WHWAS, many of these structures are not being utilized at their highest and best use, and SECTION 5, MMMS, it is in the best interest of the health, safety, and welfare of the citizens of Ridmnid, Indiana to encourage the upgMdIrg of these homes and neighborhoods. SUE, BE IT am= by the Common Council of the City of Richnm-A, Indiana, that Article 22 and Article 23 of the Zonirg Ordinance of the City of Richmond, Indiana, Ordinimce No. 2325-1968 be amended to allow admindstrative business offices and profesnionel offices in R-3 and R-4 residential districts, in existing structures, by Special Use pea�dt, subject to Article 48 of said Zcmirg Ot4tunce, the stated intent.af this ordinannce, the requirement of the petition listed in Subsection II, arcs other provisions provided hereafter, as follows; A. II. It is intended to. apply benefits of this ordinance predominately to the structures in the near downtown areas of Ricimaond. III. (SAL MIMM OF PETTTION-AND SPECIAI. USE; A. The petitioner for such a Special Use shall submit five (5) copies of a notarized affidavit of its proposal including the following: 1. Off• -street -pa plan. showing the location of off-street I��. Petitioner shall submit data on all planned uses in the subject structure, Uses other than those submitted with the petition may be aged thereafter only after submission of another Special: Use Petition under this ordinance. C, MIP. granting of a Special Use mx er this ordinance shall not prohibit other permitted uses pursuant to the applicable Zoning classification. D, S Each. Use granted for a structure pursuant to this ordinance permitted a plaque, on the front of the structure not to exceed one (1) square foot or 144 square: Inches. No lighted signs will be Permitted. No additional sigma other than traffic signs shall be permitted. IV. A Special Use granted pursuant to this ordinance shall be subject to such conditions concerning off-street parking; landscaping, structural InProvement or other conditions or restrictions which the Csaamissio n may recommend and the Council may provide .in accordance with Article 48 of the said ZMAng Ordi=nce, Tbe Planning Department of the City of Richmatd shall inspect each Property on, a quarterly basis for adherence to affidavit and other conditions and restrictions until such time as the improvmwts to the proper.-j have been cavleted, No'person shall continue to use the property in question pursuant to a Special Use granted under this Ordinance after such time that said Person is not in compliance with his proposal or other conditions or restrictions the Plan Commission may re=smend and the Comm Council may provide; Any such continued use shall constitute a violation of the Zoning Ordinance of the City of Rich nand, Iddirana, V.
