HomeMy Public PortalAbout1996_04_09_O010 Amending the SLDR to provide an Administrative Review ProcessThe Town of Leesburg, Virginia PRESENTED April 9~ 1996 ORDINANCE NO. 96-0-10 ADOPTED April 9, 1996 AN ORDINANCE: AMENDING THE LEESBURG SUBDIVISION AND LAND DEVELOPMENT REGULATIONS TO ESTABLISH AN ADMINISTRATIVE REVIEW AND APPROVAL PROCESS FOR FINAL PLATS AND PLANS WHEREAS, the Economic Development Commission requested the Planning Commission to consider certain modifications to the development review process for the purpose of expediting the process; and WHEREAS, the Planning Commission agreed in concept, that approval of preliminary development plans and subdivision plats should remain the responsibility of the Planning Commission and approval of final development plan and subdivision plats should be approved administratively; and WHEREAS, on June 13, 1995, the Town Council initiated a study of the plan review process to evaluate the recommendations of the Economic Development Commission; and WHEREAS, the Planning Commission held a public hearing on November 16, 1995, pertaining to draft amendments to establish an administrative approval process; and WHEREAS, the Planning Commission forwarded the proposed amendments to the Town Council with a favorable recommendation on January 4, 1996; and WHEREAS, the Town Council held a public hearing on these amendments on February 13, 1996; THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia, as follows: SECTION I. Leesburg Subdivision and Land Development Regulations Sections 13-53(b), 13- 55.1; 13-55.2; 13-57(various sections); 13-60(various sections); 13-61; 13-61(b); 13-62(various sections); 13-68(a); 13-68(d); 13-69(various sections); 13-70(various sections); 13-89(various sections); 13-90(c); 13- 90(d); and 13-99(c) are hereby amended as shown in Attachment 1 dated April 5, 1996. SECTION II. Any preliminary plat or plan which the Town Land Development Official has accepted for review prior to the effective date of this ordinance shall be vested in the subdivision and ORDINANCE AMENDMENTS REGARDING FINAL PLATS AND PLANS 2 land development regulations of the Town regarding minimum submission requirements at the time the aforementioned preliminary plat or plan was filed. SECTION III. Severability. If any provision of this ordinance is declared invalid by a court of competent jurisdiction, the decision shall not effect the validity of ordinance as a whole or any remaining provisions of the Subdivision and Land Development Regulations. SECTION IV. All prior ordinances in conflict herewith are hereby replaced. SECTION V. This ordinance shall be in effect upon its passage. PASSED this 9th day of April , 1996. Clem, Mayor Town of Leesburg SUBDIVISION AND LAND DEVELOPMENT REGULATIONS AMENDMENTS TO ESTABLISH ADMINISTRATIVE APPROVALS FOR FINAL PLATS AND FINAL DEVELOPMENT PLANS SECTION 13-53 COMPLIANCE REQUIRED, PENALT~ (b) No such plat of any subdivision shall be recorde.d...U..~!~..~..~i~!i~i~i~!~ shall have been submitted to and approved by the Commission ~i~!~~?~i~i~i~i~ii~.i.:"~i~!~?~ ~i~~i~i~~i~i~.1...~~..1 in a~ordance with this Article. ~?~?~ SECTION 13-55.1 GENERAL CRITERIA FOR REVIEW & APPROVAL OF SUBDIVISIONS The Leesburg Planning Commission shall review and have the authority to approve 2!! subdivisions of ~i~ii~i~~, as defined by these regulations. In approving such subdivisions, the Planning Commission ~ ~i!i~!~i?~i~ shall, in accordance with Section 15.1-466 of the 1950 Code of Virginia, as amended, be provided with suitable information in order to make a determination that the proposed plat provides: SECTION 13-55.2 MINOR SUBDIVISIONS For the purpose of this division, a minor subdivision shall be defined as the creation of no more than five lots of record which do not require the extension of any public or private street, or any public utility main. Minor subdivisions shall not include those divisions of land which create either pipestem lots or cluster subdivisions. Applications qualifying as minor subdivisions need not include the submittal of preliminary plat information, but need only submit the materials necessary for final plat approval. The P!~nning Commission ~i~i~!~i!?