AN ORDINANCE, authorizing the Executive Director on behalf of The
Metropolitan St. Louis Sewer District to execute Amendment No. 1 to the Lease Assignment to
Oakley St. Louis LLC, for certain real property of the District, as identified in said Amendment
and known and numbered as #1 Angelica Street, in the City of St. Louis, Missouri.
WHEREAS, pursuant to the Lease Assignment effective June 14, 2019, between
The Metropolitan St. Louis Sewer District, Oakley St. Louis LLC, and Lange-Stegmann Co.,
Lange-Stegmann Co. assigned its interest under the Lease to Bruce Oakley which included a Lease
Agreement dated as of June 30, 1980 as amended by Amendment #1 to Lease of June 30, 1980,
dated August 2, 1982; Amendment #2 to Lease of June 30, 1980, dated January 11, 1984;
Amendment #3 to Lease of June 30, 1980, dated June 30, 1990; Amendment #4 to Lease of June
30, 1980, dated December 18, 1992; Amendment #5 to Lease of June 30, 1980, dated February
21, 1995; Amendment #6 to Lease of June 30, 1980, dated January 24, 2002; Amendment #7 to
Lease of June 30, 1980, dated September 29, 2006; and Amendment #8 to Lease of June 30, 1980,
dated February 21, 2014 (collectively, the “Lease”), for the lease of certain real property located
in the City of St. Louis, State of Missouri.
WHEREAS, the Lease Agreement dated as of June 30, 1980 was authorized by
Ordinance No. 4131, adopted August 27, 1980; and
WHEREAS, said real property is being used by the Lessee for the purpose of
receiving, handling, bagging, storing and shipping fertilizer and urea; and
WHEREAS, the Lessee desires to lease additional property identified in
Amendment No. 1 to the Lease Assignment to Oakley St. Louis LLC.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director is hereby authorized on behalf of The
Metropolitan St. Louis Sewer District to execute Amendment No. 1 to the Lease Assignment to
Oakley St. Louis LLC, for certain real property as identified in said Amendment.
Section Two. Amendment No. 1 to the Lease Assignment to Oakley St. Louis LLC
as herein authorized shall be comprised of such other terms and conditions as are approved by the
Office of the General Counsel of the District.
The foregoing ordinance was adopted on January 14, 2021.
