HomeMy Public PortalAbout20150420-1-CURRENTCOUNCIL1 REGULAR COUNCIL MEETING, APRIL 20, 2015 – CURRENT COUNCIL CALL TO ORDER The Regular Council Meeting of April 20, 2015, was convened at 6:00 P.M. by Mayor Eric Struemph. ROLL CALL The following Council Members were present for the roll call: Present: Branch, Costales, Graham, Henry, Hussey, Medin, Mihalevich, Prather, Scrivner, and Ward Absent: None A quorum was declared present. ADOPTION OF THE AGENDA A motion was made by Councilman Hussey to adopt the agenda with the addition of addition of invited guest Yvonne Matthews under “Presentations from Sta ff, Consultants, and Invited Guests”. The motion was seconded by Councilman Graham, and approved unanimously. MISCELLANEOUS AGENDA ITEMS City of Columbia Mayor Bob McDavid made a presentation to the City and explained the City of Columbia was reimbursing the City of Jefferson the $100,000 appropriated as a joint funding agreement to support the Regional Airport. He indicated the amount being refunded includes interest accrued during the time of the funding, and thanked Mayor Struemph for his efforts on this project. PUBLIC HEARINGS (a) Rezoning 0.18 Acres at 1501 and 1503 E. High Street from RS-4 to PUD Following a staff presentation by Planning and Protective Services Director Janice McMillan, Mayor Struemph opened the floor to the public for testimony on the issue. 2 REGULAR COUNCIL MEETING, APRIL 20, 2015 – CURRENT COUNCIL In favor: Ms. Marian Fleischmann stated she was appearing on behalf of the applicants Hank and Linda Stratman and offered to answer questions about the rezoning request. No one came forward to speak in opposition to the proposed rezoning. Mayor Struemph declared the evidentiary portion of the public hearing concluded and stated the Council would now take up the associated pending bill. 2014-131, sponsored by Councilman Graham, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 0.18 ACRES FROM C-2 GENERAL COMMERCIAL AND 0.55 ACRES FROM RS- 4 SINGLE FAMILY RESIDENTIAL TO PUD PLANNED UNIT DEVELOPMENT, FOR LAND ADDRESSED AS 1501 AND 1503 EAST HIGH STREET, DESCRIBED AS PART OF OUTLOT 72, IN JEFFERSON CITY, COLE COUNTY, MISSOURI. Bill 2014-131 was read third time by title, placed on final passage , and passed by the following roll-call vote as Ordinance 15388: Aye: Branch, Costales, Graham, Henry, Hussey, Medin, Mihalevich, Prather, Scrivner, and Ward Nay: None (b) Preliminary PUD Plan for Property Addressed as 1501 and 1503 E. High St Following a staff presentation by Planning and Protective Services Direct or Janice McMillan, Mayor Struemph opened the floor to the public for testimony on the issue. Mayor Struemph declared the evidentiary portion of the public hearing concluded and stated the Council would now take up the associated pending bill. 2014-132, sponsored by Councilman Graham, entitled: 3 REGULAR COUNCIL MEETING, APRIL 20, 2015 – CURRENT COUNCIL AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A PRELIMINARY PUD PLAN FOR PROPERTY LOCATED AT 1501 AND 1503 EAST HIGH STREET; DESCRIBED AS PART OF OUTLOT 72, JEFFERSON CITY, COLE COUNTY, MISSOURI Bill 2014-132 was read third time by title, placed on final passage , and passed by the following roll-call vote as Ordinance 15389: Aye: Branch, Costales, Graham, Henry, Hussey, Medin, Mihalevich, Prather, Scrivner, and Ward Nay: None (c) Voluntary Annexation and RS-3 Zoning Plan for 0.78 Acres at 2111 Bald Hill Rd Following a staff presentation by Planning and Protective Services Director Janice McMillan, Mayor Struemph opened the floor to the public for testimony on the issue. No one came forward to speak in opposition to, or in favor of, the voluntary annexation. Mayor Struemph declared the evidentiary portion of the public hearing concluded and stated the Council would now take up the associated pending bill. 2014-133, sponsored by Councilman Graham, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO THE PRESENT CITY LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, ADDRESSED AS 2111 BALD HILL ROAD; DESCRIBED AS PART OF OUTLOT 112 AND PART OF THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 20 TOWNSHIP 44 NORTH, RANGE 11 WEST, IN THE COUNTY OF COLE, STATE OF MISSOURI; AND AMENDING SECTION 1-17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY BY ADDING ONE NEW SUB-SECTION PERTAINING