AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE
VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO THE PRESENT
CITY LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, ADDRESSED AS 2111
BALD HILL ROAD; DESCRIBED AS PART OF OUTLOT 112 AND PART OF THE
NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 20
TOWNSHIP 44 NORTH, RANGE 11 WEST, IN THE COUNTY OF COLE, STATE OF
MISSOURI; AND AMENDING SECTION 1-17 OF THE CODE OF THE CITY OF
JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY BY ADDING
ONE NEW SUB-SECTION PERTAINING TO THE SAME SUBJECT.
WHEREAS, pursuant to Section 71.012.2 RSMo, the City Council of the City of
Jefferson desires to annex the unincorporated area of land described in
Section 1; and
WHEREAS, the property is adjacent to the current City boundary; and
WHEREAS, a public hearing concerning the annexation was advertised in advance of
the hearing in the Jefferson City News Tribune.
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY
OF JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The City Council intends to and shall proceed to annex, as provided
by law, the unincorporated area of land described as follows: Part of Outlot No. 112, in
the City of Jefferson, Missouri, and part of the Northeast Quarter of the Southeast
Quarter of Section 20, Township 44 North, Range 11 West, Cole County, Missouri, more
particularly described as follows: From the Southeasterly corner of said Outlot No. 112;
thence North 02 degrees, 32 minutes, 12 seconds West along the Northeasterly line of
said Outlot No. 112, 34.22 feet; thence South 86 degrees, 15 minutes, 00 seconds
West, 114.79 feet to the beginning point of this description; thence continuing South 86
degrees, 15 minutes, 00 seconds West, 325.28 feet to the Northerly right of way line of
Bald Hill Road; thence along said northerly right of way line, on the following courses
and distances: South 32 degrees, 06 minutes, 00 seconds East, 22.22 feet; thence on a
curve to the left, having a radius of 287.09 feet, a distance of 150.38 feet; thence South
62 degrees, 06 minutes, 47 seconds East, 43.77 feet; thence on a curve to the right,
having a radius of 606.67 feet, a distance of 58.95 feet; thence North 30 degrees, 50
minutes, 00 seconds East, 223.38 feet to the beginning point of this description. Except
any part therefrom which may have been conveyed to the City of Jefferson, by Deed of
record in Book 269, Page 550, Cole County Records Office. Containing 0.78 acres,
more or less.
Section 2. The City Council finds and declares that the land described in
Section 1 is contiguous to the City boundary; that the annexation is reasonable and
necessary to the proper development of the City; and further, did determine the City has
an ability to furnish normal municipal services to this area.
Section 3. A public hearing was held on April 20, 2015 as provided by law,
concerning the annexation of the unincorporated area described in Section 1.
Section 4. The land described in Section 1 shall be zoned RS-3 until such time
as the zoning may be changed in the manner provided for by State Statute and City
Code.
Section 5. The annexed area shall be in Ward 1 of the City until such time as
the ward boundaries may be changed in the manner provided for by City Code.
Section 6. Section 1-17 of the City Code of the City of Jefferson, Missouri is
hereby amended by adding one new subsection which shall read as follows:
(X) The City's boundaries shall also include the following parcel: Part of
Outlot No. 112, in the City of Jefferson, Missouri, and part of the Northeast
Quarter of the Southeast Quarter of Section 20, Township 44 North, Range 11
West, Cole County, Missouri, more particularly described as follows: From the
Southeasterly corner of said Outlot No. 112; thence North 02 degrees, 32
minutes, 12 seconds West along the Northeasterly line of said Outlot No. 112,
34.22 feet; thence South 86 degrees, 15 minutes, 00 seconds West, 114.79 feet
to the beginning point of this description; thence continuing South 86 degrees, 15
minutes, 00 seconds West, 325.28 feet to the Northerly right of way line of Bald

Section 7. The effective date of this Ordinance and the annexation of the area
described in Section 1 will be immediately upon passage, provided that no written
objections to the proposed annexation are filed with the City Council. If sufficient
objections are filed, this ordinance shall not become effective until such time as the
annexation issue has been resolved pursuant to the provisions of Chapter 71 RSMo.

The City Council of the City of Jefferson, Missouri, will hold a public hearing on the following matter on
Monday, April 20, 2015 at 6:00 p.m. in the Council Chamber of the John G. Christy Municipal Building,
320 East McCarty Street, Jefferson City, Missouri.
2111 BALD HILL ROAD -VOLUNTARY ANNEXATION PETITION. A petition for voluntary
annexation has been filed with the City Council for the City of Jefferson City to annex certain
property into the City of Jefferson City at the request of the property owner, said property being
described as: Part of Outlot No. 112, in the City of Jefferson, Missouri, and part of the Northeast
Quarter of the Southeast Quarter of Section 20, Township 44 North, Range 11 West, Cole County,
Missouri, more particularly described as follows: From the Southeasterly corner of said Outlot No.

Case No. P15005 – 2111 Bald Hill Road, Voluntary Annexation and Zoning Plan. Application
filed by William Burnett, property owner, for voluntary annexation of 0.78 acres, pursuant to
Section 71.012 RSMo, and approval of a zoning plan for the property to be zoned RS-3 Single
Family Residential. The property is located on the east side of Bald Hill Road 100 feet south of
Eastland Drive and is described as part of Outlot 112 and part of the Northeast Quarter of the
Southeast Quarter of Section 20, Township 44 North, Range 11 West, Jefferson City, Missouri.
Mr. Barron described the proposal and explained that the property owner has the property listed
for sale. He stated that in order to connect to the City sewer system, the property owner is
petitioning for voluntary annexation. Mr. Barron explained that the applicant is requesting a zoning
designation of RS-3 Single Family Residential, which would match the adjacent property within the
City Limits. He stated that the subject property is contiguous to the current city limits and the
property lends itself well to incorporation and the requested single family residential zoning would
conform to the recommended land use of the Comprehensive plan.
No one spoke in opposition to this request and no correspondence was received.
Mr. Lester moved and Mr. Vaughan seconded to recommend approval of the annexation request
and zoning plan establishing an RS-3 zoning for the property to the City Council. The motion
passed 8-0 with the following votes:

by William Burnett, property owner, for voluntary annexation of 0. 78 acres , pursuant to Section 71.012
RSMo, and approval of a zoning plan for the property to be zoned RS-3 Single Family Residential. The
property is located on the east side of Bald Hill Road I 00 feet south of Eastland Drive and is described
as part of Outlot 112 and pmt of the Nmtheast Qumter of the Southeast Quarter of Section 20 , Township
44 North, Range II West , Jefferson City, Missouri.

This propetty consists of a 0.78 acre tract located adjacent to the existing city limits. The prope1ty
owner has the property listed for sale. In order to allow for any future construction on the prope1ty to
connect to the City sewer system, the property owner is petitioning fo r voluntmy annexation. City Code
requires annexation in order to co nnect to the City sewer system . The applicant is requesting a zoning
designation of RS-3 Single Family Residential, which would match the adjacent property within the City
Limits.

Staff Recommendation
Voluntary Annexation and Zoning Plan:
The property owner has submitted a request to annex the property into the city limits of the City of
Jefferson with an RS-3 zo ning designation. The prope1ty is contiguous to the current city lim its and the
prope1ty lends itself well to incorporation and the requested single family residential zoning would
conform to the recommended land use of the Comprehensive plan. Staff recommends approva l of the
annexation and zoning plan.
Form of Motion:
I. Motion for approval of the annexation request and zoning plan establishing an RS-3 zoning for
the property.
