Proposal. (d) Responsive Testimony Technical Conference. A Responsive Testimony Technical Conference shall be held on the record at the Metropolitan St. Louis Sewer District, 2350 Market Street, St. Louis, Missouri 63103 at the conclusion of the Supplemental Testimony Technical Conference. The Technical Conference regarding the Responsive Testimony at which each person submitting Responsive Testimony shall answer questions propounded by the District, the Consultant, Legal Counsel, and any person permitted to intervene shall continue on successive business days until the Responsive Testimony Technical Conference is completed. (e) Prehearing Conference. The Prehearing Conference previously scheduled for September 15, 2011, shall be moved to September 28, 2011, at the Metropolitan St. Louis Sewer District, 2350 Market Street, St. Louis, Missouri 63103, beginning at 9:00 a.m. The Prehearing Conference Reports shall be due October 5, 2011. (f) Public Hearing. An additional Public Hearing session shall be held on October 6 2011, at 9:00 a.m. at the Metropolitan St. Louis Sewer District, 2350 Market Street, St. Louis, Missouri 63103, during which evidence shall be submitted into the record and closing statements will be made by the District, the Consultant, and any other person who has been permitted to intervene. Public notice shall be given of the additional Public Hearing session. Approved: September 6, 2011
