Other emission units at this facility include pipeline natural gas fueled boilers, an emergency generator, water heaters, a parts washer, fuel storage tanks, paint spray booths and a sand blaster. The installation emits major levels of carbon monoxide (CO) and has the Potential to Emit (PTE) major amounts of nitrogen dioxide (NOx). Sand Blaster EMISSION UNITS WITHOUT LIMITATIONS The following list provides a description of the equipment that does not have unit specific limitations at the time of permit issuance. Lemay Wastewater Treatment Plant Project No. 1998-07-071 II. Plant Wide Emission Limitations 5 The installation shall comply with each of the following emission limitations. Consult the appropliate sections in the Code of Federal Regulations (CFR) and Code of State Regulations (CSR) for the full text of the applicable requirements. Permit Condition PWOO I • lO CSR 10-6.080 Emission Standards for Hazardous Air Pollutants • 40 CFR Part 61 Subpart M National Emission Standard for Asbestos Emission Limitation: The pennittee shall follow the procedures and requirements of 40 CFR Part 61, Subpart M for any actiVities occuning at this installation which would be subject to proVisions for 40 CFR Part 61, Subpart M. National Emission Standard for Asbestos. Monitoring: Any appropriate monitming to demonstrate compliance With registration, certification, notification, and Abatement Procedures and Practices standards as specified in 40 CFR Part 61, Sub~art M. Record keeping: Any appropriate record keepin~ as specified in 40 CFR Part 61, Subpart M. Reporting: Any appropriate reportin~ as SIJ_ecified in 40 CFR Part 61. Subpart M. Permit Condition PW002 • 10 CSR 10-6.250 Asbestos Abatement Projects -Certification, Accreditation, and Business Exemption Requirements Emission Limitation: The permittee shall conduct all asbestos abatement projects within the procedures established for certification and accreditation by 10 CSR 10-6.250. • An indiVidual must receive certification from the department before that IndiVidual participates in an asbestos abatement project operating in Missouri according to Section (3). This certification is annually renewable. Certification as an AHERA inspector, AHERA management planner and AHERA project designer apply to AHERA-related projects. • To be a training proVider for the purpose of this rule a school shall apply for accreditation to the department and comply with the United States Environmental Protection Agency AHERA Model Accreditation plan 40 CFR part 763 Appendix C, subpart E. Details of the requirements for accreditation are found in Section (4). Monitoring: Any appropriate monitoring to demonstrate compliance With Certification and Accreditation standards. Record keeping: Any appropriate record keeping to demonstrate compliance With Certification and Accreditation standards. Reporiing: Any appropriate reporting to demonstrate compliance With Certification and Accreditation standards. Lemay Wastewater TrL-cment Plant Project No. 1998-07-071 6 Permit Condition PW003 • 10 CSR 10-5.090 and 10 CSR 10-6.220 Restriction of Emission of Visible Air Contaminants Emission Limitation: No person may discharge into the ambient air from any single new source of emission whatsoever, any air contaminant: • Of a shade or density equal to or darker than that designated as No. 1 on the Ringlemann chart or 20% opacity. • Exception: A person may discharge into the atmosphere from any single source of emissions for a period(s) aggregating not more than six (6) minutes in any sixty (60) minutes air contaminants of a shade or density not darker than No. 2 on the Ringlemann Chart or 40% opacity. This rule applies to emissions from Stack No. I only when Incinerator No. 4 is not online. Monitoring: • The permittee shall conduct opacity measurements on this emission unit using the procedures contained in USEPA Test Method 22. Readings are only required when the emission unit is operating and when the weather conditions allow. If no Visible or other significant emissions were observed, then no further observations would be required at that reading. For emission units with Visible emissions perceived or believed to exceed the applicable opacity standard, the source representative would then conduct a Method 9 observation. • The following monitoring schedule must be maintained: 1. Weekly observations shall be conducted for a minimum of eight (8) consecutive weeks after permit issuance. Should no Violation of this regulation be observed during this period then- 2. Observations must be made once evecy two weeks for a period of eight [8) weeks. If a Violation is noted, monitoring reverts to weekly. Should no Violation of this regulation be observed during this period then- 3. Observations must be made once per month. If a Violation is noted, monitoring reverts to weekly. • If the source reverts to weekly monitoring at any time, monitoring frequency will progress in an identical manner from the initial monitoring frequency. • The ~rmittee shall conduct an annual opacity measurement on the emission unit by USEPA Test ethod 9 with a certtfied Method 9 observer. Record keeping: • The permittee shall maintain records of all observation using Attachment A or another form proViding equivalent information noting: l. Whether any air emissions (except for water vapor) were Visible from the emission units, 2. All emission units from which Visible emissions occurred, and 3. Whether the Visible emissions were normal for the process. • The permittee shall maintain records of any equipment malfunctions that cause a Violation of this permit condition. • The permittee shall maintain records of the annual USEPA Method 9 opacity test and any other Method 9 test performed in accordance with this permit condition. • All records will be retained for a minimum of 60 consecutive months . Reporting: The permittee shall report to the Air Pollution Control Section of the SLCDOH, Ill South Meramec, Clayton, MO 63105 and to the Air Pollution Control Enforcement Section, P.O. Box 176, Jefferson City, MO 65102, no later than 15 days after any exceedance of the opacity limit established by 10 CSR 10-5.090 or 10 CSR 10-6.220, based upon any USEPA Method 9 Visual Observations or any malfunction that causes an opacity exceedance. 