HomeMy Public PortalAbout15587 Sub-Trunk #2 Sanitary Relief (Birmingham Ct to Cove Ln) (12221)O R D I N A N C E NO. 15587 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Sub-Trunk #2 Sanitary Relief (Birmingham Ct to Cove Ln) (12221) in Unincorporated St. Louis County, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of Unincorporated St. Louis County, Missouri within the Watkins Creek Watershed wherein numerous people live and work; WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Sub-Trunk #2 Sanitary Relief (Birmingham Ct to Cove Ln) (12221) hereinafter set forth, said easements and temporary easements being more particularly described below: Parcel #7 A VARIABLE WIDTH EASEMENT through property conveyed to Kinderman, William J. & Darlene C., H/W by deed recorded in Book 7673, Page 1989 of the St. Louis County Recorder’s Office and being Lot 25 of “Maple Crest Plat No. 2 First Addition” as recorded in Plat Book 65, Page 45 of the St. Louis County Recorder’s Office, St. Louis County, Missouri and being more particularly described as follows: BEGINNING at a point on the East line of Doris Drive, 50 feet wide, being the Northwest corner of said Lot 25; THENCE South 78 degrees 53 minutes 02 seconds East 194.37 feet along the North line of said Lot 25 to the Northeast corner thereof; THENCE South 00 degrees 41 minutes 18 seconds West 223.07 feet along the East line of said Lot 25 to the Southeast corner thereof; THENCE North 83 degrees 03 minutes 42 seconds West 17.08 feet along said South line of Lot 25 to a point; THENCE North 9 degrees 02 minutes 11 seconds East 25.78 feet to a point; THENCE North 2 degrees 59 minutes 31 seconds West 196.05 feet to a point; THENCE North 78 degrees 53 minutes 02 seconds West 169.10 feet to the aforesaid East line of Doris Drive; THENCE along a curve to the left whose radius point bears North 76 degrees 10 minutes 25 seconds West 100.00 feet from the last mentioned point, an arc distance of 5.00 to the POINT OF BEGINNING. Excepting Therefrom The North 5 feet and the East 10 feet of Lot 25 of “Maple Crest Plat No. 2 First Addition” as recorded in Plat Book 65, Page 45 of the St. Louis County Recorder’s Office, being a 5 feet wide easement and a 10 feet wide easement recorded on said plat. Also, A 20 FEET WIDE TEMPORARY CONSTRUCTION EASEMENT for use during the construction of any sewer in the above described A VARIABLE WIDTH EASEMENT, said TEMPORARY CONSTRUCTION EASEMENTS being more particularly described as follows: TEMPORARY CONSTRUCTION EASEMENT A 20 FEET WIDE TEMPORARY CONSTRUCTION EASEMENT through property conveyed to Kinderman, William J. & Darlene C., H/W by deed recorded in Book 7673, Page 1989 of the St. Louis County Recorder’s Office and being Lot 25 of “Maple Crest Plat No. 2 First Addition” as recorded in Plat Book 65, Page 45 of the St. Louis County Recorder’s Office, St. Louis County, Missouri and being more particularly described as follows: BEGINNING at a point on the South line said Lot 25, being distant North 83 degrees 03 minutes 42 seconds West 17.08 feet from the Southeast corner of said Lot 25; THENCE North 83 degrees 03 minutes 42 seconds West 20.01 feet along said South line of Lot 25 to a point; THENCE North 9 degrees 02 minutes 11 seconds West 24.41 feet to a point; THENCE North 2 degrees 59 minutes 31 seconds East 198.97 feet to a point; THENCE South 78 degrees 53 minutes 02 seconds East 20.62 feet to a point; THENCE South 2 degrees 59 minutes 31 seconds East 196.05 feet to a point; THENCE South 9 degrees 02 minutes 11 seconds West 25.78 feet to the POINT OF BEGINNING. TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of the sewer construction associated with MSD Project No.12221, Sub-Trunk #2 Sanitary Relief (Birmingham Ct. to Cove Ln.) Parcel #12 AN 11.00 FEET AND 5.00 FEET WIDE EASEMENT through property conveyed to Meritt, Gail Jean by deed recorded in Book 22963, Page 649 of the St. Louis County Recorder’s Office and being part of Lot 26 of “Fontaine Estates” as recorded in Plat Book 84, Page 49 of the St. Louis County Recorder’s Office, St. Louis County, Missouri and being more particularly described as follows: BEGINNING at a point on the South line of Crossett Drive, 50 feet wide, being the Northwest corner of said Lot 26; THENCE South 82 degrees 57 minutes 43 seconds East 11.00 feet along; said the South line of Crossett Drive to a point; THENCE South 7 degrees 02 minutes 17 seconds West 151.50 feet to a point; THENCE South 82 degrees 57 minutes 43 seconds East 93.00 feet to the East line of said Meritt property; THENCE South 7 degrees 02 minutes 17 seconds West 5.00 feet along said East line of the Meritt property to the South line thereof; THENCE North 82 degrees 57 minutes 43 seconds West 104.00 feet along said South line of Lot 26 to the Southeast corner thereof; THENCE North 7 degrees 02 minutes 17 seconds East 156.50 feet along the West line said Lot 26 to the POINT OF BEGINNING.
