The regular meeting of the City Council of the City of Temple City was called to order by Mayor Nunamaker at 7:30 P.M., 2. The Rev. John J. Birch, Pastor of St. Luke's Catholic Church, Temple City, gave the invocation, followed by the Pledge of 3. Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker ABSENT: Councilmen: Tyrell ALSO PRESENT: City Manager Woollett and. City Attorney Shatford APPROVAL OF MINUTES: Regular Meeting of December 23, 1964: City Manager Woollett corrected Item 11 to delete "instruct the City Clerk to ". He also corrected Item 15, changing the date of the public hear- ing from Jan. 13th to Jan. 27th. Minutes of the Public Hearing, December 19, 1964: Councilman Merritt noted that on Page 2, 6th paragraph, the word "not" should have been inserted between the words "would" and "cause" in line 4. Counci lrriarr Merritt moved to approve the Minutes. of December 23, 1964 and the Public Hearing on December 19, 1964 as amended, seconded by Councilman Dickason and carried by the following roll call vote: AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT: Councilmen: Tyrell 6. ORDINANCE NO. 64-120 GRANTING A CHANGE OF ZONE ON PROPERTY ON WEST SIDE OF ARDEN DRIVE BETWEEN RANDWICK AND GREEN STREET FROM A -1 ACRE TO R-1. City Attorney Shatford read title to Ordinance No. 64 -120, stating that a Public Hearing has already been held on this and that this is the first reading. Councilman Merritt moved to waive further reading, seconded by Councilman Dickason and carried. 7. RESOLUTION NO. 64 -339 DENYING REQUESTED ZONE VARIANCE, CASE NO. 63-64, Benjamin Boyd, 10520 Key West. City Attorney Shatford read title to Resolution No. 64 -339.. Councilman Fitzjohn moved to adopt Resolution No. 64 -339, seconded by Councilman Dickason and carried by the following roll call vote AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT: Councilmen: Tyrell PUBLIC HEARING: 7:30 P.M. - ASSESSMENT OF :CURB AND GUTTER CONSTRUC- TION ON WEST SIDE OF AGNES BETWEEN MILOANN AND LA ROSA. Councilman Fitzjohn moved to open. the Public Hearing and carried. City Manager Woollett stated that the ;,curb was placed and this individual who resides at 5117 N. Agnes is the only one who has not paid his share, which amount to $174.58. No one spoke either for or against the issue and Councilman Fitzjohn moved to close the Public Hearing, seconded by Councilman Merritt and carried. Councilman Merritt then moved to confirm the assessment in the amount of $174.58 located at 5117 N. Agnes, seconded by Council- man Fitzjohn and carried by the following roll call vote: AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT: Councilmen: Tyrell 558 Council Minutes, January 13, 1964, Page 2 8. ORDINANCE NO. 63 -118 ALLOWING SIX CHILDREN IN FOSTER HOMES WITH 24 -HOUR CARE: 2nd Reading City Attorney Shatford read title to Ordinance No. 63 -118, stating this is the 2nd reading. Councilman Merritt moved to adopt Ordinance No. 63-118, seconded by Councilman Fitzjohn and carried by the following roll call vote: AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT: Councilmen: Tyrell NEW BUSINESS: 9. ORDINANCE NO. 64 -119 - ABANDONMENT OF CITY'S INTEREST ON REAL PROPERTY LOCATED ON WEST SIDE OF ARDEN DRIVE NORTH OF FREER ST. 1st Reading: City Attorney Shatford read title to Ordinance No. 64 -119. Councilman Dickason moved to waive further reading, seconded by Councilman Fitzjohn. City Manager Woollett stated that is an urgency ordinance and must be read in full, which City Attorney did. City Manager stated this street has already been determined not to be a major City street, and one of the conditions re- quired is that the City vacate that portion affected by the sub- division. Councilman Dickason moved to adopt Ordinance No. 64 -119, seconded by Councilman Fitzjohn and carried by the following roll call vote: AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT: Councilmen: Tyrell 10. RESOLUTION NO. 64 -338 - EXECUTION OF OPTION TO PURCHASE REAL PROPERTY LOCATED AT 5839 N. CAMELLIA AVE. City Attorney Shatford read title to Resolution No. 64 -388 ex- plaining that when the Temple City Parking Association was formed it acquired a lot located directly behind the Richfield Gas static on the Northeast corner of Las Tunas and Camellia Ave. The prop- erty is being purchased by American Savings and Loan Assn. for the purpose of building a new facility, and in order to insure parking for this new facility, they want to purchase the parking lot. The Parking Association worked out an arrangement wherein they will sell the parking lot to American Savings for $18,000. with a proviso that if the lot is not used for parking they will have the right to acquire it at like value. The Parking Assn. will then use this $18,000 and the City will exercise its option