10 CSR 10-6.220 is a State-only rule. 10 CSR 10-5.090 expires and 10-6.220 becomes federally enforceable when 10-6.220 is ap-proved for the State Implementation Plan Lemay Wastewater Treatment Plant Project No. 1998-07-071 Permit Condition PW004 • lO CSR 10-5.290 7 More Restrictive Emission Limitations for Particulate Matter in the South St. Louis Area Emission Limitation: • No person may cause or permit the handling, transporting, or storage of any material in a manner which allows particulate matter to become airborne in quantities and concentrations that-!) it remains visible in the ambient air beyond the premises where it originates or 2) its presence may be found beyond the premises where it oliginates and it is larger than forty (40) microns in size. The size of the particulate matter shall be determined by microscopy or any other technique proven to be equally accurate. • No person may cause or permit a building or its appurtenances, a road, a driveway, a parking lot. or an open area to be constructed, used, repaired, or demolished without applying all reasonable measures as may be required to prevent particulate matter from becoming airborne. The director may require a person owning, operating, or otherwise in control of the building, appurtenance. road, driveway, parking lot, or open area to take reasonable measures as may be necessary to prevent particulate matter from becoming airborne including, but not limited to. paving or frequent cleaning of roads. driveways, and parking Jots. application of dust-free surfaces, application of water. and the planting and maintenance of vegetative ground cover or buffer zones. • No person may emit into the ambient air from any air contaminant source fugitive emissions greater than that which would be emitted after application of all reasonably available control technologies and all reasonable maintenance of plant and equipment. Monitoring: The permittee shall conduct inspections of its installation sufficient to determine compliance with this regulation. If a violation of this regulation is discovered, the source shall undertake corrective action to eliminate the violation. The following monitoring schedule must be maintained: Weekly observations shall be conducted for a minimum of eight (8) consecutive weeks after permit issuance. Should no violation of this regulation be observed during this period then- • Observations must be made once every two weeks for a period of eight (8) weeks. If a violation is noted, monitoling reverts to weekly. Should no violation of this regulation be observed during this peliod, then- • Observations need be done no more often than once per month. If a violation is noted. monitonng reverts to weekly. If the source reverts to weekly monitoring at any time. monitoring frequency will progress in an identical manner to the initial monitoring freguency. Record keeping: A Jog must be maintained noting the following: • Whether air emissions ( except water vapor) remain visible in the ambient air beyond the property line of oligin. • Whether the visible emissions were normal for the installation. • Equipment malfunctions that could cause an exceedance of 10 CSR 10-5.290. • Any violation of 10 CSR 10-5.290 and any corrective actions taken to correct the violation Attachment B contains a log including these record keeping requirements. This log. or an equivalent created by the permittee. must be used to certifY compliance with this requirement. All records must be maintained for a minimum of 60 consecutive months. Lemay Wastewater Tre~-ment Plant Project No. 1998-07-071 8 Reporting: 0 The pennittee shall report to the Air Pollution Control Section of the SLCDOH, Ill South Meramec, Clayton, MO 63105 and to the Air Pollution Control Enforcement Section, P.O. Box l 76. Jefferson City, MO 65 I 02, no later than 15 days after any exceedance of any of the terms imposed by this regulation, or any malfunction that causes an exceedance of this regulation. Permit Condition PW005 10 CSR 10-5.250 Time Schedule for Compliance Emission Limitation: Except as otherwise specified, all new installations shall comply with regulations as of going into operation. Monitoring: NONE Record keeping: NONE Reporting: NONE Permit Condition PW006 0 10 CSR 10-5.443 Control of Gasoline Reid Vapor Pressure Emission Limitation: No person shall sell, dispense, supply, offer for sale, offer for supply, transport, or exchange in trade for use gasoline intended for final use in the applicable areas that exceeds the Reid Vapor Pressure (RVP) limit as follows: 7.0 psi or less from June 1 through September 15. Gasoline blends having at least nine percent (9%) but not more than ten percent (10%) ethyl alcohol by volume of the blended mtxture shall have an RVP limit of one pound per square inch {psi) higher than the above limit. Monitoring: NONE Record keeping: The pennittee shall maintain records of each bill of lading, invoice, loading ticket. delivery ticket, and other documents accompanying a shipment of gasoline during the period from June l through September 15 for at least 60 months after the date of delivery. These records shall be made available immediately for inspection to St. Louis County Department of Health personnel upon request. The director may require additional recordkeeping on a case-by- case basis. Reporting: NONE Permit Condition PW007 • 10 CSR 10-5.040 Use of Hand-fired Equipment Prohibited Emission Limitation: The p_ennittee shall not operate any_ hand-fired fuel burning equipment. Monitoring: None. Record keepinq: Lemay Wastewater Treatment Plant Project No. 1998-07-071 None. ReoamnG: The permittee shall report to the Air Pollution Control Section of the SLCDOH, lll South 9 Meramec, Clayton, MO 63105 and to the Air Pollution Control Enforcement Section, P.O. Box l 76, Jefferson City, MO 65102. no later than 15 days after a violation of any of the terms imposed by this regulation. Permit Condition PW008 • 10 CSR 10-6.260(4) Restriction of Emission of Sulfur ComDounds Emission Limitation: No person shall cause or permit the emission of sulfur compounds from any source which causes or contJibutes to concentrations exceeding those specified in 10 CSR 10-6.010 Ambient Air Qualitv Standards. Monitoring: Compliance shall be determined by source testing as specified 10 CSR 10-6.040 for measuring ambient sulfur compound concentrations. (Ambient air modeling submitted with permit application shows compliance for the entire facility with National Ambient Air Quality Standards for both hvdrogen sulfide and sulfur dioxide.) Record keeping: The permittee shall retain the results of the Ambient Air Modeling showing compliance with this regulation. Emission Unit Specific Emission Limitations The installation shall comply with each of the folloWing emission limitations. Consult the appropriate sections in the Code of Federal Regulations (CFR) and Code of State Regulations (CSR) for the full text of the applicable requirements. EUOOIO 3 Multiple Hearth Incinerators General Description: Multiple Hearth Incinerator #1: tested at 2.45 tons/hour dry sludge, Multiple Hearih Incinerator #2; tested at 2. 