HomeMy Public PortalAbout2991-1975 - AMENDING SPECIAL USE ORDINANCE 2456-1970ORDINANCE NO. 2991-1975 AN ORDINANCE AMENDING SPECIAL USE ORDINANCE NO. 2456-1970 TO PERMIT THE CITY TO ACQUIRE FRONT FOOTAGE REQUIRED TO WIDEN NORTHWEST 5TH STREET. BE IT ORDAINED by the Common Council of the City of Richmond, Indiaha, as follows: SECTION 1. WHEREAS, Ordinance No. 2456-1970 allows a "Special Use" permit for Business and Professional Offices at 1810 Williamsburg Pike, in the City of Richmond, Indiana, more particularly described as follows: Being a part of the Northwest Quarter of Section Thirty (30), Township Fourteen (14) North, Range One (1) West, in the City of Richmond, Indiana, more particularly described as follows: Beginning at a point on the present centerline of the Williamsburg Pike, said point being one hundred eighty-five (185) feet south zero (0) degrees and eight (08) minutes west, two hundred ninety-seven and ninety-five hundredths (297.95) feet north eighty-nine (89) degrees and forty-two (42) minutes west, and three hundred one and eighty-three hun- dredths (301.33) feet north thirty-four (34) degrees and fifty-seven (57) minutes west, of the southeast corner of the Northeast Quarter of Section Thirty (30), and running thence, from said beginning point, north eighty-nine (89) degrees and forty-two (42) minutes west, parallel to the south line of said Northeast Quarter, five hundred seven and ninety- seven -hundredths (507.97).feet to a point on the centerline of Mendleson Road; thence north zero (0) degrees and thirteen (13) minutes west, along said centerline, two hundred eighteen (218) feet; thence south eighty-nine (89) degrees and forty-two (42) minutes east, parallel to the south line of said Northeast Quarter, three hundred fifty-five and eighty-two hundredths (355.82) feet to a point on the.present centerline of said Williamsburg Pike; thence south thirty-four (34) degrees and fifty- seven (57) minutes east, along said centerline, two hundred sixty-six z.~' twenty-five hundredths (266.25) feet to the place of beginning, containing an area of two and sixteen hundredths (2.16) acres. SUBJECT TO: The right-of-way of all legal highways and any easements of record. 'SECTION 2. WHEREAS, Ordinance No. 2456-1970 has been approved in final form with restrictions, and, SECTION! 3. WHEREAS; the City now requires front footage from this property to widen Northwest 5th Street. SECTION 4. WHEREAS, it is the intent of this Ordinance to modify the approved plans to permit the City to acquire this property and, SECTION 5. WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 22nd day of April , 1975, at which time remonstrances were heard from 01 parties interested or affected by this Ordinance. SECTION 6. WHEREAS, the vote of the Richmond City Plan Commission was 9 to 0 in favor of/jot eppexi;tzen to recommending the passage of Ordinance No. 2991-1975. NOW THEREFORE: SECTION 7. It is hereby ordained that the original approved plan be altered to the extent necessary to facilitate the widening of NbrthWst 5th Street and that the restrictions on the original ordinance will apply to the new final approved plan. SECTION 8. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. All parties interested in or affected by this request were heard. No remonstrances were presented at the hearing. Four (4) letters were mailed to adjoining property owners and none were returned. On Tuesday, April 22, 1975, the Plan Commission voted 9-0 to recommend approval of the request to Common Council.
