HomeMy Public PortalAbout17-02 DECLARING AND EMERGENCY AMENDING SECTION 11-61 EMERGENCY ORDINANCE NO. 17-02 AN EMERGENCY ORDINANCE OF THE CITY OF OPA- LOCKA, FLORIDA; DECLARING AN EMERGENCY; AMENDING SECTION 11-65 OF THE CODE OF ORDINANCES OF THE CITY OPA-LOCKA, FLORIDATO ALLOW THE CITY OF OPA LOCKA TO ISSUE MULTIPLE FRANCHISE AGREEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Opa-locka's ("City") exclusive franchise agreement for commercial solid waste collection and disposal expired on January 28, 2016; and WHEREAS, the expiration of the exclusive franchise agreement has created an emergency whereby the City is without a commercial solid waste collection and disposal provider; and WHEREAS, under the provisions of the Code of Ordinances of the City of Opa-locka, Florida ("Code") the City is only authorized to issue an exclusive franchise agreement; and, WHEREAS, allowing the City to issue multiple franchise agreements will provide better service and prices to businesses within the City; and WHEREAS, the City Commission finds that the adoption of this Ordinance is necessary in order to protect the public health, safety and welfare; and WHEREAS, the adoption of this Ordinance is required to provide for the immediate preservation of the public welfare by permitting the City Manager to seek multiple franchises to provide cost-effective commercial solid waste collection and disposal services that will meet the unique needs of the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF OPA-LOCKA, FLORIDA, THAT: SECTION 1.LEGISLATIVE FINDINGS AND INTENT. The above stated recitals to this Ordinance are hereby incorporated into this Ordinance by the Commission as the legislative findings and intent pertaining to this Ordinance. SECTION 2.DECLARATION OF EMERGENCY. Pursuant to state law and based upon the Legislative Findings set forth in the above-stated Recitals, the City Commission of Opa- locka hereby finds and declares that an emergency exists requiring immediate action by the City Commission. By virtue of the threat to public health and safety and by virtue of the threat to the City's financial health and home rule powers, it is necessary for the City to implement this regulation, which can only be accomplished by the adoption of this Emergency Ordinance. Ordinance No. 17-02 SECTION 3. MODIFICATION OF CODE OF ORDINANCES OF THE CITY OF OPA-LOCKA. The Code of Ordinances of the City of Opa-locka, Florida, is hereby amended as shown in Exhibit "A", which is attached and made a part hereof. Except as specifically amended by this Ordinance, the Code of Ordinances of the City of Opa-locka, Florida, shall remain unchanged, and is hereby ratified and confirmed. SECTION 4.SEVERABILITY.If any provision of this ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such provision and such holding shall not affect the validity of any other provision, and to that end, the provisions of this ordinance are hereby declared severable. SECTION 5. CONFLICTS. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6. INCLUSION INTO CITY CODE. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City. SECTION 7. EFFECTIVE DATE. This emergency ordinance shall take effect immediately upon its passage, and shall expire on April 4, 2017. Nothing contained in this ordinance shall give rise to any vested rights, equitable estoppel, or claim for continuing any specific land use. (a) The city shallias-Lie-aRmav issue cxclueive multiple franchise agreements to engage in commercial solid waste service, provided that an-applicants for said franchise agreements shall, in the judgment of the city commission, be qualified to serve in such capacity, and further provided that said applicants for said franchises shall meet the specifications set forth in this article as a condition for the issuance of said franchise agreements, and such other specifications and requirements as the city commission may from time to time promulgate. The city retains all of the powers of a municipality of the State of Florida, for the exercise of its police power governing the health and welfare of its citizens for the purpose of reviewing the services rendered to the commercial, multifamily and nonresidential accounts, the maintenance of rate schedules, method employed for the accumulation and removal of waste, and the imposition of penalties for failure to render service to particular commercial accounts or the violation of the provisions of this Code. (b) The city manager or designee shall, with the successful applicants, have the power to establish the type, frequency and amount of solid waste collection service needed and to be rendered to all areas of the city and to promulgate rules and regulations not inconsistent herewith. Further, the city manager or designee, along with the franchisee, is authorized to implement the terms of the franchise so that questions of use of public streets, problems of access to customers for service which might arise from time to time, complaints, if any, and other questions can be justly and expeditiously resolved. The city shall provide means of egress and ingress to points to be collected by the franchisee and require the cooperation of its citizenry and commercial establishments in implementing the services provided by this article. (c) The franchiseesshall not be authorized to assign its-their licenses or subcontract any portion thereof without the specific written consent of the city. (d) The city shall determine the monthly rate schedule for service of all accounts in the city and said rates shall be binding, upon mutually consent, with the franchisees. The rate schedule shall be subject to review once a year at each anniversary date of the franchise agreements. The franchisees may petition the city commission for a change in the scheduled rates and shall submit proper proof and substantiation to the city commission which, in its discretion, may amend the schedule of the rates applicable to the franchisees. (e) The city manager, or franchisees, shall be assigned the responsibility for enforcement of commercial solid waste collection procedures enumerated herein. (Ord.