74 tons/hour dry sludge Multiple Hearih Incinerator #3; tested at 2.17 tons/hour dry sludge Each, with an afterburner and venturi and impingement scrubbers. Permit Condition EU0090-00 1 • 10 CSR 10-5.300 Control of Emissions From Solvent Metal Cleanine: Emission Limitation: • No owner or operator shall allow the operation of any cold cleaner using a cold cleaning solvent with a vapor pressure greater than 2.0 millimeters of Mercucy (mmHg) [0.038 pounds per square inch (psi)] at twenty degrees Celsius (20°C) [sixty-eight degrees Fahrenheit (68°F)] unless the cold cleaner is used for carburetor cleaning. After Aprtl I. 200 1, no owner or operator shall allow the operation of any cold cleaner using a cold cleaning solvent with a vapor pressure greater than 1.0 mmHg (0.019 psi) at 20°C (68°F) unless the cold cleaner is used for carburetor cleaning. (Note: The MSDS for solvent used in this emission unit lists the vapor pressure as 0.391 mmHg at 68°F and 2.0 mmHg at l00°F.) • Each cold cleaner shall have a cover which will prevent the escape of solvent vapors from the solvent bath while in the closed position or an enclosed reservoir which will limit the escape of solvent vapors from the solvent bath whenever parts are not being processed in the cleaner. • Each cold cleaner shall have a drainage facility, which will be internal, so that parts are enclosed under the cover while draining. If an internal drainage facility cannot fit into the cleaning system and the solvent volatility is less than 0.6 psi measured at I00°F, then the cold cleaner shall have an external drainage facility which provides for the solvent to drain back into the solvent bath. • Solvent sprays, if used, shall be a solid fluid stream (not a fine. atomized, or shower-type spray) and at a pressure which does not cause splashing above or beyond the freeboard. (Note: While a spray is not currently used at this facility, this paragraph would apply if such a spray were used in the future.) • A permanent conspicuous label summarizing the operating procedures shall be affiXed to the equipment. • Cold cleaner covers shall be closed whenever parts are not being handled in the cleaners or the solvent must drain into an enclosed reservoir. • Cleaned parts shall be drained in the freeboard area for at least fifteen seconds or until dripping ceases, whichever is longer. • Whenever a cold cleaner fails to perform within the operating parameters established for it by this rule, the unit shall be shut down immediately and secured. It shall remain shut down until trained service personnel are able to restore operation within the established parameters. Solvent leaks shall be repaired immediately or the degreaser will be shut down and the leaks secured until they can be more permanently repaired. Lemay Wastewater Treatment Plant Project No. 1998-07-071 21 Any waste matertal removed from a cold cleaner shall be disposed of by one of the following methods or equivalent (after Director approval) and tn accordance with 10 CSR 25, as applicable. Either reduction of the waste material to Jess than twen1y percent VOC solvent by distillation and disposal of the still bottom waste: or storage tn closed contatners for transfer to a contract reclamation service or a disposal facility approved by ihe Director. Monitoring: None. Record keeping: • The permittee shall matntatn monthly tnventory records of solvent tnventory 1ypes and amounts purchased and solvent consumption. These records shall tnclude all1ypes and amounts of solvent contatning waste material transferred to either a contract reclamation service or to a disposal facility and all amounts distilled on the premises. Core Permit Requirements 23 The installation shall comply with each of the following emission limitations. Consult the appropriate sections in the Code of Federal Regulations (CFR) and Code of State Regulations (CSR) for the full text of the applicable requirements. 10 CSR 10-6.050. Start-up, Shutdown and Malfunction Conditions The permittee shall submit the following information to the director not later than fifteen (15) days after receipt of the notice of excess emissions excess emissions. (a.) Name and location of installation; (b.) Name and telephone number of person responsible for the installation; (c.) The identity of the equipment causing the excess emissions; (d.) The time and duration of the period of excess emissions; (e.) The cause of the excess emissions; (f.) The type of air contaminant involved; (g.) A best estimate of the magnitude of the excess emissions expressed in the units of the applicable emission control regulation and the operating data and calculations used in estimating the magnitude; (h.) The measures taken to mitigate the extent and duration of the excess emissions; and (i.) The measures taken to remedy the situation which caused the excess emissions and the measures taken or planned to prevent the recurrence of these situations. 10 CSR 10-6.060, Construction Permits Required The permittee shall not commence construction, modification, or major modification of any installation subject to this rule, begin operation after that construction, modification, or major modification, or begin operation of any installation which has been shut down longer than five (5) years without first obtaining a permit from the permitting authority. 10 CSR 10-6.065, Operating Permits The permittee shall ille for renewal of this operating permit no sooner than eighteen months, nor later than six months, prior to the expiration date of this operating permit. The permittee shall retain the most current operating permit issued to this installation on-site and shall immediately make such permit available to any St. Louis County Department of Health personnel upon request. 10 CSR 10-6.110, Submission of Emission Data, Emission Fees and Process Information The permittee shall complete and submit an Emission Inventory Questionnaire (EIQ) in accordance with the requirements outlined in this rule. Lemay Wastewater Trea.cment Plant Project No. 1998-07-071 10 CSR 10-6.130, Controlling Emissions During Episodes o(High Air Pollution Potential 24 This rule specifies the conditions that establish an air pollution alert (yellow/red), watch or emergency and the associated procedures and emissions reduction objectives for dealing with each. The permittee shall submit an appropriate emergency plan if required by the Director. 10 CSR 10-6.150, Circumvention The permittee shall not cause or pennit the installation or use of any device or any other means which, without resulting in reduction in the total amount of air contaminant emitted, conceals or dilutes an emission or air contaminant which violates a rule of the Missouri Air Conservation Commission. 10 CSR 10-6.180, Measurement o(Emissions o(Air Contaminants (a.) The director may require any person responsible for the source of emission of air contaminants to make or have made tests to determine the quantity or nature, or both, of emission of air contaminants from the source. The director may specify testing methods to be used in accordance with good professional practice. The director may observe the testing. All tests shall be performed by qualified personnel. (b.) The director may conduct tests of emissions of air contaminants from any source. Upon request of the director, the person responsible for the source to be tested shall provide necessary ports in stacks or ducts and other safe and proper sampling and testing facilities, exclusive of instruments and sensing devices as may be necessary for proper determination of the emission of air contaminants. (c.) The director shall be given a copy of the test results in writing and signed by the person responsible for the tests. 