HomeMy Public PortalAbout15586 Canterbury and Roland Sanitary Relief (Nelson Dr to Roland Blvd)(12110)ORDINANCE NO. 15586 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Canterbury and Roland Sanitary Relief (Nelson Dr to Roland Blvd) (12110) in the Cities of Northwoods and Pasadena Hills, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the Cities of Northwoods and Pasadena Hills, Missouri within the Bissell Watershed wherein numerous people live and work; WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Canterbury and Roland Sanitary Relief (Nelson Dr to Roland Blvd) (12110) hereinafter set forth, said easements and temporary easements being more particularly described below: Parcel #20 A VARIABLE WIDTH SEWER EASEMENT being part of Lot 11 and Lot 12 in Block 26 of “ELECTRIC HOMESITES” recorded in Plat Book 27, Pages 46 and 47 of the St. Louis County Records said tract being recorded in deed book 11619, page 2229 of the St. Louis County Records, located in the City of Northwoods, St. Louis County, Missouri, and being more particularly described as follows: BEGINNING at the Southwest corner of Lot 12 the aforementioned property described and recorded in deed book 11619, page 2229 of the St. Louis County Records; Thence along the West property line of the aforementioned tract North 29 degrees, 37 minutes, 54 seconds East a distance of 9.76 feet to a point; Thence leaving said property line South 68 degrees, 27 minutes, 05 seconds East a distance of 53.03 feet to a point in the East property line of the above aforementioned tract; Thence along the aforementioned East property line South 29 degrees, 37 minutes, 54 seconds West a distance of 17.22 feet to a point being the Southeastern corner of the above aforementioned tract; Thence along the South property line North 60 degrees, 22 minutes, 06 seconds West a distance of 52.50 feet to the Point of Beginning of the herein described A VARIABLE WIDTH SEWER EASEMENT. ALSO A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT for use during the construction of any sewer in the above described SEWER EASEMENT; said VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT being part of Lot 11 and Lot 12 in Block 26 of “ELECTRIC HOMESITES” recorded in Plat Book 27, Pages 46 and 47 of the St. Louis County Records said tract also being recorded in deed book 11619, page 2229 of the St. Louis County Records, located in the City of Northwoods, St. Louis County, Missouri, and being more particularly described as follows: COMMENCING at the Southwest corner the aforementioned property described and recorded in deed book 11619, page 2229 of the St. Louis County Records said point also being the Southwest corner of the above aforementioned Lot 12 ; Thence along the West property line of the aforementioned tract North 29 degrees, 37 minutes, 54 seconds East a distance of 9.76 feet to the True Point of Beginning of the herein described VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT; Thence continuing along the West property line North 29 degrees, 37 minutes, 54 seconds East a distance of 7.24 feet to a point; Thence leaving said property line South 68 degrees, 27 minutes, 05 seconds East a distance of 44.58 feet to a point; Thence South 60 degrees, 51 minutes, 32 seconds East a distance of 8.37 feet to a point in the East property line of the above aforementioned tract; Thence along the aforesaid East property line South 29 degrees, 37 minutes, 54 seconds West a distance of 6.12 feet to a point; Thence leaving said East property line North 68 degrees, 27 minutes, 05 seconds West a distance of 53.03 feet to the Point of Beginning of the herein described VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT. THE VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of construction. Parcel #23 A VARIABLE WIDTH SEWER EASEMENT being part of Lot 7 and Lot 8 in Block 26 of “ELECTRIC HOMESITES” recorded in Plat Book 27, Pages 46 and 47 of the St. Louis County Records said tract also being recorded in deed book 19741, page 986 of the St. Louis County Records, located in the City of Northwoods, St. Louis County, Missouri and being more particularly described as follows: COMMENCING at the Southwest corner of Lot 8 of the above aforementioned property; Thence along the West property line of the above aforementioned tract North 29 degrees, 37 minutes, 54 seconds East a distance of 19.58 feet to the TRUE POINT OF BEGINNING of the herein described VARIABLE WIDTH SEWER EASEMENT; Thence continuing along said West property line North 29 degrees, 37 minutes, 54 seconds East a distance of 20.17 feet to a point; Thence leaving aforesaid West property line South 62 degrees, 48 minutes, 32 seconds East a distance of 48.89 feet to a point; Thence South 84 degrees, 58 minutes, 22 seconds East a distance of 23.27 feet to a point in the East property line of the above aforementioned tract; Thence along said East property line South 29 degrees, 37 minutes, 54 seconds West a distance of 21.99 feet to a point; Thence leaving said East property line North 68 degrees, 27 minutes, 42 seconds West a distance of 70.70 feet to THE POINT OF BEGINNING of the herein described VARIABLE WIDTH SEWER EASEMENT. ALSO A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT for use during the construction of any sewer in the above described SEWER EASEMENT, said VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT (#1) being part of Lot 7 and Lot 8 in Block 26 of “ELECTRIC HOMESITES” recorded in Plat Book 27, Pages 46 and 47 of the St. Louis County Records said tract also being recorded in deed book 19741, page 986 of the St. Louis County Records, located in the City of Northwoods, St. Louis County, Missouri and being more particularly described as follows: COMMENCING at the Southwest corner of Lot 8 of the above aforementioned property; Thence along the West property line of the above aforementioned tract North 29 degrees, 37 minutes, 54 seconds East a distance of 18.84 feet to the TRUE POINT OF BEGINNING of the herein described VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT; Thence continuing along said West property line North 29 degrees, 37 minutes, 54 seconds East a distance of 0.74 feet to a point; Thence leaving aforesaid West property line South 68 degrees, 27 minutes, 42 seconds East a distance of 70.70 feet to a point in the East property line of the above aforementioned tract; Thence along said East property line South 29 degrees, 37 minutes, 54 seconds West a distance of 10.69 feet to a point; Thence leaving said East property line North 60 degrees, 22 minutes, 06 seconds West a distance of 70.00 feet to THE POINT OF BEGINNING of the herein described VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT. THE VARIABLE WIDTH TEMPORARY CONSTRUCTION EASMENT will become null and void upon completion of construction. A 5 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT (#2) being part of Lot 7 and Lot 8 in Block 26 of “ELECTRIC HOMESITES” recorded in Plat Book 27, Pages 46 and 47 of the St. Louis County Records said tract also being recorded in deed book 19741, page 986 of the St. Louis County Records, located in the City of Northwoods, St. Louis County, Missouri and being more particularly described as follows: COMMENCING at the Southwest corner of Lot 8 of the above aforementioned property; Thence along the West property line of the above aforementioned tract North 29 degrees, 37 minutes, 54 seconds East a distance of 39.75 feet to the TRUE POINT OF BEGINNING of the herein described 5 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT; Thence continuing along said West property line North 29 degrees, 37 minutes, 54 seconds East a distance of 5.00 feet to a point; Thence leaving said West property line South 62 degrees, 48 minutes, 32 seconds East a distance of 47.70 feet to a point; Thence South 84 degrees, 58 minutes, 22 seconds East a distance of 24.58 feet to a point in the East property line of the above aforementioned tract; Thence along said East property line South 29 degrees, 37 minutes, 54 seconds West a distance of 5.50 feet to a point; Thence leaving said East property line North 84 degrees, 58 minutes, 22 seconds West a distance of 23.27 to a point; Thence North 62 degrees, 48 minutes, 32 seconds West a distance of 48.89 feet to THE POINT OF BEGINNING of the herein described 5 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT. THIS 5 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of construction. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing Ordinance was adopted on January 14, 2021.