~ shall review minor subdivisions in the same manner as final plats, as specified in Section 13-60 of these regulations. SECTION 13-57 REVIEW AND APPROVAL OF PRELIMINARY SUBDIVISION PLAT (a) Review for Completeness and Technical Accuracy The Land Development Official shall conduct an initial review of the application and preliminary plat of the proposed subdivision for completeness and technical accuracy. Within ~5 ~ working days of application submittal, the Land Development Official shall notify the applicant as to whether the plat has been accepted or rejected based on significant deficiencies in the proposed preliminary plat application. Applications for preliminary plat approval which are deemed incomplete shall not be accepted until the deficiencies have been properly addressed. (b) Referral of Application to Review Agencies. If the applicant fails to file or record the final plat and provide the copies as required above, final approval shall be withdrawn by the Commission ~~:~~}~ and the ~-~' ~1~* eh~ll ~*or notification ~~?~??~i~?~g~~?~~?~ marked "void" and returned to the SECTION 13-62 REQUIRED CONTENTS OF SUBDIVISION PLATS (b) Preliminary Plat Contents. PROPOSED ORDINANCE AMENDMENTS - 4/5/96 Unless a waiver is approved, as authorized in paragraph (a) above, all applications preliminary plat approval shall be accompanied by the following information: (1) for General Information ((a)) Name of the proposed ((b)) Proposed use(s) of the property. ((c)) Names and addresses of owner(s) of record and subdivider. ((d)) Names, address, signature and registration of professionals preparing the plat. ((e)) Deed reference, tax map and parcel number. ((f)) Date plat was drawn and date of any revision. ((g)) Vicinity map. ((h)) Existing zoning, including any proffers associated with the property. ((i)) Names and addresses of all adjoining property owners, including proof that all such property owners have been notified in writing by the applicant that the subject property is to be subdivided. Such notification shall be in a form approved by the Land Development Official. Notice sent by certified mail to the last known address of such owners as shown on the current real estate tax assessment books shall be deemed adequate compliance with this requirement. ((j)) Proof of any approved special exceptions, variances or waivers necessary for the subdivision. ((k)) Include the following note on the plat: Preliminary plat approval is initially valid for a period of three years. One-year extensions of this approval will be considered annually. No more than two extensions will be considered in cases where an applicant has not recorded a final plat for any section of the preliminary plat. The applicant will not receive any notification from the Town of this plat's expiration. The applicant is responsible for filing an extension request in accordance with the Town's ordinance in effect on the date of application. Existing topography with maximum of five-foot contour interval. Location and full width of existing roadways. Location and width of existing roadways. Location and explanation of any existing easements. Location and dimensions of existing driveways and access points on the property and within 200 feet of the site. Location of 100-year flood plain as shown on the most recent Federal Emergency Management Agency (FEMA) maps. PROPOSED ORDINANCE AMENDMENTS - 4/5/96 4 ((h)) All overland watercourses ~i~?~!~i~!i~i~ii!~i~i and drainage structures within the subdivision or within 100 feet of the subdivision. ((i)) Names of all abutting subdivisions or names of owners of record of abutting property. ((j)) Existing uses and zoning of all adjoining properties. ((lc)) Indication of areas of tree cover on the property, including areas where tree protection or preservation measures will be taken. All trees with a diameter at breast height (dbh) of 18 inches or greater shall be specifically identified on the plat. Groups of trees may be delineated by drawing the drip line around the groups perimeter. ((l)) Identification of all existing slopes greater than or equal to 15 percent, and further delineation of slopes greater than or equal to 25 percent. iiiii iiiiii i !!i iiiiii i i ili ............................................................................................... (4) Graphic Requirements. If more than one sheet is necessary, a match line and corresponding sheet number system shall be provided. Location, right-of-way width and typical section of all proposed streets, common driveways ~_nd parking c~urtsi~?~~iiiiiii~i~iii~iii~iiii~g~??~g~$~i~:i~!