10 CSR 10-5.070, Open Burning Restrictions (a.) The permittee shall not conduct, cause, permit or allow a salvage operation, the disposal of trade wastes or burning of refuse by open buming. (b.) Exception-Open burning of vegetation may be permitted only when it can be shown that open burning is the only feasible method of disposal or an emergency exists that requires open burning. (c.) Any person intending to engage in open burning shall file a request to do so with the director. The request shall include the following: (1.) The name, address and telephone number of the person submitting the application; The type of business or activity involved; A description of the proposed open burning operations, including the type, quantity and composition of vegetation to be bumed; (2.) The schedule ofbuming operations; (3.) The exact location where open burning will be used to dispose of the vegetation; (4.) Reasons why no method other than open burning is feasible; and Lemay Wastewater Treatment Plant Project No. 1998-07-071 25 (5.) Evidence that the proposed open buming has been approved by the fire control authority which has jurisdiction. (d.) Upon approval of the open burning permit application by the director, the person may proceed with the operation under the terms of the open buming permit. Be aware that such approval shall not exempt Lemay Treatment Plant from the provisions of any other law, ordinance or regulation. (e.) The permittee shall maintain flies with letters from the director approving the open burning operation and previous SLCDOH inspection reports. 10 CSR 10-5.160, Restriction ofEmission of Odors No person shall emit odorous matter as to cause an objectionable odor on or adjacent to: (a.) Residential, recreational, institutional, retail sales, hotel or educational premises. (b.] Industrial premises when air containing odorous matter is diluted with twenty (20) or more volumes of odor-free air; or (c.) Premises other than those in paragraphs (1)A.l. and (2) of the rule when air containing odorous matter is diluted with four (4] or more volumes of odor-free air. The previously mentioned requirement shall apply only too objectionable odors. An odor will be deemed objectionable when thirty percent (30%) or more of a sample of the people exposed to it believe it to be objectionable in usual places of occupancy; the sample size to be at least twenty (20) people or seventy-five percent (75%) of those exposed if fewer than twenty (20) people are exposed. This requirement is not federally enforceable. 10 CSR 10-6.100, Alternate Emission Limits Proposals for altemate emission limitations shall be submitted on Altemate Emission Limits Permit forms provided by the department. An installation owner or operator must obtain an Alternate Emission Limits Permit in accordance with 10 CSR 10-6.100 before altemate emission limits may become effective. ST. LOUIS COUNTY AIR POLLUTION CONTROL CODE REQUIREMENTS The following requirements are non-Federally enforceable and are only enforced by the St. Louis County Air Pollution Control Program. The St. Louis County Air Pollution Control Code. The St. Louis County Air Pollution Control Code, Section 612.120, Permits to be Visibly Affixed or Placed (l) Emission Standards: The Permittee shall Visibly affix St. Louis County DOH Permit on or near permitted equipment. (2) Record Keeping Requirements: None. (3) Monitoring Requirements: Visuallnspection performed during periodic St. Louis County inspections. (4) Reporting Requirements: None. The St. Louis County Air Pollution Control Code, Section 612.200, Testing Prior to Granting of Operating Permit ( l) Emission Stnndards: Before an authority to construct or permit to operate is granted, the Director may require the applicant to conduct tests to determine the kind or amount of the air contaminant emitted from the equipment. Such tests shall be conducted, reviewed and certified by a licensed engineer. The permittee shall notifY the County of the time and place of testing for the purpose of witnessing the test. (2) Record Keeping Requirements: Records shall be kept during testing as approved in a test protocol submitted to the County prior to testing. (3) Monitoring Requirements: Monitoring during testing shall be as approved in a test protocol submitted to the County prior to testing. (4) Reporting Requirements: The permittee shall report to the Air Pollution Control Section of the SLCDOH, Ill South Meramec, Clayton, MO 63105. no later than ten ( l 0) days after any exceedance of any of the terms imposed by this regulation. or any condition which could possibly cause an exceedance of this regulation. The St. Louis County Air Pollution Control Code, Section 612.280, Testing by Order of the Board (1) Emission Standards: If any article, machine, equipment or other contrtvance is in violation of The St. Louis County Air Pollution Control Code, the Director may file with the Board for its approval an order directing the permittee of such equipment to conduct such tests as are necessary in the opinion of the Director and approved by the Board to determine whether the equipment is in violation of this Code. (2) Record Keeping Requirements: None. (3) Monitoring Requirements: The entire test results shall be reviewed and certified by an engineer licensed under Chapter 327, R.S.Mo 1959. The engineer shall be selected by the permittee and approved by the Board. (4) Reporting Requirements: The permittee shall give at least seven (7) days notice prtor to the commencement of the test. The permittee shall report to the Air Pollution Control Section of the SLCDOH, 111 South Meramec, Clayton, MO 63105. The St. Louis County Air Pollution Control Code, Section 612.290. Right of Entry; Inspections; Samples (1) Emission Standards: The Permittee shall allow the Director or His agent to enter at all times with reasonable notice. inspect any equipment, control apparatus, fuel. matter or things which affect or may affect the emission of air contaminants. inspect any records relating to the use of any equipment or control apparatus which affect or may affect the emission of air contaminants, and sample any equipment, control apparatus. fuel, matter or things which affect or may affect the emission of air contaminants. (2) Record Keeping Requirements: None. (3) Monitoring Requirements: None. (4) Reporting Requirements: None. Lemay Wastewater Trehcment Plant Project No. 1998-07-071 28 The St. Louis County Air Pollution Control