AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A PRELIMINARY
PUD PLAN FOR PROPERTY LOCATED AT 1501 AND 1503 EAST HIGH STREET; DESCRIBED
AS PART OF OUTLOT 72, JEFFERSON CITY, COLE COUNTY, MISSOURI
WHEREAS, Henry and Linda Stratman, owners of the real estate hereinafter described, having
submitted a Preliminary PUD Plan of said real estate, being Part of Outlot 72,
Jefferson City, Cole County, Missouri, more particularly described as follows:
Beginning at a point on the southerly line of said outlot, 100 feet westerly from the
southwesterly corner of the part of said outlot sold to Adam Schubert, by deed of
record in Book 30, Page 198, Cole County Recorder's Office; thence North 25
degrees, 12 minutes East, 404.40 feet to a point on the southerly line of Lincoln
Subdivision, per plat of record in Plat Book 6, Page 75, Cole County Recorder's
Office; thence North 72 degrees, 38 minutes West, along the southerly line of
Lincoln Subdivision, 49.85 feet; thence South 25 degrees, 12 minutes West, 389
feet to the southerly line of Outlot No. 72; thence South 56 degrees, 38 minutes
East, along said southerly line, 50.00 feet to the beginning point of this
description; and, Part of Outlot No. 72 in the City of Jefferson, Missouri, being the
southerly part of that parcel of land described by deed of record in Book 205,
Page 580, Cole County Recorder's Office, more particularly described as follows:
From the southeasterly corner of Lot No. 11, of Lincoln Subdivision, as per plat of
record in Plat Book 6, Page 75, Cole County Recorder's Office; thence North 72
degrees 34 minutes 17 seconds West, along the southerly line of said Lot No. 11,
2.36 feet to the easterly line of the aforesaid parcel described in Book 205, Page
580; thence, along the boundary of said parcel described in Book 205 Page 580,
the following courses: South 25 degrees 05 minutes 56 seconds West, 147.03
feet to the Point of Beginning for this description; thence continuing South 25
degrees 05 minutes 56 seconds West, 275 feet, to a point intersecting the south
line of the aforesaid Outlot No. 72, being also the northerly line of the High Street
right-of-way; thence North 54 degrees 53 minutes 51 seconds West, along said
outlot line, 50.0 feet; thence North 25 degrees 01 minutes 01 seconds East,
266.24 feet; thence leaving the boundary of the aforesaid parcel described in
Book 205 Page 580, South 64 degrees 58 minutes 59 seconds East, 49.62 feet to
the point of beginning. Containing, in all, 0.73 acres, more or less; and
WHEREAS, it appears that the procedures set forth in the Zoning Code relating to Planned
Unit Developments have in all matters been complied with, as said property owner
submitted to the Planning and Zoning Commission and City Council a Preliminary
PUD Plan for the above referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Preliminary PUD Plan, on file as Case No. P15004 in the Jefferson City
Planning Division, is hereby approved for the land referenced above.
Section 2. Permitted Land Uses. Permitted uses for the property shall be limited to the
following: Single Family Residential, Office, Retail, Personal Services, In-Home Businesses, and
off-site parking for a commercial use.
Section 3. Common Areas and Public Land. No common areas are proposed and no
lands are dedicated to public use with this PUD Plan.
Section 4. This ordinance shall be in full force and effect from and after the date of its

Applications filed by Henry and Linda Stratman, property owners, for the following:
1. Rezoning of 0.18 acres from C-2 General Commercial and 0.55 acres from RS-4 Single
Family Residential to PUD Planned Unit Development.
2. A Preliminary PUD Plan for an unpaved parking area and use of the houses on the property
as specified commercial or residential uses.
The property is located on the north side of East High Street 250 feet west of Lincoln Street and
is described as part of Outlot 72, Jefferson City, Missouri.
Mr. Barron described the proposal and explained that the subject properties are located across
the street from The Village Square and consist of two residential properties. He stated that a portion
of one of the lots is zoned C-2 General Commercial and the remainder of the lots are zoned RS-4
Single Family Residential. Mr. Barron explained that the Applicant proposes to extend the driveway
along the eastern side of 1501 E. High Street to accommodate overflow parking for employees
during major events thereby freeing up parking at The Village Square for customers. He stated that
the driveway would be paved from the intersection with High Street to a point behind the houses,
where it would transition to gravel. Mr. Barron explained that a residential garage located on 1501
E. High Street would be demolished and a new 30’x24’ garage would be constructed with a one
foot setback from the property line. He stated that a four (4) foot tall privacy fence would be
installed along the western property line at 1501 E. High Street.
Mr. Henry Stratman, 2962 State Road AA, Holts Summit, Missouri, spoke regarding this request
and explained that there are seven (7) retail businesses with at least two to three employees each
at the Village Square. He stated that they take up a considerable amount of on-site and on-street
parking. Mr. Stratman explained that when there are major events at The Village Square there is a
need for vendors and employees to park off-site to free up parking for visitors and customers. He
stated that they bought the subject properties to make better use of the land behind the residential
homes. Mr. Stratman explained that he made slight modifications on the PUD plan to reduce the
size of the garage in order to add a patio.