to purchase a lot located at 5839 Camellia Ave. In this manner, the City will acquire a new parking facility without the expendir ture of any funds. Councilman Fitzjohn moved to adopt Resolution No. 64 -338, seconded by Councilman Merritt and carried by the following roll call vote: AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT: Councilmen: Tyrell 11. RESOLUTION NO. 64 -336 - REQUESTING REGISTRAR OF VOTERS TO RENDER. ELECTION SERVICES FOR MUNICIPAL ELECTION TO BE HELD !.PRIL 14,196. City Manager Woollett read title to Resolution No. 64 -336 and explained that this requests such services as printing of ballots, forms, etc. Councilman Merritt moved to adopt Resolution No. 64 -336, seconded by Councilman Fitzjohn and carried by the follow- ing roll call vote: AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT: Councilmen: Tyrell 12. APPEAL FROM PLANNING COMMISSION DECISION, ZONE CASE NO. 63 -71, N. W. CORNER OF BROADWAY AND TEMPLE CITY BLVD. City Manager Woollett explained that the applicant, Frederick Garside, has appealed to the City Council within the appeal period and recommends setting the public hearing at 7:30 P.M. on Janu- ary 27, 1964. 559 City Council Minutes, January 13, 1964, Page 3 Councilman Fitzjohn so moved, seconded by Councilman Dickason and carried. 13. REQUESTS FROM CAMELLIA FESTIVAL: (a) Rainbow Girls requested permission to sell Festival hats before, during and after the parade. Councilman Fitzjohn moved to approve this request, seconded by Councilman Merritt and carried. (b) Request for subsidation for television coverage of parade. City Manager Woollett suggested this item be tabled at this time. Councilman Fitzjohn so moved, seconded by Councilman Dickason and carried. 14. PROCLAMATION OF JANUARY 1964 AS MARCH OF DIMES MONTH: Mayor Nunamaker read Proclamation. Councilman Dickason moved to approve, seconded by Councilman Fitzjohn and carried. Councilman Fitzjohn stated that Jacob "Pop" Gunst was the originator of the Line of Dimes. 15,, PLANNING COMMISSION RECOMMENDATIONS: (8) Approval of Tentative Tract #29316 with conditions as amended: Planning Advisor Cushman explained Planning Com- missions thoughts and recommended approval subject to con- ditions as noted by the Subdivision Committee Report and Planning Commission. Councilman Dickason moved to approve, seconded by Councilman Fitzjohn and carried by the follow- ing roll call vote: AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT:Councilmen: Tyrell (12) Policy of Location of Sidewalks in all zones. Planning Advisor Cushman stated that this policy arose due to the increased development of apartments in R -3 zones in which the developer raised the question of desirability of having sidewalks adjacent to curbs where it would not interfere with tree planting programs. It became obvious that a definite policy should be established for all zones in order to provide uniformity throughout the City. Councilman Dickason asked if the City Manager would have the right to make deviations if necessary, and was assured he would. Councilman Merritt moved to approve the Policy of Location of Sidewalks, seconded by Councilman Dickason and carried by the following roll call vote: AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT:Councilmen: Tyrell (13) Citation of Mr. Gabriel Janus, 6156 Rosemead Blvd. City Attorney stated that an inspection of Mr. Janus' prop- erty discloses that he is in conformity and suggests that the City take no action at this time. However, he suggested that the City keep a surveillance on the property with spot checks and if at any time he is discovered to be in viola- ' tion, then he should be cited. 16. SET PUBLIC HEARINGS FOR CURB AND GUTTER CONSTRUCTION ON DAINES DRIVE, north side, Double Drive to Welland, and Daines Drive, south side, Double Drive to Welland. City Manager Woollett stated this public hearing was originally set for this meeting but because of the current status of avail- ability of funds, recommends this be held at the next meeting. Councilman Fitzjohn moved to continue the public hearing on curb and gutter on Daines Drive to 7:30 P.M. on January 27, 1964, seconded by Councilman Merritt and carried. 17. RESOLUTION NO. 64 -337 WARRANTS AND DEMANDS IN THE SUM OF $57,300.89 DEMAND NOS. 4457 THROUGH 4533. 560 Council Minutes, January 13, 1964, Page 4 City Manager Wooli.ett stated check No. 4508 in the amount of $17,442.60 represents the first progress payment to Coletta and Edgeley for work on the new City Hall, through the 25th of De- cember and we will be billed at that amount less 10% until com- pletion of the project. Councilman Dickason questioned check No. 4515 in the amount of $2500. for traffic signal maintenance, and was informed by the City Manager that this is the City's share of maintenance costs of traffic signals in the City and also those on the boundaries of the City, which are sometimes State and sometimes County. Councilman Merritt moved to approve Resolution No. 64 -337, seconded by Councilman Dickason and carried by the following roll call vote: AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT: Councilmen: Tyrell 18. COMMUNICATIONS: None 19. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: (1) "Pop" Gunst, who has charge of the Line of Dimes, addressed the Council requesting permission to close off one lane of traffic going north and one lane south of Las Tunas on Temple City Blvd. Also request to close off the turning lane going east and west and to put a "No Left Turn" sign in the center of Las Tunas and Temple City Blvd. This request was granted by the City Manager previously, and in addition, they would like permission to close off one lane on Temple City Blvd. between the hours of 1:00 P.M. and 3:30 P.M. on Friday, January 24th. Councilman Dickason moved to grant this request, seconded by Councilman Fitzjohn. Mr. Woollett pointed out that Temple City Blvd. is narrow and felt that temporary "No Parking" signs should be placed on the west side of Temple City Blvd. from Las Tunas to the alley north, and on the east side from Las Tunas to the alley south. Council- man Dickason included this in his motion, seconded by Councilman Fitzjohn and carried. (2) Mr. Charles Oakley, 6164 Rosemead Blvd. addressed the Counci stating that he is of the opinion that Gabriel Janus has not en- tirely ceased operations at 6156 Rosemead Blvd. and was advised by the City Attorney to keep a record of what he is doing to report to the investigator, and that the City will take care of the law enforcement on this matter. (3) Mrs. Susan Warman wished to speak with City Attorney Shatforc but was advised that her business was not a City matter. 20. MATTERS.FROM CITY OFFICIALS: (1) City Attorney Shatford read title to RESOLUTION NO. 64 -340. AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AGREEMENT ACCEPT- ING GATEWAY SIGNS TO CITY FROM JUNIOR CHAMBER OF COMMERCE SUBJECT TO CERTAIN CONDITIONS. He also gave a brief summary of the Agreement. Councilman Dickason moved to adopt Resolution No. 64 -340, seconded by Councilman Fitzjohn and carried by the followr ing roll call vote: AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT: Councilmen: Tyrell (2) City Attorney Shatford read title to ORDINANCE NO. 64 -121 AMENDING MUNICIPAL CODE SECTION 6201 TO BRING THE COUNTY OF LOS ANGELES BUSINESS LICENSE ORDINANCE 5860, AS AMENDED, CURRENT TO JANUARY 13, 1964, explaining this will bring Temple City up to date, and that it does not change any amendments the City made with respect to entertainment. Councilman Merritt moved to waive further reading, seconded by Councilman Fitzjohn and carried by the following roll call vote: 561 1 Council Minutes, January 13, 1964, Page 5 AYES: Councilmen: Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen: None ABSENT: Councilmen: Tyrell Councilman Tyrell arrived at 8:22 P.M. (3) Mr. Robert Garvin, Vice President of the Junior Chamber of Commerce, 9651 Nadine St., thanked the City for all their efforts in making the entrance signs a realization. It was noted that there was no provision in the agreement for uniformity in the size of additional service club signs, and requested that this be considered. (4) City Manager Woollett advised that, in conformance with the budget for this year, that a check be drawn for $1,000.00 to the Junior Chamber of Commerce, which is the amount that the City agreed to contribute towards the entrance signs. Councilman Merritt moved to approve, seconded by Councilman Fitzjohn and carried by the following roll call vote: AYES: Councilmen: Dickason, Fitzjohn, Merritt, Tyrell, Nuna NOES: Councilmen: None maker ABSENT: Councilmen: None (5) Councilman Merritt stated that many of the Sheriff's reports are quite illegible and City Manager Woollett stated he would check into the matter. (6) Councilman Dickason stated he thought Karl Koski should be congratulated on his fine presentation made tonight at the Public Works Session. He realized that a lot of work went into his report and it gave all of them much "food for thought ", and was in favor of doing something like this once a month as it would make it much easier at budget time. (7) Mayor Nunamaker stated that Parking District No. 1 has a total of 55.81% signed up, and it is hoped that Parking District No. 2 will 'reach 60 %'and can be brought to the City Council at its next meeting for setting of public hearing. 21. ADJOURNMENT: Councilman Fitzjohn moved to adjourn at 8:30 P.M. and carried. Council adjourned until the next regular meeting on January 27, 1964 at 7:30 P.M. at the City Hall.