Code, Section 612.310, Upset Conditions, Breakdown or Scheduled Maintenance (l) Emission Standards: None. (4} Reporting Requirements: The permittee shall report to the Air Pollution Control Section of the SLCDOH, Ill South Meramec, Clayton, MO 63105 within 24 hours of occurrence of any unavoidable upset in or breakdown of equipment and in case of shutdown for necessary scheduled maintenance, the intent to be shutdown shall be reported to Air Pollution Control Section 24 hours prior to shutdown. The St. Louis County Air Pollution Control Code, Section 612.340, Air Pollution Nuisances Prohibited (I} Emission Standards: It is unlawful for the Permittee to cause of such quantities of soot, cinders, noxious acids, fumes and gases or other particulate matter from whatever source in such place or matter as to be detrimental to any person or the public or to endanger the health, comfort and safety of any person or the public, injury or damage to property or business. (2} Record Keeping Requirements: None. (3} Monitoring Requirements: None. (4} Reporting Requirements: None. The St. Louis County Air Pollution Control Code, Section 612.380, Interfering with or Obstructing Division Personnel (1) Emission Standards: No Person shall hinder, resist, interfere with or obstruct the Director or any Division employee in carrying out any duty for the Director or the Board. (2} Record Keeping Requirements: None. (3) Monitoring Requirements: None. (4) Reporting Requirements: None. The above requirements are non-Federally enforceable and are only enforced by the St. Louis County Air Pollution Control Program. Lemay Wastewater Treatment Plant Project No. 1998-07-071 V. General Permit Requirements Permit Duration 10 CSR l0-6.065(6)[C) LB. 29 This pennit is issued for a term of five (5) years, commencing on the date of issuance. This permit will expire at the end of this period unless renewed. General Record Keeping and Reporting Requirements 10 CSR 10-6.065(6)(C)l.C I) Record Keeping A) All required monitoring data and support information shall be retained for a period of at least five (5) years from the date of the monitoring sample, measurement, report or application. B) Copies of all current operating and construction pennits issued to this installation shall be kept on-site for as long as the pennits are in effect. Copies of these pennits shall be made immediately available to any St. Louis County Department of Health personnel upon request. II) Reporting A) The pennittee shall submit a report of all required monitoring by: I) October lst for monitoring which covers the January through June time period, and 2) April lst for monitoring which covers the July through December time period. 3) Exception: Monitoring requirements which require reporting more frequently than semi annually shall report no later than 30 days after the end of the calendar quarter in which the measurements were taken. B) Each report must identifY any deviations from emission limitations, monitoring, record keeping, reporting, or any other requirements of the pennit. C) All reports shall be submitted to the Air Pollution Control Section of the SLCDOH, Ill South Meramec, Clayton, MO 63105 and to the APCP Enforcement Section, P.O. Box 176, Jefferson City, MO 65102. D) Submit supplemental reports as required or as needed. Supplemental reports are required no later than fifteen (15) days after any exceedance of any applicable rule, regulation or other restriction. All reports of deviations shall identifY the cause or probable cause of the deviations and any corrective actions or preventative measeres taken. 1) Notice of any deviation resulting from an emergency (or upset) condition as defined in paragraph (6J(C)7 of 10 CSR 10-6.065 (Emergency Provisions) shall be submitted to the pennitting authority either verbally or in writing within two (2) working days after the date on which the emission limitation is exceeded due to the emergency, if you wish to assert an affmnative defense. The affirmative defense of emergency shall be demonstrated through properly signed, contemporaneous operating logs, or other relevant evidence that indicate an emergency occurred and that you can identify the cause(s) of the emergency. The permitted installation must show that it was operated properly at the time and that during the period of the emergency the pennittee took all reasonable steps to minimize levels of emissions that exceeded the emission standards or · Lemay WastewaterTreuLIIlent Plant Project No. 1998-07-071 requirements in the pennit. The notice must contain a description of the emergency, the steps taken to mitigate emissions, and the corrective actions taken. 30 2) Any deviation that poses an imminent and substantial danger to public health, safety or the environment shall be reported as soon as practicable. 3) Any other deviations identified in the permit as requiring more frequent reporting than the pennittee's semiannual report shall be reported on the schedule specified in the permit. E) Every report submitted shall be certified by the responsible official, except that, if a report of a deviation must be submitted within fifteen (15) days after the deviation, the report may be submitted without a certification if the report is resubmitted with an appropriate certification within ten (10) days after that, together with any corrected or supplemental information required concerning the deviation. F) The pennittee may request confidential treatment of information submitted in any report of deviation. G) These supplemental reports shall be submitted to the Air Pollution Control Section of the SLCDOH, 111 South Meramec, Clayton, MO 63105 and the APCP Enforcement Section, P.O. Box 176, Jefferson City, MO 65102, no later than fifteen (15) days after any exceedance of any applicable rule, regulation, or other restriction. Risk Management Plans Under Section 112(r) 10 CSR 10-6.065(6)(C) l.D. The pennittee shall comply with the requirements of 40 CFR Part 68, Accidental Release Prevention Requirements. If the permittee has more than a threshold quantity of a regulated substance in process, as determined by 40 CFR Section 68.115, the permittee shall submit a Risk Management Plan in accordance with 40 CFR Part 68 no later than the latest of the following dates: 1) June 21, 1999; 2) Three (3) years after the date on which a regulated substance is first listed under 40 CFR Section 68.130; or 3) The date on which a regulated substance is first present above a threshold quantity in a process. Severability Clause 10 CSR 10-6.065(6)(C)l.F. In the event of a successful challenge to any part of this permit, all uncontested permit conditions shall continue to be in force. General Requirements 10 CSR 10-6.065(6J(C) l.G 1) The pennittee must comply with all of the terms and conditions of this pennit. Any noncompliance with a permit condition constitutes a violation and is grounds for enforcement action, permit termination, permit revocation andre-issuance, permit modification or denial of a permit renewal application. Lemay Wastewater Trearment Plant Project No. 1998-07-071 31 2) The permittee may not use as a defense in an enforcement action that it would have been necessary for the permittee to halt or reduce the permitted activity in order to maintain compliance with the conditions of the permit. 