Home My Public Portal About3000-1975- APPROPRIATE 35000 FROM THE FEDERAL REVENUE SHARING TRUST FUNDORDINANCE NO, 3000-1975 AN ORDINANCE TO APPROPRIATE THIRTY FIVE THOUSAND DOLLARS ($35,000.00) FROM THE FEDERAL REVENUE SNARING TRUST FUND, FOR CERTAIN ORDINARY AND NECESSARY MAINTENANCE AND OPERATING EXPENDITURES AND FOR CERTAIN ORDI- NARY AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE LAWS OF THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF RICHMOND, INDIANA. WHEREAS, the State and Local Fiscal Assistance Act of 1972, Title I of Public Law 95-512 was approved October 20, 1972, WHEREAS, Section 51.40 of Part 51, Chapter I, Subtitle B, Title 31 of the Code of Federal Regulations provides as follows: A recipient government which receives entitlement funds under the Act shall: (c) Provide for the expenditure of entitlement funds in accordance with the laws and procedures applicable to the expenditure of its own revenues; WHEREAS, pursuant to the said State and Local Fiscal Assistance Act, the proper legal officers of the City of Richmond, Indiana, have established a trust fund known as the Federal Revenue Sharing Trust Fund, WHEREAS, revenues are available in said trust fund to be used for certain ordinary and necessary maintenance.and operating expenditures and for certain ordinary and necessary capital expenditures, WHEREAS, there is a need for funds for certain ordinary and necessary maintenance and operating expenditures and for certain ordinary and necessary capital expenditures as authorized by law, and WHEREAS, certain extraordinary emergencies have developed since the adoption of the existing annual budget so that it is now necessary to appropriate more money for the various functions of the City Govern- ment than was appropriated in the annual budget; NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOUD, INDIANA: SECTION 1. That for the expenses of the City Government and its insti- tutions for the year ending December 31, 1975, the following amount of money is hereby appropriated and set apart out of the Federal Revenue Sharing Trust Fund for certain ordinary and necessary maintenance and operating expenditures and ordinary and necessary capital expendi- tures, said sum being subject to all laws governing the same and such amount appropriated shall be held to include all expenditures to be made during the year unless expressly stipulated by law. SECTION 2. That for the said fiscal period, there is hereby appropriated from the federal Revenue Sharing Trust Fund for the hereafter enumerated purposes the following specified amount to meet the extraordinary emergencies hereby declared to exist: TO CONSTRUCT A PERFORMING ARTS CENTER TO BE LOCATED IN GLEN $35,000.00 MILLER PARK SECTION 3. That the contract to construct the Performing Arts Center be awarded within seventy-five (75) days from the date this ordinance is passed, or the funds appropriated shall revert back to the Federal Revenue Sharing Trust Fund. SECTION 4. An extraordinary emergency exists for the above appropria- tion and it has been recommended by the City Controller. SECTION 5. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor and is subject to the laws of the State of Indiana governing appropriations. Councilman Merchanthouse presided with the following members.present: Messrs. Brown , Cornett , Elstro , Geier , Hilton Marino Mills , Williams , Absent • _None , The following business was had to -wit: (OTHER BUSINESS HAD) The Clerk presented proof of publication of Notice to Taxpayers printed in the Richmond Palladium Item, a newspaper of general circulation in the City of Richmond, Indiana, on the dates of May 8 1 and May 15, 1975 Said notices stated that a public hearing would be held on the 19th day of by the Common Council to consider additional—appropria» t o s as pro- ed for in Ordinance No. 3000-1975 , within the City of Richmond, Indiana. The proof of pAlication and posting of notices were examined .and found to be correct and in order. Councilman Geier moved the proof of publication and posting of notices be received and ordered filed, seconded by Councilman Williams and on voice vote the motion was carried. The Clerk read on second reading Ordinance No. 3000-1975 Common Council met in regular session June 2,1975 at a hour of 7:30 P.M. All members were present. Councilman Marino moved for engrossment of Ordinance No. 3000-1975, seconded by Councilman Mills and on unanimous voice vote the motion was carried. Councilman Marino moved for suspension of the rules and read Ordinance No. 3000-1975 on third by title only, seconded by Councilman Mills and on unanimous voice vote the motion was carried. The Clerk read ontthird reading by title only Ordinance No. 3000-1975. After hearing all persons present, Ordinance No.3 was placed on final passage or rejection and cn a Call of the roll the following was recorded: Ayes; Brown Elstro Geier , 14i1ton , Milrino Mills , Williams ,Merchanthouse , Nees; Cornett Absent: None The vote being 8 to --fin- favor of passage of 00nanci No. 3000-1975.
