AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968.
BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as
follows:
SECTION 1. WHEREAS, the Zoning [lap which is a part of Ordinance No. 2325-
1968 designates and describes as R-2 One -Family Residential District the
following described property located at the intersection of Woodside Drive
and Hayes Arboretum Road, in the City of Richmond, Indiana, more particularly
described as follows:
Being a part of the Southeast Quarter of Section Thirty-five
(35), Township Fourteen (14) North, Range One (1) West in
the City of Richmondlbeing more particularly described as follows:
Beginning two hundred (200) feet North of an Iron pipe,
said point being nine hundred sixty-four and eight hun-
dredths (964.03) feet North and zero (0) degrees and twenty-
six (26) minutes East (being measured along the West line
of the Southeast Quarter of Section thirty-five (35), four
hundred ninety-five (495) feet North eighty-eight (88)
degrees East and four hundred sixty (460) feet North zero
(0) degrees and twenty-six (26) minutes East of an iron
spike at the Southwest corner of said Southwest Quarter and
running thence, from said beginning point, South eighty-eight
(88) degrees West four hundred ninety-five (495) feet to the
center of Hayes Arboretum Road; thence North zero (0)
degrees twenty-six (26) minutes East along the center of
Hayes Arboretum Road four hundred forty and twenth hun-
dredths (440.20) feet to an Iron pipe set in the South right-
of-way line of the former Dayton and Western Traction Company;
thence North sixty-seven (67) degrees and twenty-eight (28)
minutes East five hundred thirty-seven and five tenths (537.5)
feet to an Iron pipe; thence South zero (0) degrees and
twenth-six (26) minutes West six hundred twenty-five and
seventeen hundredths (625.17) feet to the place of beginning,
containing an area of six and forty-eight thousandths (6.048)
acres.
SECTION 2. WHEREAS, it is the intent and purpose hereof to change the
Zoning Classification of the above described area from R-2 to C-2.
SECTION 3. WHEREAS, a study of this Ordinance was cond cted by the Rich-
MCRd City Plan Commission on the 5�� day of _ ,
1975, at which time remonstrances were heard from all p ties interested
in or affected by this Ordinance.
SECTION 4. WHEREAS, the vote of the Richmond City Plan Commission was
to 0 in favor off' to recommending the passage of
r nance No. 2992-1975,
NOW THEREFORE:
SECTION 5. It is hereby ordained that the zoning classification of the
above described property be, and the same is hereby changed to C-2
Community Business District, and that said property be regulated in
accordance with the Zoning Ordinance of the City of Richmond, Indiana,
and all amendments thereto.
SECTION 6. This Ordinance shall be in full force and effect from and after
its passage and publication as by law required.
SECTION 7. The original zoning classification of the aforementioned area
is hereby rescinded and the zoning classification of this area will be
in accordance with Section 2 of this Ordinance.

Case No. 9-1975, 6.048 acres at the
intersection of Hayes Arboretum Road
and Woodside Drive; request to rezone from
R-2 to C-2
Dear President Merchanthouse, Council Members & Mrs. Mellen;
The Richmond City Plan Commission held a public hearing on
Tuesday, April 22, 1975, at 7:30 P.M. in the Council Chambers
of the Richmond Municipal Building on the petition of
Fredrick and Cathryn McKinney, 1713 Windover Drive, Nashville,
Tenn., requesting to rezone 6.048 acres at the intersection
of Hayes Arboretum Road and Woodside Drive from R-2 to
C-2.
All parties interested in or affected by this request were heard.
No remonstrances were presented at the hearing. Nine letters
were sent to adjoining property owners and 1 was returned
unopposed. A personal visit to one of the neighbors resulted
in the same view.
On May 27, 1975, the Plan Commission voted 6-0 to recommend
approval of the rezoning to Common Council. Mrs. Bartz, Mr.
Case and Mr. Solomon were not present at the meeting.