3) The permit may be modified. revoked, reopened, reissued or terminated for cause. Except as provided for minor permit modifications, the filing of an application or request for a permit modification. revocation andre-issuance, or termination, or the filing of a notification of planned changes or anticipated noncompliance, will not stay any permit condition. 4) Tills permit does not convey any property rights of any sort, nor grant any exclusive privilege. 5) The permittee shall furnish to the St. Louis County Department of Health, upon receipt of a written request and within a reasonable time, any information that the St. Louis County Department of Health reasonably may require to determine whether cause exists for modifying, reopening, reissuing or revoking the permit or to determine compliance with the permit. Upon request, the permittee also shall furnish to the St. Louis County Department of Health copies of records required to be kept by the permittee. The permittee may make a claim of confidentiality for any information or records submitted pursuant to 10 CSR l0-6.065(6)(C)l. No permit revision will be required for any installation changes made under any approved economic incentive, marketable permit, emissions trading, or other similar programs or processes provided for in this permit. Compliance Requirements 10 CSR l0-6.065(6)(C)3. I) Any document (including reports) required to be submitted under this permit shall contain a certification signed by the responsible official. II) Upon presentation of credentials and other documents as may be required by law, the permittee shall allow authorized officials of the St. Louis County Department of Health, or their authorized agents, to perform the folloWing (subject to the installation's right to seek confidential treatment of information submitted to, or obtained by, the St. Louis County Department of Health): Lemay Wastewater Trt~-ment Plant Project No. 1998-07-071 32 A) Enter upon the premises where a permitted installation is located or an emissions- related activity is conducted, or where records must be kept under the conditions of this permit; B) Have access to and copy, at reasonable times, any records that must be kept under the conditions of this permit; C) Inspect, at reasonable times and using reasonable safety practices, any facilities, equipment (including monitoring and air pollution control equipment), practices, or operations regulated or required under this permit; and D) As authorized by the Missouri Air ConseiVation Law, Chapter 643, RSMo or the Act, sample or monitor, at reasonable times, substances or parameters for the purpose of assuring compliance with the terms of this permit, and all applicable requirements as outlined in this permit. III) All progress reports required under an applicable schedule of compliance shall be submitted semiannually (or more frequently if specified in the applicable requirement). These progress reports shall contain the following; A) Dates for achieving the activities, milestones or compliance required in the schedule of compliance, and dates when these activities, milestones or compliance were achieved, and B) An explanation of why any dates in the schedule of compliance were not or will not be met, and any preventative or corrective measures adopted. IV) The permittee shall submit an annual certification that it is in compliance with all of the federally enforceable terms and conditions contained in this permit, including emissions limitations, standards, or work practices. These certifications shall be submitted annually unless the applicable requirement specifies more frequent submission. The compliance certification shall include the following: A) The identification of each term or condition of the permit that is the basis of the certification, B) The current compliance status, as shown by monitoring data and other information reasonably available to the installation, C) Whether compliance was continuous or intermittent, D) The method(s) used for determining the compliance status of the installation, both currently and over the reporting period, and E) Such other facts as the St. Louis County Department of Health will require in order to determine the compliance status of this installation. Permit Shield 10 CSR 10-6.065(6)(C)6. I) Compliance with the conditions of this permit shall be deemed compliance with all applicable requirements as of the date that this permit is issued, provided that: A) The applicable requirements are included and specifically identified in this permit; or B) The permitting authority, in acting on the permit revision or permit application, determines in writing that other requirements, as specifically identified in the permit, are not applicable to the installation, and this permit expressly includes that determination or a concise summcuy of it. II) Be aware that there are exceptions to this permit protection. The permit shield does not affect the following: Lemay Wastewater Treaunent Plant Project No. 1998-07-071 A) The provisions of section 303 of the Act or section 643.090. RSMo concerning emergency orders, 33 B) Liability for any violation of an applicable requirement which occurred prior to, or was existing at, the time of permit issuance, C) The applicable requirements of the acid rain program, D) The administrator's authority to obtain information, or E) Any other permit or extra-permit provisions, terms or conditions expressly excluded from the permit shield provisions. Emergency Provisions 10 CSR 10-6.065(6)(C)7. I) An emergency or upset as defined in 10 CSR 10-6.065(6)(C)7. shall constitute an affirmative defense to an enforcement action brought for noncompliance with technology-based emissions limitations. To establish an emergency-or upset-based defense, you must demonstrate, through properly signed, contemporaneous operating logs or other relevant evidence, the following: A) That an emergency or upset occurred and that you can identifY the source of the emergency or upset, B) That the installation was being operated properly, C) That you took all reasonable steps to minimize emissions that exceeded technology- based emissions limitations or requirements in this permit, and D) That you submitted notice of the emergency to the St. Louis County Department of Health within two (2) working days of the time when emission limitations were exceeded due to the emergency. This notice must contain a description of the emergency, any steps taken to mitigate