~! The proposed lot and yard requirements with approximate dimensions, lot areas, and tentative lot numbers. Preliminary plans for water, storm and sanitary sewer systems for the subdivision, including any off-site improvements. All proposed connections to existing water lines, sewer lines and storm drainage structures. Preliminary layout of provision for collection and discharging surface drainage. Preliminary plans for erosion and sedimentation control measures. An indication of phases or sections within the proposed subdMsion and the order of development. A soil overlay map at a scale of not less than one inch to 200 with accompanying narrative. Drainage improvements proposed in the Town's Storm Drainage Master plan within the subdivision or within 100 feet of the subdivision. Location and size of existing and proposed public open spaces within and adjacent to the subdivision. Location and size of existing and proposed public open spaces within and adjacent to the subdivision. If the Leesburg Zoning Ordinance requires the provision of a buffer yard, the PROPOSED ORDINANCE AMENDMENTS - 4/5/96 (c) plat shall indicate the type and location of the buffer yards proposed. ((n)) If significant topographic changes are proposed, the plat shall indicate the areas and approximate depth of cut and fill. ((o)) If modifications to the 100-year flood plain are proposed, the plat shall indicate the existing and proposed limits of such flood plain. ((p)) Identification of tree protection and tree preservation areas within the ((q)) Preliminary design of facilities proposed within common open space areas, including the number of parking spaces proposed, if any. ((r)) Location or proposed fire hydrants and/or distance to nearest existing hydrant. ((s)) A blank space ~o by three inches in size on the first sheet for use. as a signature panel for approval. (5) Other Information. ((a)) If the subdivision is not to be served by central water and sewer facilities, a statement by the Health Department that the site can be se.wed by ,:.,ells and ((b)) A stakeout plan, along with a certificate indicating that the properW has been staked in a~rdance with the plan. Stakes shall be Placed at 100-foot inte~als along the approximate center line of public and private roads. In addition, all parcel corners and proposed entrances, other than single-family detached driveways, shall also be staked. The stakeout plan and field stakes shall have a corresponding reference system. Field stakes must be clearly visible; however, trees with a diameter of sk inches or more should not be cleared for these purposes. ((c)) The applicant shall submit a complete T~e I soils report. A detailed Type II geotechnical investigation may be submitted in lieu of the Type I soils report. ((d)) Outline of proposed deed covenants, which may affect the type or location of structures, use of properties, or access to public rights-of-way. ((e)) If the proposed subdivision includes any areas designated in the Town Plan as proposed sites for schools, parks, bike paths, or other public uses, the prelimina~ plat shall include a statement regarding the applicant's intention to provide such public use(s). ((0) The application shall include information related to the projected traffic generated by the property and the need for turn lanes and similar improvements. Furthermore, if the subdivision is expected to generate 500 vehicles per day or more, a traffic study shall be submitted in accordance with Section 7-111 of the Leesburg Design and Construction Standards Manual, latest edition. Final Plat Contents. Unless a waiver is approved, as authorized in Section 13-62(a) herein, all applications for final plat approval shall be accompanied by the following information: PROPOSED ORDINANCE AMENDMENTS - 4/5/96 1. Names of any holders of easements or liens affecting the property. Name of the licensed professional surveyor or engineer who prepared the plat. Date of plat preparation and dates of any revisions. General location map at a scale of not less than six inches equals one mile, indicating thereon roads and their names and numbers, town limits, subdivisions and other landmarks. Boundary survey, with an error of closure within the limit of one in ten thousand, related to the true meridian or the Virginia State Grid with iiiiii~ minimum of two ~ coordinated tick marks as determined by the Land D~;~lopment Official. Proposed use(s) of the area being subdivided. All covenants and restrictions which will run with the land. Statement regarding the removal of obstructions in easements. Certificate signed by a Commonwealth of Virginia Certified [.and Surveyor setting forth the source of title and the place of record of the last instrument in the chain of title.
