HomeMy Public PortalAbout15588 Sub-Trunk #3 Sanitary Relief (Muriel Dr To Jenner Ln) (11669)O R D I N A N C E NO. 15588 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Sub-Trunk #3 Sanitary Relief (Muriel Dr to Jenner Ln) (11669) in Unincorporated St. Louis County, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of Unincorporated St. Louis County, Missouri within the Watkins Creek Watershed wherein numerous people live and work; WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Sub-Trunk #3 Sanitary Relief (Muriel Dr to Jenner Ln) (11669) hereinafter set forth, said easements and temporary easements being more particularly described below: Parcel #3 A 10 FOOT WIDE SEWER EASEMENT, being part of Lot D of “Johnny Londoff Subdivision Plat 1” as recorded in Plat Book 357, Pages 443-444 of the St. Louis County Recorder’s Office and located in St. Louis County Missouri, being more particularly described as follows: CENTERLINE OF 10 FOOT WIDE SEWER EASEMENT COMMENCING at the Northeast corner of said Lot D; THENCE along the North line of said Lot D, North 89 degrees 57 minutes 32 seconds West, 51.52 feet to the POINT OF BEGINNING; THENCE leaving said North line of Lot D along the CENTERLINE OF 10 FOOT WIDE SEWER EASEMENT, South 07 degrees 11 minutes 55 seconds East, 160.47 feet to the POINT OF TERMINUS and containing 1,605 square feet more or less. Also, two (2) TEMPORARY CONSTRUCTION EASEMENTS, for use during construction of any sewer in the above described 10 FOOT SEWER EASEMENT, said TEMPORARY CONSTRUCTION EASEMENTS being more particularly described as follows: TEMPORARY CONSTRUCTION EASEMENT No. 1 COMMENCING at the Northeast corner of said Lot D; THENCE along the North line of said Lot D, North 89 degrees 57 minutes 32 seconds West, 56.56 feet to the POINT OF BEGINNING; THENCE leaving said North line of Lot D, South 07 degrees 11 minutes 55 seconds East, 194.22 feet to a point on the West line of an existing variable width sewer easement to MSD as recorded in Deed Book 6785, Pages 33-34 of the St. Louis County Recorder’s Office; THENCE along said West line of an existing variable width sewer easement, South 01 degrees 23 minutes 15 seconds West, 32.32 feet; THENCE leaving said West line of an existing variable width sewer easement, South 82 degrees 48 minutes 05 seconds West, 15.17 feet to a point; THENCE North 07 degrees 11 minutes 55 seconds West, 228.72 feet to a point on said North line of Lot D; THENCE along said North line of Lot D, South 89 degrees 57 minutes 32 seconds East, 20.16 feet to the POINT OF BEGINNING and containing 4,472 square feet more or less. TEMPORARY CONSTRUCTION EASEMENT No. 2 COMMENCING at the Northeast corner of said Lot D; THENCE along the North line of said Lot D, North 89 degrees 57 minutes 32 seconds West, 27.56 feet to a point on the West line of an existing variable width sewer easement to MSD as recorded in Deed Book 6785, Pages 33-34 of the St. Louis County Recorder’s Office, the POINT OF BEGINNING; THENCE leaving said North line of Lot D and along said West line of an existing variable width sewer easement, South 01 degrees 23 minutes 15 seconds West, 125.74 feet to a point on said West line of an existing variable width sewer easement; THENCE leaving said West line of an existing variable width sewer easement, North 07 degrees 11 minutes 55 seconds West, 126.72 feet to a point on said North line of Lot D; THENCE along said North line of Lot D, South 89 degrees 57 minutes 32 seconds East, 18.92 feet to the POINT OF BEGINNING, excepting therefrom that portion covered by an existing easement recorded in Deed Book 6785, Page 19 of said St. Louis County Recorder’s Office and containing 1,189 square feet more or less. THE TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above described sewer construction. Parcel #4 A 10 FOOT WIDE SEWER EASEMENT, being part of Lot 207 of “Northgate Estates No.6” as recorded in Plat Book 95, Page 45 of the St. Louis County Recorder’s Office and located in St. Louis County Missouri, being more particularly described as follows: CENTERLINE OF 10 FOOT WIDE SEWER EASEMENT COMMENCING at the Easternmost corner of said Lot 207, said point being on the South line of Claudine Drive, 50 feet wide; thence along the South line of said Lot 207, North 89 degrees 57 minutes 32 seconds West, 51.52 feet to the POINT OF BEGINNING; THENCE leaving said South line of Lot 207 along the CENTERLINE OF 10 FOOT WIDE SEWER EASEMENT, North 07 degrees 11 minutes 55 seconds West, 14.40 feet to a point; THENCE North 28 degrees 29 minutes 11 seconds East, 11.74 feet to the POINT OF TERMINUS, excepting therefrom that portion covered by the existing easement recorded in Plat Book 95, Page 45 of said St. Louis County Recorder’s Office, containing 161 square feet more or less. THE TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above described sewer construction. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing Ordinance was adopted on January 14, 2021.