emissions. and any corrective actions taken. II) Be aware that an emergency or upset shall not include noncompliance caused by improperly designed equipment, lack of preventative maintenance, careless or improper operation, or operator error. Operational Flexibility 10 CSR 10-6.065(6)(C)8. An installation that has been issued a Part 70 operating permit is not required to apply for or obtain a permit revision in order to make any of the changes to the permitted installation described below if the changes are not Title I modifications, the changes do not cause emissions to exceed emissions allowable under the permit, and the changes do not result in the emission of any a1r contaminant not previously emitted. The permittee shall notifY the St. Louis County Department of Health and the Administrator at least seven (7) days in advance of these changes, except as allowed for emergency or upset conditions. Emissions allowable under the permit means a federally enforceable permit term or condition determined at issuance to be required by an applicable requirement that established an emissions limit (including a work practice standard) or a federally enforceable emissions cap that the source has assumed to avoid an applicable requirement to which the source would otherwise be subject. I) Section 502(b)(l0) changes. Changes that, under section 502(b)(l0) of the Act, contravene an express permit term may be made without a permit revision, except for changes that would violate applicable requirements of the Act or contravene federally Lemay Wastewater Trea.LIIlent Plant Project No. 1998-07-071 34 enforceable monitoring (including test methods), record keeping, reporting or compliance requirements of the permit. A) Before making a change under this provision, The permittee shall provide advance written notice to the St. Louis County Department of Health and to the Administrator, describing the changes to be made, the date on which the change will occur, and any changes in emission and any permit terms and conditions that are affected. The permittee shall maintain a copy of the notice with the permit, and this agency shall place a copy with the permit in the public file. Written notice shall be provided to the administrator and this agency at least seven (7) days before the change is to be made. If less than seven (7) days notice is provided because of a need to respond more quickly to these unanticipated conditions, The permittee shall provide notice to the administrator and the permitting authority as soon as possible after learning of the need to make the change. B) The permit shield shall not apply to these changes. Off-Permit Changes 10 CSR l0-6.065(6)(C)9. I) Except as noted below. The permittee may make any change in its permitted operations. activities or emissions that is not addressed in. constrained by or prohibited by this permit without obtaining a permit revision. Insignificant activities listed in the application, but not otherwise addressed in or prohibited by this permit, shall not be considered to be constrained by this permit for purposes of the off-permit provisions of this section. Off-permit changes shall be subject to the folloWing requirements and restrictions: A) The change must meet all applicable requirements of the Act and may not violate any existing permit term or condition: The permittee may not change a permitted installation without a permit revision. if this change is subject to any requirements under Title IV of the Act or is a Title I modification: B) The permittee must provide written notice of the change to the permitting authority and to the administrator no later than the next annual emissions report. This notice shall not be required for changes that are insignificant activities under paragraph (6)(B)3. of this rule. This written notice shall describe each change. including the date. any change in emissions. pollutants emitted and any applicable requirement that would apply as a result of the change. C) The permittee shall keep a record describing all changes made at the installation that result in emissions of a regulated air pollutant subject to an applicable requirement and the emissions resulting from these changes: and D) The permit shield shall not apply to these changes. Responsible Official 10 CSR l0-6.020(2)(R)l2. The application utilized in the preparation of this was signed by Neil F. Frankenberg, P.E .. Assistant Director of Wastewater. If this person terminates employment, or is reassigned different duties such that a different person becomes the responsible person to represent and bind the installation in environmental permitting affairs, the owner or operator of this air contaminant source shall notify the Director of the St. Louis County Departrnent of Health Air Pollution Control Section of the change. The notification shall include the name and title of the new person assigned by the source owner or operator to represent and bind the installation in environmental permitting affairs. All representations, agreement to terms and conditions and covenants made by the former responsible person that were used in the establishment of limiting permit conditions on this permit will continue to be binding on the installation until such time that a revision to this permit is obtained that would change said representations, agreements and covenants. Applicable Requirements Included in the Operating Permit but Not in the Application In the operating permit application, the installation indicated they were not subject to the following regulation(s). However, in the review of the application, the agency has determined that the installation is subject to the following regulation(s) for the reasons stated. 10 CSR 10-6.180 Measurement of Emissions of Air Contaminants. Tills rule has been included in the operating permit in order to provide citing for the allowance of requests for emission data results. On past forms issued by the Air Pollution Control Program. including the application for this permit, this regulation was automatically marked as an administrative rule not required to be listed as an applicable requirement. It is no longer judged to be solely administrative and is therefore included in the operating permit. In the permit application and according to APCP records, there was no indication that any Missouri Air Conservation Law, Asbestos Abatement, 643.225 through 643.250; 10 CSR 10-6.080, Emission Standards for Hazardous Air Pollutants, Subpart M, National Standards for Asbestos; and 10 CSR 10-6.250, Asbestos Abatement Projects· Certiftcation, Accreditation, and Business Exemption Requirements were applicable to this installation. However, if they undertake any construction or demolition projects In the future, which deal with or involve any asbestos containing materials, the installation must follow all of the applicable requirements of the above rules related to that specific project. Therefore, the rules were placed in the permit. Lemay Wastewater Treatment Plant Project No. 1998-07-071 SB-2 Other Air Regulations Determined Not to Apply to the Operating Permit The Air Pollution Control Program (APCP) has determined the following requirements to not be applicable to this installation at this time for the reasons stated. 