The Monthly Average Limit for E. coli is expressed as a geometric mean. SPECIAL CONDITIONS 1. This,pemut may be reopened and modified, or altematively revoked and reissued, to: a) Comply with any applicable effluent standard or limitation issued or approved under Sections 301(b)(2)(C) and (D), 304(b)(2), and 307(a) (2) o(the Clean Wntcr Act, if Ihc eftlucnt standard or limitation so issued or approved: 1) contains different conditions or is othenvise more stringent than any effluent limitation in the penit; or 2) controls any pollutant not limitcd in thc permit. b) Incorporate new or modificd efflucn limitations or other conditions, if the result of a waste load allocation study, toxicity test or other information indicates changes are necessary to assure compliance with Missouri's Water Quality Standards. c) Incorporate new or modified efflucnt limitations or other conditios if, as the result of a watershed anatysis, a Total Maximum Daily Load (TMDL) limitation is developed for the receiving waters which are currently included in Missouri's list of waters of the state not fully aclicving the state's water qualiry stadards, also called the 303(d) list. The permit as modified or reissced ander this paragraph shall also contain ay other requirements of ihe Clean Water Act then applicable. 2. All outfalls must be clearly marked in the field. 3. Changes in Discharges of Toxic Substances The pemiittee shall notify [he Director as soon as it knows or has reason [o believe: a) That any activity has occurred or will occur whieh would result in the discharge of any toxic polla[ant which is not limited in the pertnit, if ihat dischage will excced the highest of the following "notification levels:" Q) One hundred micrograms per li[er (]00 µg/L); 2) Two hundred micrograms per liter (200 µg/L) for acrolein and acrylonitrile; five hundred micrograms per liter (500 g/L) for 2,5 dinitrophenol and for 2-methyl-4, 6-dinitrophenol; and one milligram per liter (1 mg/L) for antimony; 3) Fivc (5) [imes the maximum concentration value reported for the pollutant in the permit application; 4) The leve] established in Pari A of Ihe permit by the Director. b) That [hey have begun or expect to begin to use or manufacture as an itemiediate or final product or byproduct ay toxic pollutant, which was not reported in the permit application. 4. Report as no-discharge when a discharge does not occur during the repod period. 5. Water Quality Standards a) Discharges to waters of the state shal] not causc a violation of water qualiry standards tule under 10 CSR 20-7.031, including both specific and general criteria. b) General Criteria. No wa[er contaminant, by itself or in combination with o[her substances, shall prevent the waters of the state from meeting the follo}ving conditions: I) Waters shall be free from substances in sufficient amounts to cause the fonnalion ofputrescent, unsighdy or harmful bottom deposits or prevent ful] maintenance of beneficial uses; 2) Waters shall be free from oil, scum and Floating debris in sufficient amounts o be unsightly or prevent full maintenance of beneficial uses; 3) Waters slull be frce fmm substances in sufficient amounts to cause unsightly color or htrbidity, offensive odor or prevent full mainfenance of beneficial uses; 4) Waters shall ba free from substances or couditions in sufficient amounts to resalt in toxicity to haman, animal or aquatic ]ife; 5) There shal] be no significant human health hazard from incidental contact with the wa'ter; 6) There shall be no acu[e toxicity to livestock or wildlife watering; 7) Waters shall be free from physical, chemical or hydrologic changes that would impair the natural biological community; 8) Waters shall be free from used tires, car bodies, appliances, demolition debris, used vehicles or equipment and solid waste as defined in Missouri's Solid Waste Law, section 26020Q RSMq except as the use of such materials is specifically permi[ted pursuan[ [o section 260.200-260247. 6. The permittee shall comply with any appliwble reqnirements fisted in 0 CSR 20-9, unless the facility has received written notification that ihe Department has approved a modification to ihe requirements. The monitoring frequencies contained in this permit shall ot be cons[rued by the permittee as a modification of Ihe moniroring frequencies ]isted in 10 CSR 20-9. If a modification of the monioring frequencies listed in 10 CSR 20-9 is ceeded, the permitee shall submit a written request to the department for review and, if deemed necessary, approval. SPECIAL CONDITIONS (wntinuedl Z The permittee shell implement and enforce its approved pretreatment program in accordance with the requiremets of 40 CFR Part 403. The approved pretreatment program is hereby incorporated by reference. The permittee shall submit to the Department on or before September 30 of each year a report briefly describing itspretrea[ment activities during the previous calendar yeac At a minimum, the report shall include the following: a) An updated list of the Pennittee's Industrial Users, inclading their names and addresses, or a list of deletions and additions keyed to a previously submitted list. 7he Pemiittcc shall provide a brief explanation of cach deletion. This list shall identify which Industria] Users are subject to eategorieal pretreatment Standards and specify which Standards are applicablc to eacl Induslrial User. The list shall indicate which Industrial Users are subject to local standards that are more stringent than the categorical Pretreahnent Standards. However, in-stream monitoring is not necessary at Ihis time, as the facility is subject to E. co/i effluent limitations intended to be protective of receiving stream water quality. Coldwater Creek is a class C, Meaopolitan No-Discharge stream with designated uses of aquatic life, livestock and wildlife wateriog industrial and boating. TSS monthly average effluent limits were exceeded for the monihs of February 2006 and March 2008. Effluent from Outfall #005 violated pH limits on 9 June 2005. Settleable Solids exceeded daily maximum effluent limits on 18 October 2007 and 23 October 2008. Setticable solids exceedcd montlily average effluent limits durig the months oCOctober 2007 and Ocrober 2008. Oi1 and grease effluent limits were violated for daily maximum on 12 January 2007 and monthly average for the month of January 2007. A SSOs is defined as an untreated or partially treated sewage release from a SSS. SSOs can occur at any point in an SSS, during dry weather or wet weather.