TO THE SAME SUBJECT. Bill 2014-133 was read third time by title, placed on final passage , and passed by the following roll-call vote as Ordinance 15390: Aye: Branch, Costales, Graham, Henry, Hussey, Medin, Mihalevich, Prather, Scrivner, and Ward Nay: None 4 REGULAR COUNCIL MEETING, APRIL 20, 2015 – CURRENT COUNCIL PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS Ms. Yvonne Matthews made a presentation announcing the 1890 Wellness Walk which would be held, rain or shine, at Lincoln University on Thursday, April 23, from 4:00 to 7:00 P.M. and urged everyone to participate or sponsor someone to participate in the event. Mayor Struemph thanked Ms. Matthews for her presentation. Parks, Recreation & Forestry Director Bill Lockwood gave a brief update on the ongoing meetings with Lincoln University regarding the multipurpose building partnership project. He stated that the Commission and LU staff will be participating in an all -day retreat scheduled for Friday, April 24, to discuss the issue. He then answered questions asked by the Council. ANNOUNCEMENTS BY THE MAYOR, COUNCIL, AND STAFF Councilman Hussey announced the upcoming Serve Jeff City event on Saturday, April 25, and urged those who wished to volunteer to help beautify our City’s United Way agencies to please make contact through the ServeJeffCity.org website, or just show up the at the Riverside Park kickoff on the morning of April 25. PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS No presentations were made at this time. CONSENT AGENDA Mayor Struemph stated that the following items were presented to the Council for their approval by consent at this time: a. Minutes of City Council Meetings: April 6, 2015 b. Agreement with the County for EMS services A motion was made by Councilman Hussey to approve the Consent Agenda as presented, seconded by Councilman Graham, and approved with Councilman Costales abstaining. BILLS INTRODUCED 5 REGULAR COUNCIL MEETING, APRIL 20, 2015 – CURRENT COUNCIL 2014-138, sponsored by Councilman Scrivner, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH COLE COUNTY MISSOURI AND DUNKLIN STREET PROPERTIES, LLC, FOR RESOLUTION OF ISSUES PERTAINING TO THE SOUTHSIDE TIF. Councilman Scrivner requested that the rules be suspended and Bill 2014-138 placed on final passage. City Counselor Drew Hilpert explained that the reason staff requested suspension of the rules is that the current Council Members were familiar with, and have been involved in, decisions regarding the negotiation s throughout the issue. Thus, he believed it advisable that the current Council take the action needed to resolve the issue. There were no objections to the request to suspend the rules. RESOLUTIONS There were no resolutions presented at this time. PRESENTATIONS FROM THE GALLERY ON OTHER TOPICS No presentations were made at this time. COUNCIL AND STAFF RESPONSE TO PRESENTATIONS FROM THE GALLERY There were no comments made at this time. NEW BUSINESS Mayor Struemph presented a plaque to outgoing Councilman Ron Medin and thanked him for his willingness to serve in the four-month gap following the resignation of Councilman Bray until the April election could fill the vacancy. Council Members also expressed their thanks to Councilman Medin for his service. President Pro Tempore Scrivner presented a plaque to outgoing Mayor Struemph for his years of service as both Councilman and Mayor, and shared a list of accomplishments during his tenure. Following his presentation, Council Members made comments thanking Mayor Struemph for his service. UNFINISHED BUSINESS Mayor Struemph announced that after this meeting of the Current Council adjourned, a ceremony will be held for the swearing-in of newly elected City officials, followed by convening of a second meeting of the New Council. APPROVAL OF CLOSED SESSION MINUTES 8 REGULAR COUNCIL MEETING, APRIL 20, 2015 – CURRENT COUNCIL A motion was made by Councilman Hussey to approve the April 6, 2015, Closed Session minutes, seconded by Councilman Graham, and approved unanimously by the following roll-call vote Aye: Branch, Costales, Graham, Henry, Hussey, Medin, Mihalevich, Prather, Scrivner, and Ward Nay: None ADJOURN SINE DIE A motion was made by Councilman Medin that the Council adjourn Sine Die, seconded by Councilman Graham, and approved unanimously at 7:01 P.M.