10 CSR 10-6.170, Restriction of Particulate Matter to the Ambient Air Beyond the Premises of Origin Tills rule has been replaced by the more restrictive, 10 CSR 10-5.290. The installation has reported the following emission sources as being exempt emission units per 10 CSR 10-6.065(3)(E)l. ("Combustion equipment that emits only combustion products, produces less than one hundred fifty pounds per day of any air contaminant, and with either: 1. A capacity of less than ten million British thermal units (BTUs) per hour heat input by using exclusively natural or liquefied petroleum gas, or any combination of these; or 2. A capacity of less than one million BTUs per hour heat input"): 4 Natural Gas Fired Water Heaters, 1. 76 MMBTU /hr total. Natural Gas Fired Emergency Generator, 340 hp (2.72 MMBTU/hr). The visible emissions limitation is still applicable to the engine. 10 CSR 10-6.260. Restriction of Emission of Sulfur Compounds Section (4), Restriction of Concentration of Sulfur Compounds in the Ambient Air, is applicable to the two 12.5 MMBtu/hr pipeline natural gas fired boilers, but they would never be expected to exceed the SOz emission limits. Therefore, the rule was not listed as specific for the boilers. 10 CSR 10-5.030, Maxi.mumAUowable Emission of Particulate Matter From Fuel Burning Equipment Used for Indirect Heating. The rule is applicable to the two 12.5 MMBtu boilers. However, the emissions of particulate matter (PM) from firing only pipeline natural gas would never be expected to exceed the 0.30 lb PM/hr limit. Therefore, the rule was not applied to the boilers in the permit. 10 CSR 10-5.510, Control of Emissions of Nitrogen Oxides. Tills rule is applicable to this installation since it is a major source of Nitrogen oxides. However, since the maximum rated heat input capacity for each incinerator is less than fifty (50) MMBtu/hr, there are no applicable requirements. Therefore the rule was not placed in the permit. Lemay Wastewater Treatment Plant Project No. 1998-07-071 10 CSR 10-5.520, Control ofVOC Emissions from Existing Major Sources. SB-3 Til.is rule is not applicable to this installation, as it is not a major source ofVOC emissions. Construction Permit Revisions The following revisions were made to construction permits for this installation: 1) None. NSPS Applicability NSPS Subpart 0 does not apply to EUOOIO (Incinerators #1, #2, & #3 due to their being constructed before June 11, 1973. The rule is applicable to Incinerator #4 that was constructed in 1983, NSPS Subparts K, Ka, & Kb do not apply to EU0050 due to the gasoline tanks each having a capacity of less than 40 cubic meters (10,567 gallons). NSPS Subpart De does not apply to the 2 Natural Gas Fired Boilers due to their being constructed before June 9, 1989. MACT Applicability MACT Subpart T does not apply to the parts washer (EU0070) due to the solvent not containing any of the halogenated HAP solvents listed in §63.460 (based on the MSDS for the solvent used in EU0070). NESHAP Applicability CFR Part 61, Subpart C, National Emission Standardjor Beryllium CFR Part 61, Subpart E, National Emission Standard for Mercury CFR Part 61, Subpart M, National Emission Standardjor Asbestos Other Regulatory Determinations Due to 10 CSR 10-6.070 (NSPS, Subpart 0) being applicable to EU0020 (Incinerator #4}, 10 CSR 10-5.050 (Restriction of Emission of Particulate Matter From Industrial Processes) and 10 CSR 10-5.090 and 10-6.220(Restriction of Emission of Visible Air Contaminants) were not applicable to this emission unit. In the permit application, the burning of natural gas in the incinerator afterburners (EU0010 & EU0020) was presented as an alternate operating scenario; however, according to the DNR's Operating Permit Application Instructions, based on the EPA definition of"altemate operating scenarios", they are only needed if different modes of operation would change the method of documenting compliance. Since there would be no changes to the method of demonstrating compliance for these emission units due to the above scenario, Lemay Wastewater Treatment Plant Project No. 1998-07-071 SB-4 it is not listed under Reasonably Anticipated Operating Scenarios. Also. the installation will not need to notify the St. Louis County Department of Health (SLCDOH) when the afterburners' fuel is changed to pipeline natural gas. Since both source testing (for Incinerator #2) and emissions calculations using AP-42 emission factors (for Incinerators #1, #3, & #4) demonstrate that sulfur dioxide concentrations due to sludge incineration will be minimal, no additional monitoring. recordkeeping, or reporting requirements were included in regard to 10 CSR 10-6.260 (Restriction of Emission of Sulfur Compounds) for EUOOlO and EU0020. EUOOlO and EU0020 are exempt from St. Louis County Air Pollution Control Code Sections 612.410 (Incinerators) through 612.520 (Reduction in Quantity ofWaste Prtor to Incineration) per 612.410(2)(A). Mr. Charles Wildt of the St. Louis County Department of Health stated on August 25, 1999, that this exemption continues to apply even though the original basis for the exemption, 10 CSR 10-6.190 (Sewage Sludge and Industrial Waste Incinerators), has been voided. 10 CSR 10-5.330 (Control of Emissions From Industrial Surface Coating Operations) applies to certain installations from which actual emissions of VOCs from surface coating operations are greater than 2. 5 tons in any calendar year. While the maximum potential VOC emissions from the paint spray booths (EU0060 and EU0070) are greater than 2.5 tons per year, the actual emissions are a few pounds. Therefore, CSR 10-5.330 is not applicable. 10 CSR 10-5.455 (Control of Emission from Solvent Cleanup Operations) applies to certain solvent cleanup operations at which cleaning solvent VOCs are emitted at 500 lbs/day or greater. Since the maximum potential VOC emissions from the parts washer (EU0090) is less than 500 lbs/day and cold cleaning is exempted from this rule, 10 CSR 10-5.455 is not applicable. In a conversation with Mr. Charles Wildt of the St. Louis County Department of Health on June 14, 1999, he stated that they do not require a permit to be obtained for small emission units such as the conveyors. storage tanks, etc. Thus, SLCDOH Chapter 612.110 (Permits Required) was not listed as being applicable to EU0040, EU0050, EU0060, EU0070, EUOOSO, EU0090 and EUOlOO. The terms "online" and "operating" refer to the time that sludge is being fed to an incinerator. "Ofiline" refers to that time when sludge is not being fed to the incinerators.
