CITY OF MEDINA
RESOLUTION NO.2018-75
RESOLUTION GRANTING PRELIMINARY APPROVAL OF THE
CAVANAUGHS MEADOWWOODS PARK THIRD ADDITION PLAT
WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and
existing under the laws of Minnesota; and
WHEREAS, Arrowhead Holdings, LLC (the "Owner") owns property located west of
Arrowhead Drive and north of Meander Road (the "Property"), which is legally described as:
Outlot A, Cavanaughs Meadowwoods Park, Hennepin County, Minnesota
WHEREAS, the Owner has made an application for preliminary approval of a subdivision
of the Property into one lot and one outlot to be platted as Cavanaughs Meadowwoods Park Third
Addition; and
WHEREAS, the Planning Commission held a duly noticed public hearing on September
11, 2018 and continued the hearing on October 9, 2018, reviewed the information provided by the
Owner and City staff, heard testimony from interested parties, and recommended approval of the
preliminary plat; and
WHEREAS, the City Council reviewed the proposed preliminary plat and the Planning
Commission recommendation and heard additional testimony on September 18, 2018 and October
16, 2018; and
WHEREAS, subject to the fulfillment of the conditions noted below, the City Council
makes the following findings of fact in regard to the preliminary plat based on the requirements of
the Subdivision Ordinance:
a. The proposed preliminary plat is not in conflict with the Comprehensive Plan and is not
premature for consideration.
b. The subdivision is appropriate for the physical conditions on the site including the
topography, storm water, natural resources, and soils.
c. The proposed subdivision will not cause substantial environmental damage.
d. The proposed subdivision is not likely to be injurious to public health.
e. The proposed subdivision and its improvements will not conflict with public or private
streets, easements, or right-of-ways.
NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota
hereby grants preliminary plat approval for Cavanaughs Meadowwoods Park Third Addition,
subject to the following terms and conditions:

1. The Owner shall enter into a development agreement with the City, which shall include the
conditions described below as well as other requirements by City ordinance or policy.
2. The Owner shall install all improvements shown on the plans dated September 21, 2018
except as may be modified herein. The design of all improvements shall be reviewed and
approved by the City Engineer prior to commencing construction.
3. The Owner shall dedicate a trail easement 10-feet in width adjacent to the northern property
line and pay cash -in -lieu of additional land dedication in an amount of $161,386.24.
4. The Owner shall enter into a petition and waiver agreement regarding future turn lane
construction to serve the proposed access for the Property.
5. The plat shall dedicate drainage and utility easements around the perimeter of Lot 1, over all
water mains and hydrants, and over all wetland areas.
6. The Owner shall submit documents for review and approval by the City which will be
recorded against the Property and the adjacent properties related to cross -access.
7. The Owner shall submit a letter of credit in an amount of 150% of the cost of site
improvements in order to ensure completion.
8. The final plat applicant shall be filed within 180 days of the date of the city council
resolution granting preliminary approval or the approval shall be considered void, unless a
written request for time extension is submitted by the applicant and approved by the City
Council.
9. The Owner shall pay to the City a fee in an amount sufficient to reimburse the City for the
cost of reviewing the preliminary plat, construction plans, and other relevant documents.

The motion for the adoption of the foregoing resolution was duly seconded by member Cousineau
and upon vote being taken thereon, the following voted in favor thereof:
Anderson, Cousineau, DesLauriers, Martin, Pederson
And the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
