AN ORDINANCE AMENDING ORDINANCE NO. 1997-214
REGARDING THE UNIFORM BUILDING CODE BY MAKING
SEPARATE PROVISION FOR INSPECTION OF NONRESIDENTIAL
BUILDINGS
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose: The purpose of this Ordinance is to amend Ordinance No.
1997-214 which adopted the Uniform Building Code, by amending the type of
buildings it applies to and by adoption of certain International and National
Building Codes for nonresidential buildings.
Section 2. Amendment: Ordinance No. 1997-214(2) of the City of Tiffin is
hereby deleted and the following Section 2 substituted therefor:
Section 2. Adoption of Uniform Building Code, National, and International
A. The Uniform Building Code, including any amendments
thereto, as previously adopted by this Ordinance shall
now be applicable only to residential buildings
constructed in the City.
B. The following listed International and National Codes,
including any amendments thereto, are hereby adopted
for all nonresidential buildings construction in the City:
1. International Building Code (2006)
2. International Fire Code (2006)
3. International Mechanical Code (2006)
4. International Plumbing Code (2006)
5. International Fuel-Gas Code (2006)
6. National Electrical Code (2005)
C. The City shall maintain a copy of the Codes available for
public reference.
Section 3. Penalty Provision. The city may elect, at its sole discretion, to
prosecution any violation either as simple misdemeanor or a municipal
infraction.

Section 4. Repealer. All ordinances or parts of ordinances in conflict
with the provisions of this Ordinance are hereby repealed.
Section 5. Severability. If any section, provision, or part of this
ordinance will be adjudged to be invalid or unconstitutional, such adjudication
will not affect the validity of the ordinance as a whole, or any section, provision,
or part thereof not adjudged invalid or unconstitutional.
Section 6. Effective Date. This ordinance will be in effect after its final
passage, approval, and posting as provided by law.
On the 28th day of May 2008, at a special meeting of the Tiffin City Council,
Tiffin, Iowa, CouncilpersonMike Gericke introduced Ordinance No. 2008-
29 2 , and moved that it be given its first reading. The motion was
seconded by Councilperson John Wright .
Ayes: Jim Bartels, Chris Ball, Mike Gericke, Mark Petersen, John Wright
Nays: None
Five members of the council being present and having voted "Aye", Mayor
Royce Phillips declared the motion carried, and Ordinance No. 292 , was
read the first time and discussed and placed on record.
Thereupon, it was moved by Councilperson Mike Gericke and
seconded by Councilperson John Wright that the laws
and rules providing that ordinances be considered and voted on for passage at
two council meetings prior to the meeting at which it is to be finally passed be
suspended and dispensed with and that Ordinance No. be placed
on its last reading.

Nays: None
Five members of the council being present and having voted "Aye", Mayor
Royce Phillips declared the motion carried, and Ordinance No. 292 , was
then placed on its last reading and was read the last time.
Thereupon, it was moved by Councilperson Mark Petersen and
seconded by Councilperson Mike Gericke that Ordinance
No. 2008-292 be placed upon its final passage and adopted.

Five members of the council being present and having voted "Aye", Mayor
Royce Phillips declared the motion carried, and the ordinance was passed and
adopted.
Whereupon the Mayor declared that Ordinance No.2 0 0 8-2 9 2 be adopted
and signified his approval of same by fixing his signature thereto.
Passed by the Council on the 28th day of May 2008 and
approved by the Mayor on the 28thday of May 2008.

I, Ruth Demuth, Clerk of the City of Tiffin, Iowa, state that an ordinance
entitled AN ORDINANCE AMENDING ORDINANCE NO. 1997-214
REGARDING THE UNIFORM BUILDING CODE BY MAKING
SEPARATE PROVISION FOR INSPECTION OF NONRESIDENTIAL
BUILDINGS, and known as No. 2008- 292 was duly passed by the
Council on the 28th day of May 2008, and signed by the Mayor on the 28th day
of May 2008, and published on the 28th day of May 2008, by posting copies
thereof in four public places within the limits of the City of Tiffin, Iowa.
That I posted copies of Ordinance No. 2008- 292 in the following places:
Morgan's Service; On the Go Convenience Store; Solon State Bank of Tiffin; and
The Depot
