ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA,
FLORIDA AMENDING ORDINANCE 15-31, SECTION 22-118 PROPERTY
MAINTENANCE, "I", OF THE LAND DEVELOPMENT REGULATION
DEALING WITH EXTERIOR COLOR STANDARDS FOR COMMERCIAL
BUILDINGS, INDUSTRIAL BUILDINGS, MULTI-FAMILY BUILDINGS,
DUPLEX RESIDENCES AND SINGLE-FAMILY RESIDENCES. FURTHER
PROVIDING FOR RESTRICTIONS AND REQUIREMENTS FOR THE EXTERIOR
COLORING OF EXISTING AND NEW COMMERCIAL, INDUSTRIAL AND
RESIDENTIAL STRUCTURES; CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN THE LAND
DEVELOPMENT REGULATION AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the City Commission of the City of Opa-locka, Florida desires to improve and enhance the
appearance of all commercial, industrial, multi-family, duplex and single-family buildings throughout the
City; and
WHEREAS, the City Commission desires to attain a goal of unified exterior appearance for all existing
buildings in the City that will enhance the image of the City and provide a uniform appearance; and
WHEREAS, it is the intent of this legislation to eliminate garish or brilliant colors, while allowing
individuality that contributes to the enhancement of the City's image.
WHEREAS, Ordinance 02-2 established a color scheme chart that all commercial buildings must conform
to and the inclusion of single-family home structures to conform to use of this color pallet.
WHEREAS, this Ordinance amends Ordinance 15-31, Section 22-118 Property Maintenance, "1", of the
Land Development Regulation to include Exterior Color Standards for all buildings, and
NOW,THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION FO THE CITY OF OPA-LOCKA, FLORIDA:
SECTION 1. The recitals to the preamble herein are incorporated by reference.
SECTION 2. Ordinance 15-31, Section 22-118, "I" of the Zoning Regulation is amended in the

"Exterior Color Standards for all commercial, industrial, multi-family, duplex and single-family
buildings, Existing and Current.
All commercial, industrial, multi-family, duplex and single-family buildings shall have a

unified exterior color chosen from the City's color scheme chart. This general requirement and
other requirements outlined in this Ordinance shall apply to all buildings-and-structures,
commercial, industrial, multi-family, duplex and single-family buildings within the corporate
limits of the City of Opa-locka, (all commercial and industrial buildings, residential town homes,
single-family residences and medium, moderate and high density_multi-family residential
districts such as apartment buildings).
A. When the areas involved forms an integral part of any established section of the
City,the exterior color shall enhance rather than detract from the character of the surrounding
Commercial/Industrial Buildings or multi-family, duplex and single-family residences.
The color scheme is established, and all existing and current businesses and multi-
family,duplex and single-family residences shall conform to the established color scheme chart,
a copy of which is attached as exhibit"A"
Section 3. All ordinance or parts of ordinances in conflict herewith are hereby repealed.
Section 4. If any portion, subsection or section of this Ordinance is found invalid or
Unconstitutional by any court of competent jurisdiction,then said holding shall in no way affect
the validity of the remaining portion of this Ordinance.
Section 5. This Ordinance shall be codified and made a part of the City of Opa-locka Land
Development Regulation.
Section 6. This Ordinance shall become effective in the manner provided by law.

Short Title:

Staff Summary
Ordinance 02-2 established a color scheme chart so that the painting of all commercial/industrial buildings would be
uniform in appearance and it included this requirement for single-family residences also. The goal of this legislation is
to provide for a uniform appearance for all existing and new buildings to enhance the image of the City and to eliminate
garish or brilliant colors, while allowing individuality that contributes to the enhancement of the City's image. This
ordinance amends Ordinance 15-31, Section 22-118 Property Maintenance, "I", of the Land Development Regulation to
include Exterior Color Standads for all buildings in the City. A copy of Section 22-118, with a Draft of the amendment
listed as section "I" Exterior Color Standards is also attached.

All existing structures must conform to a color scheme compatible to the structures in
the surrounding area and chosen from the City's color scheme chart. Such existing structure
shall have three years after adoption of this Ordinance,to bring the property into compliance
with the requirements of this Ordinance. Single family residences shall have until June 1,
2003 to conform to a color scheme selected from the City's color scheme chart.Except: 1)if
a building or any part thereof is repainted, the entire building shall conform to this
Ordinance; 2) if the paint or any part thereof of a building becomes unsightly or is not
maintained,the entire building shall be required to conform with this section upon notice by
the Director of Buildings and Licenses; 3)Potentially historic buildings and buildings on the
National Register for historic Places may use colors from the color scheme chart provided

that approval is granted by the Historic Preservation Board. All existing structures which fail
to come into compliance shall be in violation of the Code and subject to code enforcement
proceedings thereof; 4) if a single family residence is repainted, it shall conform to this
Ordinance; 5)if the paint of a single family residence becomes unsightly,the single family
residence shall be required to conform with this section upon notice by the Director of
Building and Licenses.
The exterior color scheme for designated commercial property and single family
residences within the City Shall be authorized by the ' -_ . _ - • - !' --

Once a color scheme is established, all existing and current businesses and single
family residences shall conform to the established scheme.