Correspondence in favor of this request was received from Mr. Thomas Gredell, P.E. Gredell
Engineering Resources,1505 E. High Street.
Mr. Barron gave the Planning Division staff report. He inquired whether Mr. Stratman contacted
the property owner at 1411 E. High to the west of his property about locating the garage so close to
the property line. Mr. Stratman explained that he tried to make contact with them and verify if they
knew where the property line was, which they did not. He stated that he will have the property line
surveyed before he moves to that phase. Mr. Stratman explained that he will let them know of his
plans for that property.
Mr. Lester moved and Ms. Cotten seconded to recommend approval to rezone the subject
properties from RS-4 and C-2 to PUD to the City Council. The motion passed 8-0 with the following
votes:
Aye: Cotten, Deeken, Fitzwater, George, Jordan, Lester, Vaughan, Yarnell
Mr. Lester moved and Ms. Cotten seconded to recommend approval of the Preliminary PUD Plan

Tenants/Employees and Vendors during major Village Square
events--thus affording close -in parking for event customers
and attendees.
1. Rezone entirety of both properties (1501 & 1503 E. High) as a PUD
authorizing mixed use of buildings and commercial parking on the
backyards of both lots.
2. Potential Mixed-Use of buildings: SF Residential, Office, or Retail
(Aka; Hair/Beauty Care Treatments/Sales), or in -home businesses.
3. Remove existing garage on 15011ot---construct new 2 car garage 30
x 24 feet, 1 foot off of Western property line for Res. and Com . use.
4. Extend driveway due North along Eastern Side of 1501 Lot approx
120ft. from new garage (12' wide); gravel initially-concrete in
future. See diagram attached.
5. Level/blend 1501 & 1503 lots to accommodate 10 parking spaces
directly off driveway East & 10 spaces in Western direction. Parking
area -initially grass covered (gravel/concrete in future).
6. Install security lighting vicinity of home on north and south corners

7 . Widen High Street driveway approach by 6 to 8' to better align with

The property is located on the north side of East High Street 250 feet west of Lincoln Street and is
described as patt of Outlot 72, Jefferson City, Missouri.
Nature of Request
The applicants are the owners of the Village Square (formerly Warwick Village) commercial center
across High Street from the subject properties. They are seeking an overflow parking area in order to
accommodate parking for employees during major events, thereby freeing up parking at the Village
Square for customers. The owners are also seeking flexibility in terms of the future use of the existing
residential hou ses on the subject properties. To this effect, the owners have proposed a rezoning of th e
property to PUD Planned Unit Development and a Preliminary PUD Plan for an overflow parking area
located behind the houses, which are proposed for potential mixed use (proposed uses including single
family residential, office, retail , personal services, or in-home businesses).

Overflow Parking Area: The overflow parking lot is proposed to remain unpaved, with a gravel driveway
and grass parking spaces (with planned gravel or paving in the future). The driveway would be paved
from the intersection with High Street to a point behind the houses, where it would transition to gravel.
Minor modifications to the driveway intersection are also planned. The parking area would be able to
accommodate approximately 20 cars .
Garage: A resident ial garage on the 150 I property would be demoli s hed and a new 30 'x24 ' garage would
be constructed with a proposed setback from the si de property line of I foot. The garage would be half
utilized by th e residence on the property and half utilized as ma intenance storage for the Village Square
commercial operation.
Permitted Uses: Permitted uses for the existing houses on the propet1y are proposed as Single Family
Residential, Office, Retail, Personal Services, or In-Home Businesses.
Signs : No signage is proposed within the PUD Plan .
Lighting: Residential style security lighting would be installed on the new garage in order to provide a
minimal level of lighting for the parking area .
Bufferyard: A 4' tall privacy fence would be installed along the western property lin e of the 150 I
property between the house and garage and north from the garage approximately 40 feet. The fence
would be located on ground that si ts 2 feet higher than the rest of the property , effectively resulting in a 6
feet tall privacy barrier.

Staff recommend approval of the request to rezone the property and the PUD plan proposal. The Village
Square s hopping center is an excellent example of an effective reuse of a hi sto ric property, and is a
promising addition to the east side business di strict that adds hi storic character to the C ity . But the
propetty suffers from a lack of available parking, and uni q ue consideration (outside of the normal zoning
code proce sses) is necessary in order to accommodate th e parking need of this property while protecting
the adjacent residential areas from more intensive forms of commercial development. The proposed PUD
Plan would accompli sh this dual goal with minimal impacts to surrounding propetties .
