AN ORDINANCE TO APPROPRIATE TWENTY THOUSAND, FIVE HUNDRED DOLLARS
($20,500.00) FROM THE FEDERAL REVENUE SHARING TRUST FUND, FOR CERTAIN
ORDINARY AND NECESSARY MAINTENANCE AND OPERATING EXPENDITURES AND
FOR CERTAIN ORDINARY AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED
BY THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF RICHMOND,
INDIANA.
WHEREAS, the State and Local Fiscal Assistance Act of 1972, Title
I of Public Law 95-512 was approved October 20, 1972,
WHEREAS, Section 51.40 of Part 51, Chapter I, Subtitle B, Title
31 of the Code of Federal Regulations provides as follows:
A recipient Government which receives entitlement funds under
the Act shall:
(c) Provide for the expenditure of entitlement funds in
accordance with the laws and the procedures applicable
to the expenditure of its own revenues;
WHEREAS, pursuant to the said State and Local Fiscal Assistance Act,
the proper legal officers of the City of Richmond, Indiana, have
established a trust fund known as the Federal Revenue Sharing Trust
Fund,
WHEREAS, revenues are available in said trust fund to be used for
certain ordinary and necessary maintenance and operating expenditures
and for certain ordinary and necessary capital expenditures,
WHEREAS, there is a need for funds for certain ordinary and necessary
maintenance and operating expenditures and for certain ordinary and
necessary capital expenditures as authorized by law, and
WHEREAS, certain extraordinary emergencies have developed since the
adoption of the existing annual budget so that it is now necessary to
appropriate more money for the various functions of the City Govern-
ment than was appropriated in the annual budget.
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
RICHMOND, INDIANA:
SECTION 1. That for the expenses of the City Government and its
institutions for the year ending December 31, 1975,.the following
amount of money is hereby appropriated and set apart out of the
Federal Revenue Sharing Trust Fund for certain ordinary and necessary
maintenance and ordinary and necessary capital expenditures, said sum
being subject to all laws governing the same and such amount appro-
priated shall be held to include all expenditures to be made during
the year unless expressly stipulated by law.
SECTION 2. That for the fiscal period there is hereby appropriated
from the Federal Revenue Sharing Trust Fund for the hereafter enumerated
purposes the following specified amount to meet the extraordinary
emergency hereby declared to exist:
SERVICES PERSONAL
(City Court) $ 8,500.00
SERVICES CONTRACTUAL
(Clinton) $12,000.00
SECTION 3. An extraordinary emergency exists for the above appro-
priation and it has been recommended by the City Controller.
SECTION 4. This Ordinance shall be in full force and effect from
and after its passage and approval by the Mayor and is subject to
the laws of the State of Indiana governing emergency appropriations.
PASSED AND ADOPTED by the Common Council of the City of Richmond,
Indiana, this day of 1975.

EXCERPTS OF THE MEETING OF THE COMMON
COUNCIL OF THE CITY OF RICHMOND, INDIANA
The Common Council of the City of Richmond, Indiana, met in regular session
in the Council Chambers in the Municipal Building of said City March 17,
1975 , at the hour of 7:30 P.M.
Councilman Merchanthouse presided with the following members present: Messrs.
Brown _ �, Cornett Elstro Geier ,
Hilton , Marino , Mills Williams ,
Absent: None ,
The following business was had to -wit:

The Clerk presented proof of publication of Notice to Taxpayers printed in the
Richmond Palladium Item, a newspaper of general circulation in the City of
Richmond, Indiana, on the dates of March 5 and March 12 1975 .
Said notices stated that a public hearing would a eId on thel7th day o
March 1975 by the Common Council to consider additional appropria-
t oni s as provided or in Ordinance Mo. 2986-1975 , within the City of
Richmond, Indiana. The proof of publication angposting of notices were
examined and found to be correct and in order. Councilman Geier
moved the proof of publication and posting of notices be received a and ordered
filed, seconded by Councilman Elstro and on voice vote the motion
was carried.
The Clerk read on second reading Ordinance No. 2 86�1975•�
Councilman Mills moved for engrossment of Ordinance No. 2986-1975, seconded by
Councilman Williams and on unanimous voice vote the motion was carried.
Councilman Geier moved to suspend the rules and place Ordinance No. 2986-1975
on third reading by title only, seconded by Councilman Elstro and on unanimous
voice vote the motion was carried.
The Clerk read on third reading by title only Ordinance No. 2986-1975.
After hearing all persons present, Ordinance No._ c was placed on
